I agree we only know what is reported, but unless somehow there is another shoe to drop, this seems the scope of it. The big difference to the DM case is they had a forensic link. Here we have the witness ID, but it doesn't appear to be so definitive if it's based on eye colour and an assessed...

This is the part I am struggling with @Janosch As you know, this kind of similar fact evidence is typically tightly restricted in Courts. Generally you would have evidence against the accused, plus some previous similar offending that is so distinctive and similar that it's seen as adding...

Abby & Libby - The Delphi Murders - Richard Allen Arrested - #184

The para I quoted (and that you repost below) are findings by the Judge (IMO) IMO she did not misspeak. She found that they were not in fact suspects at the time and therefore the interviews not material. The onus was on the defence to show the content was material and that LE knew this at the...

Abby & Libby - The Delphi Murders - Richard Allen Arrested - #184

I wanted to take some time to think before responding. I guess where I am a bit lost on the second motion to dismiss is it just doesn't feel like a legal argument to me. The point of departure is the following factual findings by the Judge following the first motion to dismiss. Contrary to...

Abby & Libby - The Delphi Murders - Richard Allen Arrested - #184

sure but he was investigated and they confirmed an alibi so that rules him out. what am i missing here? i guess i am struggling with how alleged missing evidence can lead anywhere unless we are going to argue there is an intentional coverup. But that is a very heavy lift? is that where you...

It's just lawyers doing their job IMO. Many times in the UK we don't find out about these arguments because all the big evidential arguments usually take place pre-trial or in chambers. IMO

Abby & Libby - The Delphi Murders - Richard Allen Arrested - #184

Sure that was aimed at @Melted. Apologies. I agree it might be something investigators would look at but does it rise to the standard of a court looking at it? To me this feels like innuendo when they don't have anything to incriminate either BH or PW and BH has an alibi. If I've understood...

Personally I am struggling to see the bombshell here? What am I missing?

Just to note that the defence moving to exclude evidence is a fundamental part of due process. Attacking the evidence of process grounds is the big half of the job IMO.

This kind of defence that the prosecution had tunnel vision and didn't investigate the case properly can be effective. It'd be interesting to know the similarities of the other convictions. MOO

I think there is decent evidence that CB is guilty of the 3 rapes but I wonder if it rises to the criminal standard. MOO

the reality is once the hype wore off it’s returned to being a small local case that isn’t big news in Germany. that’s why you see some decent local coverage and a bit in Bild but nothing in the majors. similarly the UK media who supposedly were hot for this trial have published not much...

The whole theme of the HaB attack is the attacker took precautions to leave no forensics and so he could not be recognised. So that makes it difficult to prosecute or to link to any other solved case IMO
