Prosecution Files Depositions On Casey Defense Witnesses

ORANGE COUNTY, Fla. -- The defense team in the Casey Anthony murder trial has suffered another hit to their case.

The defense team said the volunteers searched the area on Suburban Drive where Caylee’s remains were found.

But, according to the depositions, all five said they never searched the area. They said they didn't even get out of the car.

Meanwhile, a judge is expected to rule this week on whether prosecutors can use air tests performed on Casey's trunk, also whether the jury will hear evidence that cadaver dogs alerted on Casey's trunk and her back yard, and the botany test results as to how long body was in that location.

Former Casey Anthony boyfriend Anthony Lazzaro says in a newly released deposition filed in court Wednesday that Casey Anthony told him her father physically abused her.

"From what I remember, I think it was just hitting – that she was physically abused," Lazzaro told attorneys during a Feb. 18 deposition.

Both Lazzaro and Huizenga figure to play prominently .

He said Caylee never appeared to be neglected or abused, but when asked about Casey, Lazzaro said she had told him about being abused herself.
"I just don't recall it being sexual in nature," Lazzaro said. "It could have been. Honestly, it would have been much better to do this at that time. I just know she said that they didn't live together and she made it sound like her dad was like this really bad guy."

The former friend also told of how Casey Anthony described a foul odor in her car.

"There were definitely a day or two that she had been like, 'Dude, my car smells and I don't know what it is," Huizenga said. "She just said it smelled like, you know, something had died in her car and she had no clue what it is."

She thought it might have been a squirrel that her father may have hit while driving the car, Huizenga said.

"Like it was weird that Caylee was spending so much time with the nanny. Casey had taken all this time off work because she had vacation time, but wasn't with Caylee because she said that was a better circumstance."
She recalled Cindy Anthony describing the odor in Casey's car as "the most horrible smell that she had ever smelled and that they were terrified that it was either Casey or Caylee in the car – in the trunk – until they got it open."

Cindy Anthony asked Huizenga about Casey's job, and Huizenga said she thought she worked as an event planner at Universal Studios. "She [Cindy] said she didn't even think that Casey had a job," Huizenga said.

Cindy also told her "she didn't think she was a very good mother" and said "she was close to suing for custody of Caylee," Huizenga said.

"They've got to address the biggest elephant in the room -- why didn't she go to her own parents?" said Orlando criminal defense attorney Richard Hornsby, who is not affiliated with the case.

Who else could testify about trauma in Anthony's life? Her own family, says Hornsby.

"It seems they're pointing at George, who would overreact or act out. That is going to be why Casey didn't feel comfortable coming forward to her parents during the first 31 days," Hornsby theorized.

Perry said that the defense did not meet the legal burden needed to exclude the evidence.

The defense "did not present any factual evidence at the hearing in support of the grounds alleged in the motion, and therefore failed to meet (the defense's) burden of proof," Perry wrote.

The stain and any presence of fatty acids could help prove decomposition in the trunk.

Casey Anthony's parents want to be excused from a rule of sequestration that may be invoked during her upcoming murder trial because they are listed as witnesses but want to atend the proceedings.

George and Cindy Anthony's attorney filed a motion late Monday saying their constitutional rights would be prejudiced if they were excluded from "crucial stages" of the proceedings.

The motion said victims of crimes, including the next-of-kin of homicide victims, have the right to be present, "to the extent that it does not interfere with the constitutional rights of the accused."

ORLANDO, Fla. -- WFTV obtained a new motion filed by Casey Anthony's defense team wanting to prohibit, among other things, the party-girl pictures taken of Casey

Casey's lawyers are trying everything to prevent the jury from hearing what she was up to the first 31 days Caylee was gone.

The defense claims prosecutors cannot use that evidence to prove Casey's consciousness of guilt, because it doesn't show she was evading prosecution by fleeing, destroying evidence or covering it up.

ORLANDO, Fla. -- The judge in the Casey Anthony case dealt the defense another blow Tuesday afternoon, denying three motions where the defense sought to prevent evidence from being presented at trial.


Judge Belvin Perry denied the defense motions to disallow evidence involving the heart sticker, cadaver dog searches and alerts, and postmortem hair banding.

The judge has yet to rule on air tests.

The defense team Tuesday filed a new motion regarding the stain and asked Perry to reconsider. In this latest motion, Baez argued that the fatty acids were consistent with other items found in the trunk "that are not of human origin."

"This evidence is probative of absolutely nothing, and will only be successful in confusing the jury and asking it to rely on unconfirmed, speculative and unreliable science," Baez wrote.

As of Tuesday afternoon, Perry still did not issue rulings on other defense evidence objections, including: air samples, chloroform levels found in the trunk of Anthony's car and the growth of plant roots where Caylee's remains were found.

ORLANDO, Fla. -- Chief Judge Belvin Perry, late Wednesday afternoon, denied the defense's motion to throw out controversial chloroform evidence found in the trunk of Casey Anthony's car.
This decision could seriously jeopardize the defense's ability to convince a jury that Caylee Anthony's death was an accident.

Even Chief Judge Belvin Perry ruled that the evidence of a massive amount of chloroform, a leading research scientist found in Casey's trunk, could be related to the search for how to make chloroform on the Anthony's home computer and could be connected then to Casey.

ORANGE COUNTY, Fla. -- Casey Anthony was in court on Monday and broke down in tears as Judge Belvin Perry denied a motion (read motion) in reference to news organizations and a confidentiality agreement.

The arguments brought Casey to tears and Judge Perry, at one point, became angry.

Judge Perry talked about the confidentiality agreement to one of Casey's defense attorneys saying, "There is nothing, ma'am, in that agreement which would prohibit any news station if they found from independent sources, in broadcasting the location.

Media Outlets Appeal Judge's Order In Casey Case

ORLANDO, Fla. -- Several Florida media outlets have appealed a decision by Judge Belvin Perry in the case against Casey Anthony late Tuesday afternoon.

The media outlets that filed the appeal with the 5th District Court of Appeal were not local. They include: WPTV-TV, WFTS-TV, Naples Daily News, SCRIPPS Treasure Coast Newspapers, and The Associated Press.


Judge Perry indicated at Monday's hearing that an appeal could mean a delay in the start of Casey Anthony's trial. Jury selection is scheduled to begin May 9.

George and Cindy Anthony have asked to see their daughter, Casey, before the young woman’s murder trial begins.

“I am told her parents are waiting for her to decide whether or not they will have a video visitation,” WKMG’s Tony Pipitone reported. “Defense attorney Jose Baez was made aware of the parents’ request this week, and so far, George and Cindy Anthony have not heard back from their daughter’s attorney.”

The parents’ attorney, Mark Lippman, told WKMG that he would fight the release of video of such a visit. But such a fight depends on whether Casey agrees to see her parents at the Orange County Jail.

The judges are aware of the time-sensitive nature of the appeal, but cannot predict when a decision will be made, Simmons said.

Joanne Simmons, spokeswoman for Florida's 5th District Court of Appeal, said today that the circuit received the petition Tuesday night, and it has been assigned to judges William Palmer, Jacqueline Griffin and Kerry Evander.

Simmons said the judges are reviewing the petition and there has been no request for oral arguments.

ORLANDO, Fla. -- An order came down on Wednesday, involving the possible delay of Casey Anthony's murder trial. The public may have to wait an extra 48 hrs to find out when the trial will start.

The Fifth District Court of Appeal panel is giving Chief Judge Belvin Perry, prosecutors, defense lawyers and the State Attorney General until Friday morning at 10:00am, to weigh in on the media outlet's challenge.

ORLANDO, Fla. -- Lawyers for Casey Anthony don't want her own parents in the courtroom [/b]during her upcoming first-degree murder trial.
In a motion filed late Thursday by Anthony defense attorney Cheney Mason, he objected to the request from Anthony's parents.
"George and Cindy Anthony will likely be subject to impeachment by the testimony of other witnesses," the motion read.
The motion requests that the Anthonys remain sequestered during "relevant portions" of the trial.

ORANGE COUNTY, Fla. -- Casey Anthony's defense team filed a motion for an extension of time on Friday, minutes before a 10:00am deadline to file a response to petitioner's rule. However, shortly after the motion was filed it was denied.

The 5th District Court of Appeal had given a deadline of 10:00am

Defense attorney Cheney Mason had asked to be given 30 days to respond.

WFTV has learned that Casey Anthony's defense team has lost its jury selection consultant, Richard Gabriel. This is a huge blow to the defense.

A jury selection consultant is a person who helps trial attorneys choose their jury. Casey's defense team is now scrambling for a new consultant just three days before jury selection is scheduled to start.
