(Some of the lawyers listed show other employment with the AZ Bar (http://www.azbar.org/ ) , so I don't know if this site is up to date.)

Mr. Victor has a civil rights practice in addition to criminal defense, which might be a good fit for Elizabeth.

On the downside, Mr. Victor was investigated by the Arizona Attorney General for alleged violations of the Arizona Consumer Fraud Act in connection with advertising for loan modification services. In October 2010, he entered into a an ASSURANCE OF DISCONTINUANCE with the State, agreed to reimburse his aggrieved clients and pay the State 15k for costs of the investigation. (He admitted no liability)

Soo- imo an odd choice for a woman who has accused a prior attorney of false advertising and misrepresentation. Or is it just perfect?

Judge tosses evidence in case of missing 'Baby Gabriel'

PHOENIX (CBS5/AP) - A key piece of evidence in the trial of the mother of an Arizona baby missing for more than two years was thrown out of court early Monday morning.

Twenty-five-year-old Elizabeth Johnson has pleaded not guilty to charges of child abuse, kidnapping and custodial interference in the case of her missing son, Gabriel, who was 8 months old when he went missing.

Johnson has been jailed without bond since January 2010, a month after her son disappeared in Texas.

On Monday, a judge ruled that admissions made by Johnson to a detective from San Antonio, TX, in a Phoenix jailhouse interview in May of 2010 violated her Sixth Amendment rights because she was questioned without an attorney present.

There was also some question as to whether a detective from another state has the legal right to question a suspect about a case in Arziona. The ruling means the statements Johnson made to the detective can never be introduced in court.

"She could even testify and say something radically different and they still couldn't use that statement to impeach her," said her attorney, Marc Victor...

Elizabeth wants her bail lowered which is at 1.1 mil right now. Her defense team has also argued that she ought to be released pending trial as some sort of sanction for having her 6th amendment rights violated by the San Antonio detective who talked to her in jail. Listening to the testimony in the TPS trial (EJ says she's about to get on a plane, you'll never find me) I think that if she is released on bond, she's right, we'll never find her.

Is the popular consensus that G was illegally given to a family in TX and they have never come forward OR that he is deceased?

I don't think I represent the general consensus...I believe he is alive and I believe Tammi Smith knows exactly where he is. There is factual information that most likely will not be presented at trial regarding phone calls placed at the very same time as Gabriel was supposedly being handed over in the park. These calls were between Jack and his adult son and brother

This order grants the defense request that Elizabeth's restraints be removed during contact legal visits. This may seem like a small victory but I'll bet it's huge for Elizabeth.

In my gut, I've always felt that Gabriel is alive and that Tammi knew more about him than she is letting on. Thank you for posting this information, I hope it makes it to court somehow so that everyone can see what actually happened.
