BUTLER COUNTY — The prosecution and defense in the John Carter murder case met in judges chambers Tuesday, Nov. 28, setting deadlines and a new hearing date, but again the case of the man accused of killing Fairfield’s Katelyn Markham in 2011 was not called in Butler County Common Pleas Court.

Carter, who is free on $1 million bond, was scheduled for a status report hearing before Judge Dan Haughey, but the hearing was continued until Jan. 16 with motions to be filed by Jan. 5.

This is one of those excruciatingly long cases. These cases teach me patience. I can’t imagine how her family and friends feel.

There have been three previous hearing continuances and Carter has not been in court since April. But he apparently was in the vicinity of the courthouse Tuesday ready to appear if the case was called, because his signature is on the pretrial entry form.

It appeared the prosecution believed the Tuesday hearing would happen — and so did Katelyn’s father, Dave Markham, who was in the hallway ready to go into the courtroom at 1 p.m. for the scheduled hearing. Markham expressed frustration at another continuance.

Prosecutors have turned over five rounds of discovery to Carter’s defense team that includes hundreds of items, some obtained as recently as this summer and fall.

On Dec. 21, more discovery was filed that included subpoenas for cell phone records, a TikTok video, Carter’s jail booking video, screenshots of text messages between “K.W.” and prosecutor’s investigator Paul Newton, Yahoo service records for Carter and response to a subpoena for Carter’s bank records, according to court documents obtained by the Journal-News



“As these cases start spinning, there is more material that comes about as the result of the charge having been brought,” Butler County Prosecutor Michael Gmoser said in September. “Just because there is an indictment doesn’t mean that we stop our investigation.”

Gmoser declined comment on the most recent discovery. Carter’s defense attorney Chris Pagan did not respond to a request for comment.

In November, the prosecution turned over discovery to Carter’s defense team that included 33 items.

Also included are a “Facebook search warrant for Michael Strouse,” “email from J. Ryan Green about Michael Strouse” and “screenshots from Facebook of Michael Strouse provided by J. Ryan Green.”

Green is a private investigator hired by Markham’s family to investigate her disappearance and death.

Strouse was convicted in 2019 of the death of 23-year-old Ellen “Ellie” Weik at his Liberty Twp. home. Within hours after Strouse’s arrest, Fairfield police, who initially investigated the Markham case, confirmed a meeting with the West Chester Police Department, which investigated the Weik case.

A photo also surfaced in 2019 of Strouse at a gathering picturing him with Markham and others.

Markham's remains were found in a remote, wooded area in Indiana almost two years later. Her death was ruled a homicide, but the cause of her death has never been determined.

Ten years later, Carter was arrested and charged. In April, Carter posted a $1 million bond and was released from jail.

What is the shocking twist? Just that no motions have been filed?
 
Will have to go back and read, but wasn't there something dodgy going on with at least one of his friends too at the time?
Either way, if you can post a $1 million bond you can pay $1 million for a fake alibi, and a phone ping is not proof of anything.
Curious what this "alibi" is.
Oh, wasn't this also the person who posted pictures of himself on Facebook pouring kool-aid into his kitchen sink? I have no idea why that memory just decided to pop into my head. Katelyn will get justice, I'm sure.
 
John Carter, 35, accused in the murder of his fiancee Katelyn Markham, 21, plans to offer evidence at his upcoming trial next month that he “was not at the scene of the alleged crime of the alleged offense,” according to the Notice of Alibi.

The two-sentence notice filed on Friday in the Butler County Common Pleas Court redacts the address Carter was at in Fairfield, Ohio, but says he was there from the late hours of Aug. 13, 2011, to the early morning hours of Aug. 14, 2011, when Markham was killed.

“I would assume anybody who is saying they didn’t do something is going to claim that they were somewhere else. That’s fine,” Butler County Prosecutor Michael Gmoser said, The Journal-News reported.

Less than 3 months from jury selection for the trial of a man accused of killing his fiancée Katelyn Markham in 2011, prosecutors have issued 64 nameless subpoenas and eight rounds discovery while the defense remains silent.

 
IMO. Kill her, stash her body, get to alibi location, move body to found location when things cool down.

The art student suffered trauma and her remains were not originally in the location where they were found, according to a forensic anthropology report released by prosecutors late last year.
