Florida laws open book on Casey Anthony's life

Today is Sunshine Sunday, the day designated by the Florida Society of News Editors to raise public awareness of the importance of open government in the state.
In the months since Anthony was arrested and eventually charged in the death of her daughter, Caylee Marie, thousands of pages of legal documents detailing the sweeping criminal investigation have been released in response to records requests.

"In the 12 1/2 years I have worked as P.I.O. [public information officer] for Orange County Corrections, no case has generated this much media activity for such a long period of time," he said.

In response to media requests, public agencies have released recorded video visitations with Anthony and her relatives, 911 calls and videotapes of her parents being questioned by detectives.

Orlando lawyer Bill Sheaffer, a legal analyst for WFTV-Channel9, said he has never seen a case where public records have been requested, and churned out, to the degree they have been with the Anthony case.

"This case is just unprecedented in a number of levels, including the public interest," he said.

Deputy Deposition In Caylee Case Continues

A source with Casey Anthony's defense team said it will be two weeks before a key deposition is completed in the case.
The source said the deposition is continuing with a deputy who may have missed a chance to find Caylee Anthony's remains in August.

Jose Baez and two other defense attorneys spent more than three hours questioning Deputy Richard Cain.
Because of scheduling conflicts, the source said it will likely take until the end of the month before questioning of Cain is completed.

Casey Anthony's Brother Avoids Answers In Civil Case

The attorney for Lee Anthony filed new documents on Monday, saying his client's opinion about specific questions in Casey Anthony's civil lawsuit were not relevant to a fact-finding deposition.

Thomas Luka said Lee Anthony should not have to answer two questions in the civil case regarding his client's sister, Casey Anthony, who is being sued for defamation by a woman named Zenaida Gonzalez.
Luka said his client should not have to answer questions pertaining to Lee Anthony's opinions on who Caylee's father is or whether he's had thoughts that his sister was responsible for Caylee's death.

Luka said that Gonzalez's attorney have shown no need for that information, except to embarass or annoy the Anthony family. Luka argued that the father's identity is irrelevant to the civil lawsuit.


Gonzalez's attorneys are seeking a judge's order to force Lee Anthony to answer the questions, saying it is necessary to help show that their client did not kidnap Caylee. It's unclear when the judge will decide whether Lee Anthony will be compelled to answer.

A hearing is scheduled for Wednesday as Gonzalez's attorneys attempt to re-schedule a deposition with Casey Anthony's parents, George and Cindy Anthony.

In a recent court motion filed by Anthony's lead attorney, Jose Beaz, he cites the name Lt. Tammy Uncer, who he claims discussed Anthony's medical details with prosecutors.
Local 6 News has confirmed that Uncer was the corrections employee who escorted Anthony from her cell and observed her reaction to the news, which she watched on TV in the common area. Anthony also asked for a sedative to calm her down, Local 6 News has learned.

Anthony's reaction was captured on jail surveillance cameras, and Baez is trying to keep thee recordings from becoming public through the discovery process.
He's also trying to keep a videotaped statement that Uncer gave to prosecutors from becoming public. Baez alleges that Uncer discusses his client's medical history, including what she observed that day.

Prominent local defense attorney Mark NeJame, who once represented Anthony's parents, said Uncer's statement to prosecutors could be a violation of Anthony's rights. NeJame also said Baez's argument could go either way, specifically in reference to what Uncer may have told prosecutors about Anthony's reaction to the breaking news.
"Can the state question a corrections officer about their observations? Yes. However, if the corrections officer was acting as an arm of law enforcement or the state attorney's office and it was done secretly, there's some real trouble with that," NeJame said.

The state maintains that there has never been any conspiracy or misconduct.
It's not known when a hearing will be held on the issue.

Casey Anthony's brother seeks to block questions

Casey Anthony's brother, Lee Anthony, doesn't want a judge to force him to answer two remaining questions in his sister’s civil case.
Last week, lawyers for Zenaida Gonzalez -- the Kissimmee woman suing Anthony for defamation -- asked Orange Circuit Court Judge Jose R. Rodriguez to make Lee Anthony address two questions he didn't answer during an interview under oath last month.

Lee Anthony's lawyer, Thomas Luka, wrote in his legal response today that the questions only serve to embarrass and annoy the Anthony family.
And, Gonzalez's legal team, Luka wrote, didn't cite any legal reason why identifying Caylee's father is relevant.

No hearing has been set yet.

Thomas Luka, attorney for Lee Anthony, objected to Zenaida Gonzalez's attorneys asking Lee Anthony if he knew the identity of Caylee Marie Anthony's father and if he thought his sister could be responsible for Caylee's disappearance. Luka advised Lee to not answer those questions, stating that they were not relevant to the civil lawsuit.

In a newly filed motion, Luka pointed out that his client spent more than three hours in Morgan and Morgan's law offices on February 26 and was cooperative in answering more that one hundred questions. Luka argued that neither of the questions which Morgan and Morgan are taking to a judge have anything to do with the civil defamation suit and are merely a publicity stunt.


Judge Jose Rodriguez will hear this argument on May 21.

The attorney for Cindy and George Anthony, parents of Casey, will also appear in court that same on behalf of his clients. Brad Conway is scheduled for a hearing before that Judge Roriguez on Wednesday. Gonzalez's lawyers were set to question Casey's parents the day before Lee back in February. Their depositions were put on hold because the two said they were not mentally or emotionally prepared to undergo questioning.

On Monday, Conway told FOX 35 that he will be talking to attorneys at Morgan and Morgan on Tuesday to see if they can agree on a level of professionalism and standard of conduct during the depositions. He said if they can work something out on their own, Wednesday's hearing might not be necessary.

State Releases Subpoena List In Anthony Case

The list of those subpoenaed by the state includes Casey Anthony's parents, Cindy and George, as well as her brother Lee.
When Casey Anthony's trial starts Oct. 12th, her family will be legally required to be ready to take the stand against her.

Prosecutors hope to get from the Anthonys that they never met, saw or talked to the babysitter Zenaida Fernandez Gonzalez, who Casey claims kidnapped Caylee. Ex-boyfriend Tony Lazarro, tthe man closest to Casey Anthony at the time her daughter disappeared, has told investigators she lied to him about where Caylee was.

Casey Anthony's own Grandmother, Shirley Plesea, also has been subpoenaed. Plesea sent her daughter Cindy Anthony emails suggesting Casey was lying and involved in Caylee's disappearance.

There is also a subpoena of Kiomarie Cruz, Casey's childhood friend who is expected to testify the two used to hang out in the woods where Caylee's remains were dumped. Another name is Brian Burner, who saw Casey Anthony backing her car in to the garage and borrowed a shovel from him a couple of days after investigators believe Caylee died.
Even employees of the Mount Dora nursing home where this last video of Caylee was taken, are now under subpeona as state witnesses.

Court Hearing On Anthonys' Depositions Canceled

A court hearing pertaining to the depositions of George and Cindy Anthony in connection with a deposition lawsuit filed against their daughter has been canceled.
Gonzalez's attorney, John Morgan, said he and Brad Conway, the attorney representing George and Cindy Anthony, worked out a deal for Casey Anthony's parents to be deposed April 9 -- without the media present.

Lawyers from both sides agreed that the depositions will be taken in Morgan and Morgan's mock courtroom. The media will not be allowed inside the room, only those directly involved get access.

Conway tells FOX 35 that Cindy and George Anthony just want to get these depositions behind them. They feel this lawsuit is frivolous and that Zenaida Gonzalez and her attorneys are just doing this for publicity.

Lee Anthony, Casey Anthony's brother, was recently deposed in the case and refused to answer two questions which sought Lee Anthony's opinion on whether he thought his sister had anything to do with Caylee's disappearance and who the father of Caylee is.
A judge is being asked to rule on whether Lee Anthony must answer the questions.

Casey's Parents To Face Questioning Under Oath

In the civil case against Casey Anthony, e-mails to a judge played a part in forcing Casey's parents to face questions under oath.

The judge received e-mails from people who pointed out that George and Cindy Anthony went to Putnam County to search for Haleigh Cummings.

The Anthonys told the judge they had not made any public appearances since the discovery of Caylee's remains in December and were not emotionally ready to answer questions.

However, the Anthony's will have to answer questions on tape on April 9. A hearing on the issue was set for Wednesday afternoon, but was cancelled.

Prosecutors have released more investigative information -- including e-mails and videos -- to Casey Anthony's defense team.

Among the 10 items made available: videos taken by private investigator Jim Hoover; e-mails the Oak Ridge National Laboratory sent the Orange County Sheriff's Office; e-mails Detective Yuri Melich sent to the laboratory; and a photograph of a child's T-shirt.

Evidence collected for prosecutors in criminal trials must be shared with defense lawyers -- a process known as discovery.

After the defense receives the information, it then can be released publicly. It's unclear when the items recently shared with the defense will become public.

A roadside memorial where Caylee Anthony's body was found has drawn the curious from across the region and the world.

Meanwhile, the owner of the land has put the parcel up for sale, WESH 2 News learned Wednesday. A real estate agent said the small parcel on Suburban Drive was put on the market by the owner, a resident of Winter Park.

The owner has not removed the memorial, which draws a steady stream of visitors. Some said on Wednesday that they think it is time to take it down. Orange County also said it has no plans to clean up the site, although it appears some of the memorial is on the road's right-of-way.
"It's touched the world," said Chicago tourist Jane Clifford who visited the site and said the memorial should stay. "This has just touched everyone."

Some parents with children at nearby Hidden Oaks Elementary School said the time to honor Caylee with the roadside memorial has passed. They want to see the site cleared.

"Its vacant land on the east side of town. Its a good sized lot on a nice street," said Channing Harrison, a real estate agent who has been selling property in Central Florida for more than a decade.

"Its got a little bit of an added stigma to it," said Harrison. "Its probably going to take a little longer than usual for someone to step forward and put a serious offer in. It's going to take a unique buyer."

On Wednesday afternoon, people from as far away as Canada stopped by to pay their respects. Jeanette Saborido is one of the few who noticed the property is now for sale. "I wouldn't want to own it. If they were giving it away I wouldn't take it," said Saborido.

After taking a closer look at the property, Harrison pointed out that the lot has an odd shape. It sits lower than the property around it, so it would cost quite a bit of money to fill it with dirt and raise it to the point where it would not flood. Harrison estimates the owner will likely get just a fraction of the asking price.

Casey Anthony's birthday will be another routine day in jail

Casey Anthony won't enjoy a birthday bash when she turns 23 on Thursday.
Other than her attorney, Anthony doesn't have any scheduled visitors. If family members did want to visit, they'd have to talk to Anthony from a separate building via a video stream.

She'll start the day off with a cup of oatmeal, gravy and potatoes; and end the day with a dinner of smoked sausage, rice and mixed veggies.
She'll also get one cookie or piece of cake – but that's only because it's already on the jail's planned meal list.
"There is no special treatment for any inmate who has a birthday while in jail," said Allen Moore, spokesman for the Orange County Jail.


For weeks, bloggers and others have been making online pleas for people to send a birthday card to Anthony.
It's unclear if she's received any.
The jail doesn't track mail volume for specific inmates, Moore said, there are no public records that would show if anyone has tried to mail Anthony a gift.

But, Moore added, mail-room staffers say Anthony does receive "a significant amount of mail daily." Anthony's attorney, Jose Baez, said this through his spokeswoman Marti Mackenzie when asked about Anthony's birthday behind bars:
"Unfortunately many of my clients have spent their birthdays in jail. I will be visiting the jail tomorrow in the capacity as Casey's lawyer to discuss development in her defense."

Casey Anthony Turns 23 Years Old

Casey Anthony turned 23 years old on Thursday, a birthday she will spend almost entirely in her 12.5-by-7-foot cell.

Anthony's family has avoided meeting with Casey Anthony because the visits are recorded and released to the public as part of the discovery process.
In birthdays past, Internet photographs show Casey Anthony wearing a tiara and celebrating with her brother, Lee Anthony.

At a memorial service for Caylee in February, Anthony's father, George Anthony urged the public to reach out to his daughter.
"She deserves letters. Take the time to write a letter to her. Just say, 'Hi Casey, I'm thinking about you today," George Anthony said.
Casey Anthony's attorney screens her mail, however, and it's not known how much, if any, is passed on to her.


The Anthony family celebrated Caylee's August birthday without their granddaughter being present, and now will do the same with their daughter.
"Our emotions are really tough right now because tomorrow's a big day, and every day that gets closer to her birthday gets harder," said Cindy Anthony, Caylee's grandmother, a day before Caylee's third birthday.

Meanwhile, more documents in Casey Anthony's murder case were expected to be made public through the discovery process, but it's now known when that will occur.

More Evidence Turned Over To Casey's Defense

More of the prosecution's evidence in the case against Casey Anthony could be revealed as soon as Thursday.
The state attorney's office just handed over more files to the defense. That includes e-mails sent from Orange County investigators to the lab that tested some of the evidence.

The defense will also get to see videotapes of the wooded area near the Anthony home taken a month before Caylee's remains were found. The video shows the Anthony's private investigator Dominic Casey talking on a phone.

Prosecutors have also handed over three-dimensional photos of the scene and a photo of a child's t-shirt with the words "Big Trouble" on it.

Meanwhile, Thursday is Casey Anthony's 23rd birthday. She will spend the day in the Orange County Jail.
Her family and friends are not scheduled to visit her, but she may get a visit from her attorney Jose Baez.

Casey Anthony spent her 23rd birthday at the Orange County Jail on Thursday with just a visit from two of her attorneys and money from her dad.

Her father, George Anthony, also deposited a $100 money order into her account for purchases at the jail commissary.
Jail officials said no special treatment was planned, and no family members have made plans to visit her. Two attorneys. Jose Garcia and Gabriel Adam, visited.

Meanwhile, the property where a roadside memorial to Caylee is located has gone up for sale, and a real estate agent said two people have expressed interest.
Some mourners said it needs to stay there because it provides closure, but others who pass it every day said it needs to come down.

Caylee doll off the market

FOX 35 has learned the "Sunshine Caylee" doll is officially off the market. Showbiz Promotions out of Jacksonville, Florida announced they put the doll on the market in late January. After rage from the public, the company's owner changed his mind saying quote "After reviewing the response to our media introduction of the Sunshine Caylee Doll and listening to the advice of the general public. We feel that is it best to suspend the launch of The Sunshine Caylee Doll."

Today Conway called Showbiz Promotions and told the owner to take the doll and all caylee products down immediately. "We've come to an amicable agreement," said Conway.
That agreement, by midnight tonight the Caylee dolls and everything with Caylee's name on it will be off the site, no longer be for sale.
