The man accused of killing five-year-old Nathan O'Brien and the boy's grandparents, Kathy and Alvin Liknes, made a brief court appearance in Calgary Thursday morning via closed-circuit TV.

Garland said nothing as Crown lawyers told a judge they are still awaiting a substantial amount of evidence to be disclosed by Calgary police.

The case was put over again until Sept. 17. Garland last appeared in court via video link on July 16, at which time the case was adjourned until today because Crown prosecutors were still waiting for police evidence disclosure.

SF: The man accused in connection with the murders of 5 year old Nathan O'Brien and his grandparents, Alvin and Kathryn Liknes, is expected to be back in court today.

AS: And Douglas Garland has been under suicide watch since he was arrested last month. Jenna Bridges joins us this morning from the Calgary Court Centre with more. Jenna.

JB: Good morning, Amber. Well, since his last court appearance, we've learned that Calgary Police Service detectives have been visiting Douglas Garland at the Calgary Remand Centre. It's a technique that isn't very common, but not completely unheard of. The reason that the case was put over to today was to give more time for the defence to be disclosed evidence.

54 year old Douglas Garland is facing two counts of first degree murder and one of second degree murder in the deaths of Alvin and Kathryn Liknes and their grandchild, 5 year old Nathan O'Brien. The three have not been seen since June 29th, since the trio disappeared from the Liknes home in the Parkhill neighbourhood.

And so far their bodies have not been found, but police say they have enough evidence to charge Garland with first and second degree murder. The Crown also says that, even without bodies, it also has enough evidence to build a strong case,

The Calgary Police Service has expanded its investigation to Mexico. Prior to their disappearance, Alvin and Kathryn Liknes had been planning to move there. The Calgary Police Service would not elaborate on where in Mexico officers are or why.

As for what happens today at court, that will depend again upon what evidence to the defence, But, again, 54 year old Douglas Garland is scheduled to make his second court appearance some time this morning. Scott, Amber.

The man accused of an horrific triple murder in Calgary has made another court appearance. It was brief, and a trial for Douglas Garland is still a long way off. That means there is a hard road ahead for family and friends left behind.

Elissa Carpenter reports.

EC: Once again, Douglas Garland appeared in court via CCTV from the Calgary Remand Centre. His appearance lasted only about a minute and a half.

KR: I understand I'll be receiving disclosure very shortly here, early next week.

EC: Disclosure refers to the evidence police have collected so far that could be used to prosecute Garland for murder.

SP: So, there's a fair bit of materials for him to go through. As you can appreciate, for the numbers of resources that were used by the police.

EC: Even though Garland's appearance was brief, it was long enough for Cherri Hodgins to lay eyes on the man accused of murdering her friend.

CH: I am Kathy's closest friend. She was my dearest friend in the whole world.

EC: Kathryn Liknes; her husband, Alvin Liknes; and their grandson, Nathan O'Brien, disappeared from the Liknes's southwest home on June 30th. Police believe all three were killed. Garland is a relative through marriage.

CH: Her family is in pieces. Nobody is working. Nobody can get back to normalcy, whatever normalcy means to us at this point. But, it's going to take a long time for us to be able to recover.

EC: The bodies of Nathan, Kathryn, and Alvin haven't been found. Garland will be tried with, or without, that evidence, but there's an even more important reason to find those remains. No memorial services have yet been held, and none are planned.

Douglas Garland will next appear in court next month. So far, his lawyer has not decided whether or not he will seek bail for Garland. He also hasn't determined whether or not he should ask the court to order a psychiatric evaluation. All of these things, he says, will be determined once he's seen that disclosure from the crown.

MeghaParker Grant reports.

MG: For six weeks now, close friends have tried to help the Liknes and O'Brien families through their grief, one day at a time.

CH: This young family is absolutely shattered, and they need all of our support.

MG: What's needed now is financial support according to Kathy Liknes's best friend.

CH: And the family is in pieces. Nobody is working. Nobody can get back to normalicy [sic], whatever normalicy [sic] means to us at this point.

MG: Hodgins and her husband set up a trust account at CIBC banks across the country under the name "The O'Brien Fund". The pair were at court for Douglas Garland's brief appearance today. Garland's lawyer is still waiting for the prosecution to hand over the substantial amount of evidence police have gathered in the case.

KR: He's anxious to see the disclosure also, so, hopefully, once we get that next week, we can start moving this forward.

MG: The bodies have not yet been found, and police remain tight-lipped about the evidence they have against Garland. But, the prosecution says the investigation is ongoing.

SP: Police are continuing their searches, and we're encouraged by the lab results that we're getting back, but no specifics as of right now.

MG: Parker says the prosecution will meet with the victims' families at the end of the month to keep them up to date on the court process.

SP: It's critical, just from a human standpoint, making sure they understand what's happening. It's a confusing time on so many levels for them. And, if we can help them, explain the court process, then that's helpful.

MG: A preliminary hearing is likely six to eight months away, and would last several weeks according to Parker. Garland is back in court September 17th. Meghan Grant, CBC News, Calgary.

Garland, accused in Liknes/O’Brien murder case makes court appearance

Crown Prosecutor Shane Parker asked Provincial Court Judge Terry Semenuk to adjourn the trial to Sept. 17 to allow his office time to turn over information regarding the evidence collected – called discovery – to Garland’s lawyer, Kim Ross, and to give Ross ample time to go through it.

“The police have done a great job getting a fair amount of disclosure ready for the defense. We just have to go through our final checks to make sure everything’s appropriate to go to them,” said Parker. “That should be done today (Aug. 14) or tomorrow (Aug. 15).”

“We’ve set the next date into September just to allow Mr. Ross to take an initial view of that disclosure and then we’ll in a better position to schedule the length of time for the next step, which is a preliminary inquiry,” he added.

Parker said the amount of evidence is “voluminous” and that his office continues to receive lab results. He said he expects the preliminary inquiry to take six to eight months because of the volume of evidence.

Garland did not speak during his brief appearance in court.

NH: Dressed in superhero costumes, Spiderman T-shirts, hockey jerseys, and bright colours, family and friends, and a lot of children, gathered together to celebrate Nathan O'Brien--his life cut horribly short at just five years old.

More than nine weeks ago, Nathan and his grandparents, Alvin and Katherine Liknes, went missing. Hope they would be found or their bodies recovered faded as police laid first and second degree murder charges in the case. Now, finally, a time to gather and remember.

Nathan's family would like to express their heart-felt thanks and gratitude for all the thoughtful expressions of love and kindness by relatives and friends during their time of loss and bereavement.

NH: It's been a heartbreaking time for his parents who continue to struggle to come to terms with what's happened.

Douglas Garland's preliminary hearing set for next May

CALGARY -- The man accused of killing a five-year-old Calgary boy and the child's grandparents will have a preliminary hearing next May.
Douglas Garland, 54, made a brief court appearance in Calgary Wednesday.
Clad in a blue prison jumpsuit, Garland kept his head down and said nothing as the court set a two week hearing that is to begin May 19.

July 1, 11:00 am Investigators say they have no "significant leads" about the whereabouts of the missing family. Also that evidence at the Liknes home indicates the three family members left the residence against their will. LE ask anyone who attended the estate sale to contact them and that LE will be at Parkhill Community Centre on July 3 to meet with them. People are being asked to bring photos of what they bought to help investigators catalogue what was purchased and what remains in the house.

July 2 Wednesday, sometime after midnite and before morning, a neighbour of the Garlands is awake during the night and sees a light on in the greenhouse at the Garland farm. He says that is unusual.

July 2 Neighbours notice that someone at the Garland property has been burning most of the day (elsewhere it said 2 days?)

July 2 3:00pm MT (mountain time) JO and RO make public plea for the return of their son. LE say they have decided not to offer a cash reward at this time. LE also says the grandparents are not considered suspects.

July 3 LE remove AL’s truck from the driveway

July 4 LE update says there was a violent struggle inside the Liknes home. They are searching for a green Ford F150 made in the late 1980s or early 1990s that was seen driving around the neighbourhood several times the night of the disappearance

July 4 LE arrived at the Airdrie farm in the evening; a green truck matching the one LE is seeking is removed from the scene and POI DG is taken into custody, charged with possession of ID in the name of Matthew Hartley and a stolen bank card.

July 5 Search takes place around the Liknes’ home and the park.

July 6 LE continue search at farm but DG is released from custody. LE says he remains a POI

July 7 DG makes first court appearance and will be back in court Wednesday, July 9

July 11 DG released from custody on $750 bail with the following terms: keep the peace and be of good behaviour; must stay in province (cannot leave Alberta without permission), surrender passport within 24 hours of release, to report 3 days a week, first report to be July 15, must provide land line phone # if available to supervisor, must be home between the hours of 9 pm and 7 am each day, he is to reside at transitional housing - hotel, motel, Mustard Seed, Drop-In Centre, Salvation Army Centre of Hope, or homeless shelter, be back in court Aug. 6 at case management office, not possess ID other than his own. DG asks judge "I live on a farm, sometimes working past 9 o'clock, would residence be on the farm itself?" The judge reminds him he won't be going to the farm but to some form of transitional housing.

July 11 LE conclude search at southeast Calgary landfill and focus their efforts on an acreage north of the city and the Spyhill Landfill site. Also have a tactical unit at the Airdrie acreage to deal with dangerous and flammable chemicals that were found on the property. Asking people/businesses/oil companies in the Airdrie and Parkhill/Stanley Park areas to check their properties for absolutely anything out of the ordinary.

July 11 Members of Liknes family confirm in the media that beef between AL and DG was over patent filed years ago by AL; family says it was AL's invention

July 13 The Liknes home was released as a crime scene

July 13 time unknown, homicide detectives conclude enough evidence to determine all 3 family members murdered

July 14 1:30 am DG re-arrested in the early morning hours near his parents’ farm in Airdrie.

July 14 1:00 pm LE holds presser to advise that an arrest has been made and that two charges of first-degree murder (AL andKL) and one charge of second-degree murder (NO) are pending in the case. Police did not confirm the name of the suspect, but family has told media that Douglas Garland is the person. LE expect charges to be laid later today.

July 14 DG was formally charged late tonite with 2 counts of first degree murder related to Alvin and Kathryn Liknes, and 1 count of second degree with regard to Nathan O’Brien. His next court appearance is scheduled for Wednesday, July 16

July 24 LE say they are looking at possible connection of DG to other violent crimes, specifically the death of 32 y.o. Helena Mihaljevic. Helena’s body was found in 2007 just off RR 280 and Symons Valley Road. She had disappeared the previous year.

August 5 Reported in MSM as confirmed by CPS that CPS has investigators in Mexico in relation to this case. CBC reporter says LE is searching one specific property (address and further details unknown at this time)

August 5 It is reported that charges against DG related to the identity theft (and bank card?) have been stayed.

Fortney: Parents of Nathan O’Brien shed light on private struggles and honouring their lost child’s legacy

For the past four months, Rod O’Brien has been treading water.

“It’s like we were hit by a tsunami,” he says. “You crawl back on to the beach and look around — and there’s devastation everywhere. I can’t believe I have to stand up and start cleaning up.”

The 40-year-old is justified in using such dramatic imagery to describe his recent travails.

On June 30, his parents-in-law Kathy and Alvin Liknes disappeared from their southwest Calgary home, along with five-year-old Nathan, his middle boy of three.

Nathan, a gregarious and happy child with a penchant for wearing superhero costumes everywhere, had been sleeping over at his grandparents’ after helping them run an estate sale the day prior.

The child’s disappearance over the Canada Day long weekend triggered a two-week Amber Alert, the longest in Canadian history, along with a several-days search of the rural acreage where 54-year-old Douglas Garland — the man now charged in their deaths — lived with his elderly parents.

No new leads in search for bodies of Nathan O’Brien and grandparents, police

Calgary police say they currently are not actively searching for the bodies of five-year-old Nathan O’Brien and his grandparents, Alvin and Kathyrn Liknes.

The three vanished from the Liknes home in the southwest neighbourhood of Parkhill at the end of June. While their bodies have never been found, police later charged 54-year-old Douglas Garland with their murders.
