Court documents show that investigators took a sample from under the victim's fingernails, and they say there is only a one in 7.2 billion chance that it belongs to anyone other than Jesse Matthew. The documents also say that the DNA evidence is the only thing that connects Matthew to the crime.

The November 4, 2014 Rolling Stone article described an alleged gang rape of a student named "Jackie" at Phi Kappa Psi house. UVA asked Charlottesville Police to investigate the allegations. Chief Longo says there is no evidence that there was a rape as described in the article. *

Graham’s remains are found outside of Charlottesville in a rural area of Albemarle County, a few miles away from where the remains of a Virginia Tech student who went missing in 2009 were found. The man police charge in Graham’s disappearance and killing is a taxi driver who never attended Virginia. He is a former football player at Liberty University and Christopher Newport University. He left each school after being accused of committing sexual assaults there.

The author of Rolling Stone’s discredited “A Rape on Campus” story, Sabrina Rubin Erderly, will apologize Sunday in conjunction with the release of the Columbia Journalism School’s external review of the erroneous story, according to media reports.
Columbia’s review will be published at 8 p.m. ET.

If convicted, Jesse Leroy Matthew Jr. could now face the death penalty in the death of 18-year-old Graham, who went missing last fall following a night out with friends. Her remains were found five weeks later.

On Tuesday, Lunsford said that new criminal analysis came back in late February. She said that there is “compelling evidence from the lab that capital charges are now appropriate.” She declined to comment about what that specific evidence is. “These are never easy decisions to make. If I didn’t believe it was worthy, we wouldn’t be standing here today.”

A prosecutor said new forensic evidence led to the additional capital murder charge and prosecutors will seek death penalty if Matthew, 33, goes to trial.

Matthew, 33, was previously charged with first-degree murder, a charge which carries up to a life sentence. He is also charged with abduction with intent to defile and two counts of reckless driving for incidents that occurred early in the investigation.

His jury trial had been scheduled to begin June 29, but in March, an Albemarle County circuit judge granted a request to postpone the trial. Tuesday's hearing had initially been scheduled to set that new trial date.

Lawyers representing Matthew asked for his trial from 2005 in Fairfax County to be postponed last week. He is scheduled to stand trial June 8 for attempted capital murder and sex crimes against a woman who was attacked outside of apartment in September 2005.

With the ruling, Matthew&#8217;s trial is scheduled to begin June 8.

Public defender Dawn Butorac had said her client&#8217;s constitutional rights were being &#8220;obliterated,&#8221; because she didn&#8217;t have sufficient time to process DNA analyses, which were provided recently.

Circuit Court judge David Schell disagreed, saying Matthew&#8217;s lawyers had &#8220;ample, or at least sufficient time&#8221; to review discovery in preparation for trial.

After Schell&#8217;s ruling, Butorac told the judge &#8220;this case is coming back,&#8221; on appeal. The judge did not respond to Butorac&#8217;s statement.

Jesse L. Matthew Jr., the lone suspect in the death investigation of Hannah Graham of Alexandria and also a suspect in the 2005 rape and attempted murder case of a 26-year-old Fairfax City woman, will face his live accuser next week.

According to an Oct. 24, 2014 certificate of analysis from the Virginia Department of Forensic Science, DNA evidence obtained from skin beneath RG&#8217;s fingernails match Matthew&#8217;s DNA to a probability of 7.2 billion to one. In 2010, state police said forensic evidence in the Harrington case matched forensic evidence in the 2005 Fairfax City case. Later, police said a forensic link also tied Matthew to the Graham case.

Judge Schell granted a defense motion that will prevent the Commonwealth from introducing Matthew&#8217;s criminal history at trial and denied a defense motion prohibiting the media from attending Thursday&#8217;s motion to suppress hearing.

Matthew&#8217;s trial begins Monday June 8 with jury selection. A hundred potential jurors will be brought in on Monday and another 50 on Tuesday. The trial is scheduled to last two weeks.
