NY - $250m fraud against Former President Donald Trump, Trump Org., Eric, Donald Jr., Sept 2022, Trial 2 Oct 2023, #2

Another failure in court for Trump.

A judge in London on Thursday threw out a lawsuit by former U.S. President Donald Trump that accused a former British spy of making “shocking and scandalous claims” that were false and harmed his reputation.

Judge Karen Steyn said the case Trump filed against Orbis Business Intelligence should be dismissed. “There are no compelling reasons to allow the claim to proceed to trial,” she said.

How long until these become SLAAP?

It is not yet clear whether, if the deal happens, Mr. Weisselberg would plead guilty to a low-level felony or a misdemeanor, or what his sentence might be.

It is also unclear which of Mr. Weisselberg’s statements in the civil fraud case caught prosecutors’ attention — but trial transcripts offer hints.

In 2022, the attorney general, Letitia James, sued Mr. Trump, his adult sons and Mr. Weisselberg, accusing them of fraudulently exaggerating the value of the former president’s assets to obtain favorable loans from banks. One such asset was Mr. Trump’s triplex apartment in Trump Tower, which is 10,996 square feet, but had been listed for years on his annual financial statements as measuring 30,000 square feet.

While testifying, Mr. Weisselberg claimed that he “never focused” on the unit.
Shortly thereafter, Forbes magazine published an article contending that Mr. Weisselberg had lied under oath. The article cited emails and notes between the former chief financial officer and the magazine, which compiles a list of America’s richest people, showed that Mr. Weisselberg “played a key role in trying to convince Forbes over the course of several years” of the apartment’s value.

After that article was published, Mr. Weisselberg abruptly stopped testifying.
Mr. Weisselberg was also questioned under oath in 2020 about the triplex during an interview with Ms. James’s office, statements that might now also be under scrutiny by the district attorney’s office.

I am going to post this now - since I will be leaving Sunday on my vacation [to Sweden] - and might miss the decision...

Sometime from early to mid-February for decision.

1/31/24 Wednesday, Trial Day X: 1/31/24 Update: The verdict in the NYAG's sprawling civil fraud lawsuit against Trump & his family company won't come until early February, a source familiar with the timing told Business Insider. NY Supreme Court Justice Arthur Engoron, who oversaw the three-month bench trial, had previously said he aimed to issue his verdict in the case by the end of January. That's no longer the plan. The written verdict is now expected to hit the electronic court docket on or around 2/5/24, according to the source, an insider who spoke to BI on condition of anonymity.

2/2/24 Update: Negotiations to Plead Guilty to Perjury. Allen H. Weisselberg would admit to lying on the stand during Trump’s civil fraud trial, according to people familiar with the talks. [While testifying, Mr. Weisselberg claimed that he “never focused” on the unit. Shortly thereafter, Forbes magazine published an article contending that Mr. Weisselberg had lied under oath. The article cited emails & notes between the former chief financial officer & the magazine, which compiles a list of America’s richest people, showed that Mr. Weisselberg “played a key role in trying to convince Forbes over the course of several years” of the apartment’s value. After that article was published, Mr. Weisselberg abruptly stopped testifying]. As part of the potential agreement with the Manhattan district attorney’s office, Mr. Weisselberg would have to admit that he lied on the witness stand in Mr. Trump’s recent civil fraud trial, the people said. Mr. Weisselberg, the former chief financial officer at Mr. Trump’s family business, also would have to say that he lied under oath during in an interview with the New York attorney general’s office, which brought the civil fraud case.
2/2/24 Update: “It’s looking like early to mid-February, as a rough estimate, and subject to modifications,” said Al Baker, a spokesperson for the Office of Court Administration.
2/7/24 Update: Judge Arthur Engoron is requesting more information about potential perjury committed by defendant Allen Weisselberg, the former Trump Organization CFO, according to an email shared on the court's docket. ...as he weighs decision. "I of course want to know whether Mr. Weisselberg is now changing his tune, and whether he is admitting he lied under oath in my courtroom at this trial." This is regarding the article in the NY Times (on 2/1/24) headlined "Trump's former finance chief in negotiations to plead guilty to perjury. Defendant's attorneys have by 2/7/24 to submit a letter detailing anything they know about this matter that would not violate any of their professional ethic or obligations. So he can make his final decision on the case.
2/7/24 Update: In a letter submitted to Jude Engoron Wednesday, defense attorney Clifford Robert urged the judge to strictly consider the record from the trial in his final decision, describing his request to provide information about Weisselberg based on a NY Times article "unprecedented, inappropriate & troubling." Citing their ethical obligations, lawyers for the defendants in Trump's civil fraud trial declined to provide details about "rumors of any kind" involving form Trump Organization CFO Weisselberg & urged Judge Engoron to make a decision solely based on the evidence presented at trial. In a separate letter, Alina Habba, who represents Weisselberg in the civil case but is not his criminal defense lawyer -- declined to provide any information about the potential perjury & argued that no further action was needed on the matter. NYAG Letitia James said on Wednesday that the potential perjury-related guilty plea of former Trump Organization CFO Allen Weisselberg should have no bearing on the outcome the civil fraud case against Trump.
2/8/24 Update: Judge Engoron's response - see post #510 page 26 thread #2 to letter submitted (above).

The ex-president pledged his devotion to his wife by referencing his many indictments in a pitch for supporters’ donations

“I think she’s going to be very active in the sense of being active,” Trump added.

Such a way with words.
