Dylan Redwine's father arrested in connection to son's death 22 July 2017

I think 16-48 years is Colorado's sentencing range for both second degree murder and child abuse resulting in death...in other words, the two types of unintentional killing MR has been charged with. He could be convicted of one or both charges (or neither). As for why the defense is asking for...

Dylan Redwine's father arrested in connection to son's death 22 July 2017

Kamille, I feel the same way. The Durango judge even agreed with the prosecutor that MR is a flight risk...why take the chance? Believe it or not, he does have supporters and I wouldn't put it past them to pool their resources for his portion of the bail ($112,500.).

    The correct figure is $112,500.

Dylan Redwine's father arrested in connection to son's death 22 July 2017

Bail is now set at $750.000 - he'll need to come up with $112,500 cash, and the remainder can come from a bail bondsman. So it's still a high amount, but conceivable that one or more supporters could come up with the $112,500. I don't know if he's on a suicide watch, that wasn't discussed...

Dylan Redwine's father arrested in connection to son's death 22 July 2017

The Denver Post published an article today that erroneously stated MR had posted bail. The Durango Herald says that is absolutely not the case, he remains in jail: https://durangoherald.com/articles/178930-redwine-remains-in-jail-despite-incorrect-newspaper-headline

Full video of advisement hearing: http://bit.ly/2wNBM1J Edited to add: In the early moments of the prosecutor's statement re bail, one of Redwine's public defenders jokes and laughs with the other one. Not a good visual. I wish the judge had kept the bail where it was.

In my layman's opinion, it would almost constitute ineffective assistance of counsel for a lawyer not to seek a change of venue. This case has been without resolution for so long, and opinions about it are held so passionately, that I can't imagine empaneling an impartial local jury.

He's had a couple of local attorneys for other cases, including his lawsuit against Elaine. Maybe one of them will take the bait. Here's a preview of what the prosecution can expect: https://durangoherald.com/articles/175028-former-defense-lawyer-mark-redwine-prosecution-will-be-difficult

Dylan Redwine's father arrested in connection to son's death 22 July 2017

Could he possibly be laying the groundwork for an insanity defense? He's knewn for some time that he is a "person of interest" and might actually be charged in the future...is he trying to act delusional, or as if he has no memory of what went on? The La Plata County jail and courthouse are...

Dylan Redwine's father arrested in connection to son's death 22 July 2017

I agree, DeDee. Based on what we know so far, the only reasons I can come up with for the 2nd degree murder indictment with child abuse are that a) historically, prosecutors often lose cases because they overcharge, and conscientious jurors don't want to make a mistake, and b) the prosecutorial...

Dylan Redwine's father arrested in connection to son's death 22 July 2017

My understanding of 1st degree murder v. 2nd degree (based mainly on hearing lawyers comment on the difference on TV) is that 1st degree doesn't require an elaborate plan - a killer can formulate the idea even a minute before the act, and if he/she has even a sketchy plan of how to carry it out...

Has the case fizzled a bit?

Right, there is. This is precisely why DAs prefer to try cases that are freighted with hard evidence - they want to avoid embarrassment, and they do not wish to lose elected office by "wasting" taxpayers' money on grand juries and cases that carry a high risk of acquittal. The culture of...

Has the case fizzled a bit?

Right. And in addition to most people (typically those who weren't absorbed by the case early on) being tired of the Ramsey name, citizens today are bedeviled by all manner of financial, social and political woes that were not predominant in 1996 - our focus was narrower: it could afford to be...
