January 16, 2013 Morning Testimony

State witness Rafael Columbo

--works for Budget car rentals in Redding, California
--was working on June 2, 2008. Prosecution is asking how the car rental business work...how does somebody get a rental? Customers can call, walk up, or book a car on the website.
--Renters must have a valid drivers licence and a major credit card, if they are under the age of 25. If over they need a valid drivers licence.
#235, June 2, 2008 at 0804 hours, original car rental contract. There are three sheets that is associated with the rental. The name on the rental is Jodi Arias. Columbo identifies Arias in the courtroom. Columbo says that Jodi had called a few times before requesting a vehicle. During those calls she had stated her name. She wanted "something dependable". When Jodi arrived at Budget there was a male with her. Columbo asked where Jodi was going. She said she was going to "go around town, nothing big". Did not want a car that was "loud" in color. Jodi was offered a red car but she asked for a lighter colored one instead. Columbo mentioned she was single, and she was very friendly.
--Jodi's hair color was blonde at the time of the car rental.
--Car was due to be back on June 6, at 0815 hours.
--Rental agreement had unlimited miles.
--Jodi was asked where she was going because some vehicles may need an oil change and that may determine what car is given.
--Columbo was at the office when the car was returned and checked the car in.
--Noticed that the car has more miles than he thought
#237.001, car rental agreement. The car has been driven for 2484 miles.
--Jodi said that she had decided to take a longer trip.
--When cars are returned detailers clean it.
--Columbo does a walkaround to check it over for dents and scratches.
--Inside of the car...there were stains on the back seat. Appeared to be Kool-aid. Columbo cleaned it.
--Front seat....Kool aid stain on the passenger side.
--Back seat had a larger stain.
--All of the floor mats were missing.

CROSS EXAMINATION
--Columbo is a Budget contractor.
--DT wants to know if Budget partners with companies like Orbitz.com and if people can do online comparisons for rentals.
--Columbo cannot recall seeing Arias in the car rental system.
--Budget requires a valid drivers licence and a major credit card that is verified in the system.
--The credit card is swiped and verified.
--Budget does not offer insurance but it offers coverage.
--Columbo does not recall Arias showing proof of insurance.
--Interaction between Arias and Columbo was approximately 15 minutes.

Re: Exhibit #235 The rental form has a place for the drivers licence.

Exhibit 241--Jodi Arias driver's licence. The number matches the one on the car rental. Jodi's drivers licence has a post office box on her drivers licence. In 2008 it was okay to only have a P.O Box.
California requires both a back and a front licence plate.
 
January 16, 2013 Morning Testimony

STATE WITNESS DETECTIVE FLORES

--Video taped interview of Jodi where she is wearing the orange jail jumpsuit
--Flores is trying to get a reason "why" from Jodi and she will not give him one.
--Flores confronts her about the gun and shell casing, her blood, hair,
--Jodi says that she wasn't jealous, well maybe a little about Cancun.
--Flores continues to go over the evidence such as the knife and how she stabbed Travis. --Flores is asking for the truth. Jodi says nothing and stares at Flores.
--Flores asks what she did with the gun. She denies having a gun.
--Jodi says she "did not kill Travis" Flores says "I believe you did, I truely believe you did".
--Flores says that he has been at so many scenes and there is always, always evidence left behind.
--Jodi says that if she had planned to hurt him in any way she wouldn't stab him, she would shoot him, and she would have to wear gloves. *if* she had to kill him she would make as humane as possible. Jodi says that "Travis was still alive". Flores says he was shot first. Jodi now talking about Travis being attacked by the Ninjas. At that time Travis was able to move. He was sort of using his legs but he wasn't standing up.
--Jodi doesn't know what time she left.
--Flores now telling Jodi he gave her the only opportunity to tell the truth. The evidence does not make any sense. The evidence tells a story and it doesn't match Jodi's story. Asks Jodi if that is how she wants to leave it. Tells her he doesn't
--Jodi: "as long as I am here someone else is out there." Now going on about the male and female that killed Travis.
--Jodi asking if she could write his family a letter. Flores will not provide their address and if they want contact with her they can make it.
Flores concluding the video statement saying he hoped that they could resolve it here. <he reads his cell phone>. Flores is standing and ready to walk out. Tells Jodi she is hurting her family by not telling the truth.
 
DA questioning Det . . re: 6/15/08 interview w/JA . . . re: TA portraying himself a certain way . . . they kept their relationship hidden from everyone else . . . talked about "you had made the comment . . .. OBJECTION - Approach.

A few days back comment to JA about "you were just going there to have a good time and something got out of hand" . . .then talked about interview/interrogation techniques - trained in them (same thing) - some courses are labeled interview others are interrogation.

When he first became a Det - he took 30 hr basic course and later he took a more advanced 12 hr interview/interrogation course. In the academy there are basic courses on how to contact and interview people.

DA alleges there is a differences in interview w/witness vs. interrogation w/supect of a crime - yes.

These techniques are different in types of interview vs. interrogation - a little different because of the nature of what they are . . . . witness vs suspect - is there concern that suspect is going to be a little less (upfront?) with info -

what specific techniques . . . in every case it is different - sometimes you say I know your fingerprints were there and maybe they really weren't there.

Maybe you were going to there to have a good time and something got out of hand - it is a "theme" technique - after you get to know their lifestyle.

Mr. Alexander portraying himself a different way - he was trying to play on her emotions - he didn't see her as emotional - he was hoping to play on her emotions.

JA told him about intruders - in terms of interrogation of suspects - trained on indicators of deception ... certain things people do when deceptive - they turn away, play with clothes alot, other indicators.

He has conducted "hundreds or thousands" of interrogations over the years. Indicators of deception - non-verbal indicators. Are there verbal indicators? Could be . . . .

Based on training and experience - when people lie is there generally speaking do they throw a little truth in there to make lie be more beliveable - it has to be plausable - or believable. . . . Det job is to sort out some of that

Discussion about attempting to find a handgun - were there knives recovered @ Alexander home? yes - kitchen knives - several - there was a kitchen block - there were knives in the dishwasher - they could not determine if they were the ones used in the murder.

The yard and all around residence in and out was searched - didn't have anywhere to go in the neighborhood but everything in immediate area was searched.

On 6/15 they had a fairly complete investigation up to that point . . . one video centered around a period of time when he and JA talking about her move to Mesa. In that video she made a comment to the effect that Travis told her they could still hang out. . . . did hang out mean a code for having sex? . . . don't remember

tape cut off right off at the time when JA was talking about Travis and Lisa - Det. doesn't recall that specific . . . .

Exhibit #351 refresh recollection? sure.
 
Was the July 16th interview story much different than the 2nd story she gave you?

I was not able to download those - I didn't have any software with capability of doing that @ the time.

This issue inovlving the text messages has already been discussed . . .Melendez was not able to download text messages as they didn't have the technology

The Verizon guy testified they didn't keep text messages more than 3 days . . .

Submitted document for purposes for the court to rule on for the motion of this trial.

Defense cannot recall specific dates of other hearings . . .

STate - yesterday Defense said he wanted item - camera belonging to JA - seized from one of the homes searched in Yreka Calif- it was never requested before yesterday. Item was brought over to Defense yesterday.

Defense asks Lisa Andrews . . . . the telephone number is at least one year old - request State provide contact info

State says she called me during the break - he will call her and see if she will call Defense or visa versa
The reason State did not call her was because of the stalking . . . . we never indicated the stalker was the defendant - that info came from the defense in the opening statement. . . an issue like that was so infamatory - someone may say something to the effect the jury might consider this improper evidence of stalking . . .

She will testify (diadoni?) - she spent time with TA in 2007 it was raining - they went outside to look - saw TA's tires were slashed - he got them replaced the next day someone came to the door and his tires were again slashed and her tires were slashed - she was concerned her safety was at risk - she asked TA to spend the night with her - they did not have sexual contact.

The next day 12/08?/07 - she received a letter from John Doe - something to the effect you are a *advertiser censored* . . . . in State view he didn't want this to be tainted (stalker) -

Defense believes States "so called concern" is disingenuous - Defense doesn't need STate's advice - she was dating TA at the same time as JA . . . he is basically trying to imply down the road. . . let the chips fall where they may . . . don't know whether he is asking for preclusion(?) . . .. Defense certainly intends to call her.

STate said he will call her - he will tell her she is to be there and she is not to watch anything to do with this case. . . she has been reluctant about testifying - State will act as an intermediary.

Judge said allright - do that.

A: No. We didn't find anything like that

Q: Was the gun used to kill Mr. Alexander found in Ms Arias' possession?

A: No, it was not.

Q: Why were the fibers found at the scene, sandles, and pillows not sent to compare them?

A: We didn't feel it was necessary at that time.

Q: When you personally interviewed Mr. Alexander's roommates was there ever a mention of their concern for his extended absence June 4 thru June 9?

A: No. They believed he was in Mexico already. They didn't know his schedule.

Q: What were the alibis given by those roommates?

A: One was working and the other was actually staying at his girlfriend's home and they were house sitting for her parents.

Q: Did Mr. Alexander have a boarder or another person living in the house?

A: No. Just the two roommates.

Q: Were the fingerprints of the boarder taken to see if they matched any at the scene?

A: Yes. They were.

Q: With regard to the knife or gun: was Mr. Alexander's old BMW searched?

A: No. It was not.

another entry 5 min later - a different phone call - 961 seconds - same sort of entry as before

State calls Leslie Udy from Utah - met @ prepaid Legal convention in Las Vegas - in Sept. 2006. They had a few things in common . . .they talked. All expense paid trip by their company to Huntington Beach attended w/JA (and others) . . . JA mentioned she thought TA was seeing other girls because she had seen texts on his phone . . .she looked @ his phone while he was showering or sleeping.

She saw JA @ PPL business briefing - got over about 8:30 or 9:00. Leslie rode with JA over to Chili's to have something to eat. Leslie sat in front passenger seat. I didn't notice whether car had carmats, she didn't look for stains - it was dark. We actually sat in the parking lot and talked for close to an hour. She was acting like Jodi - same Jodi I always talked to.

During conversation - we talked about photography she had pictures from Huntington Beach to send to her . . . we talked about Travis - JA said they were not together anymore - which Leslie already knew. They (JA and TA) would be friends and see each other @ PPL events and one day their children would play with each other . . . JA's children would play w/TA's children one day.

JA said they would always be best friends . . . JA and Leslie went into Chili's - JA sat on Leslie's right side and next to her husband Mark. JA had injuries on her hand - said she broke a glass @ work and cut her fingers.

After that . . . received a call after finding out TA had been killed - she was very upset, disrought, crying - TA had been killed - couldn't imagine why someone would do that to TA, why would they do that. . ..

Another phone call - 2am the next morning - cellphone next to Leslie's bed - husband asked who would call @ this time in the morning - JA calling saying it was the time of night she would normally talk to TA and he was her best friend - she lost her BFF and she didn't know what to do.

State witness Detective Flores

State playing a phone message from Jodi to Flores on June 21, 2008. Jodi is asking Flores to call her regarding Travis.
Exhibit 366, phone record.

CROSS EXAMINATION

DT asking Flores about the photos recovered on the camera. DT asking if there was any other
Flores spoke to numerous people at the scene and none of them told Flores that Jodi was visiting Travis. DT says that's because it was a secret right? Prosecution objects, Flores does not answer

Next witness for the state: Jeff Strohn, works for Sprint/Nextel communications, a cell phone company

Exhibit #366, record from when the telephone call was made. Jodi's cell phone is 831-402-1901 and the records for that phone number are admitted.
--When this witness speaks, he looks at the jury. Strohn explains how the phone records work.
--Explains how calls register onto the network and what each column means on the records.
--When phone calls are routed to voicemail it is not going to show any cell site information.
--The telephone company itself has a server for voicemail.
--June 4, 2008, 2348 hours, called ended at 2351 hours. 169 seconds. 831-402-1901 is the calling number. Jodi's phone called a number twice.
--Another call on June 4, 2008 after the above noted call, lasted 961 seconds.

DT does not do a cross examination.

Next witness for the state: Leslie Udy--Leslie lives in Utah and knows Jodi, identifies her in court.
--Met Jodi the first time at a PPL convention in Vegas in September 2006.
--Became friends, had a few things in common like photography.
--Went to Huntington Beach in June 2007 with Travis and Jodi, it was an all expense paid trip put on by PPL.
--Leslie states that Jodi was concerned that Travis was seeing another girl as she had seen some texts from another girl. Jodi had looked at them while Travis was in the shower or asleep and

June 5, 2008, Thursday, in the evening around 1930 hours at a PPL business briefing. The event was over at 2030 hours. Leslie rode with Jodi to Chilis to have something to eat. Leslie sat in the front passenger seat. Leslie did not notice if there were any car mats. It was dark, she did not notice. Leslie did not notice stains on the car seat.
--Prior to the meeting Leslie and Jodi sat in the parking lot with Jodi for an hour and talked to her. Jodi's demeanor was "just Jodi".
--They spoke about photography. Jodi was supposed to
--Talked about Travis. Jodi said that they weren't together anymore. Leslie already knew that. Jodi said they would always be friends (Travis and Jodi) and someday they would see each other at PPL events and their children would play together (meaning Travis' children and Jodi's children). Jodi said that Travis had tried to get her to come to Mesa but Jodi said she had moved to California to get away from him. Jodi indicated that her and Travis would always be best friends.
--After the conversation Leslie and Jodi went into Chilis. Leslie is asked if her husband Mark said anything about any injuries.
--Jodi said she had broken a glass at work and cut her fingers.
--Leslie got a call from Jodi right after Jodi had found out that Travis had been killed. Call was from between 9-11. Jodi was distraught, sobbing. Jodi said that Travis was dead, he had been killed, couldn't imagine why somebody would do something to him. Travis was such a wonderful guy.
--Leslie got another call around 0200 in the morning. Leslie had told Jodi that she would keep her phone by her bed if Jodi needed to talk. Jodi was upset and crying, and that it was the time of day she usually talked to Travis. She had lost her best friend and didn't know what to do.
--Jodi never told Leslie that she had killed Travis.
