GUILTY VA - Tina Smith, 41, slain, 12yo daughter abducted, Salem, 2 Dec 2010 - #8

4.2 Notify Law Enforcement of Non-Caretaker Sexual Abuse
If a report is not valid because it alleges child sexual abuse perpetrated by a person who is not in a caretaker role, the local department (or CPS State Hotline staff if receiving the call) is required to report the allegation to the local law enforcement agency. The worker should telephone the information to law enforcement in the jurisdiction where the abuse occurred in accordance with any local protocol or standard procedures for reporting sex offenses involving juvenile victims. If there is any reason to believe a child may be in danger, the report must be made immediately. In all other cases, the report must be made on the same day it is received.
Additional procedures may be developed locally to ensure effective reporting and accountability.

IMO - Reports and how they are handled at CPS in VA seems convoluted. There is a procedure and time line to determine if a report is valid. The criteria is on their website. http://www.dss.virginia.gov/family/cps/index2.cgi

In this circumstance I think I would be willing to cry wolf "I suspect sexual abuse" instead of "I see inappropiate touching of hands and hair". Without knowing what the relatives reported it's hard to say if CPS did anything wrong. I think with overburdened and underfunded agencies; sometime the squeeky wheel gets the grease. So yell loud and long, go talk to someone in person, call LE etc etc. I say this now only after following this story.

Anyone else surprised that his arraignment was in Juvenile and Domestic Relations Court? I understand that "[t]he court also hears family abuse cases, cases where adults have been accused of child abuse or neglect, and criminal cases where the defendant and alleged victim are family or household members" (http://www.courts.state.va.us/courts/jdr/home.html ) but I'm just stunned that this hasn't been removed to federal court due to the interstate aspect. It can be removed to federal court at a later date, I suppose, but this is just surprising to me.

Also, his desire to move to general population is just more proof that he needs to be in the psych unit, IMO. Only a crazy person would ask for general pop after being arraigned on criminal charge(s) against a child. Be careful what you ask for, JSE...

Outstanding links. Thanks so much for posting them.

Regarding JSE’s last FB post that began “yesjd9c00”, I just read back in this and previous threads to see that it was discussed but I couldn’t find a post where the code had been deciphered. Did anyone have any luck decoding it that they could share? TIA

No, I don't think anyone actually did. (I could have missed it though).

I think that the general consensus was he pocket-dialled it. :cow:

Maybe he wants in gen pop so he can brag about what he did? If I were him I would want to be isolated.

Easley, 32, unshaven, handcuffed and dressed in an orange jail jumpsuit, was asked by Roanoke County Juvenile and Domestic Relations Judge Philip Trompeter if he needed a court-appointed lawyer.

"Yes Sir," Easley answered in a low voice.

He told the judge he lost his job about six weeks ago and has no income, real estate or car. The judge appointed attorney Thomas Roe Jr., who was at today's hearing at Easley's side.

Like the judge is going to feel sorry for him. HA ! Maybe he shouldn't have "sold" his SUV.

So if he moved into the Smith home in ( supposedly ) October, that means he held a job for less than a month ? NOT BUYING IT.

I believe it...he's a :loser: I was more shocked to see that he even had one at all.

wonder if BS wants to talk to him now?
or if JE wants to talk to BS now?

JE parents there?

"Two other charges against Easley of credit card fraud and unauthorized use of Tina Smith credit card were to be heard Monday, Dec. 20, in Salem but Salem Commonwealth’s Attorney Tom Bowers said he had nol prossed them at this time."

http://ourvalley.org/accused-abductor-gets-court-appointed-attorney/

Wow! Is VA the 'nol pros' capitol of the world? I worked in and around the court system in 3 other southern states for 30 yrs and didn't see as many cases nol pros'd as I've seen in a week of watching and reading about this one in VA. I know different states do things different ways so, VA folks...is this as common in the Commonwealth as it appears?

I wonder if it's because they can't prove that she didn't give them the credit cards to use, since he was/had been her live-in boyfriend? Especially since she's no longer around to testify... :(... It reminds me of the rape case recently where the teenage girl pressing charges committed suicide before the trial, so they're dropping charges/no pursuing it. The mother is very upset, but the lawyers say there's nothing they can do. Just wonder if this is a similar case.

OTOH, where is the murder charge?!? Someone killed TS.

Tried to go back and see if anyone has mentioned the "red Blazer" being back at AMc's apartment. I had read it somewhere and just could not believe they could have it back. I thought it was seized for evidence but I guess the sale of this vehicle must have been "legal". On my way across town this afternoon I "just happened" to drive up the boulevard and immediately obvious is the "alleged red Blazer" parked in front of the person's house that "allegedly purchased it from JSE". As several have discussed, he must have gotten that blazer for a song because JSE says in court that he needs a court appointed attorney because he has no real estate, car or job.

I understand that they can reinstate the credit card charges at a later date and hope they do...they were used in the commission of a crime, regardless of whether they were given to him by TS or not. But the number of nol pros'd cases that we've seen just with the players in this case amazes me. But I'm not from VA so maybe it's common and easier than dismissing them and bringing they again later. 'Fraid I don't know any criminal lawyers in VA to ask about procedure. LOL

The murder charges are coming...patience, grasshopper! (Am I showing my age...Kung Fu, the TV show, famous line?) One of those ducks might not be getting into the row like he needs to! LOL (Thanks to the poster above that created that mental imagery! LOL) I imagine they're processing a bunch of evidence and wanting to do this right the first time...get all the players involved ID'd (as many as possible, anyway).

And, God forbid, if BS was involved in any way, they will want to give her Christmas with her family before considering juvenile charges. She's below the age of having serious crimes transferred to adult court, but still...victim though she is, they may feel like they have to press juvenile charges to get her to talk. Who knows? There's LOTS of leeway, generally, in juvenile cases (or at least in my outside-VA-experience!) so I'm not too worried about the delay in the murder charges. They'll come in due time. Gotta deal with LOTS of ducks here! And unless they're ducklings following their mama, they're harder to herd than cats! :)

Jeffrey Easley arraigned preliminary hearing set
Jeffrey Easley made his first appearance in a Roanoke County Courtroom Friday for his alleged role in the kidnapping of 12-year-old Brittany Smith.
The judge informed him of his abduction charge. Easley then requested a court-appointed attorney.
After the hearing, prosecutors would not speculate on any additional charges related to the death of Brittany's mother Tina.
Easley's mother stands by her son and says he is not the man being portrayed in the media.

That looks like a bot. Bots get email addresses and then send advertisements, *advertiser censored*, etc to everyone on your contact list. If the bot is not programmed correctly it will give off gibberish like that status message. If he had sent status updates via email to his Facebook page then he would have a "contact email" for that Facebook account. If a bot was able to get into his email then this would explain the status update.

FWIW:

jd = job done; juvenile delinquent; dork; jack & dash (steal and run); someone who trips on hallucinogens often; someone white who prefers sleeping with black women, pimp king, jump down (someone who's quick to give a male oral sex).

9 is a text code that says 'change the subject NOW...parents/teacher/authority figure approaching!'

c00 = Cool

Maybe more...this is my first search cycle.
