A new District Attorney will be taking over the case of James Holmes v. The People of Colorado in Arapahoe County.

Republican George Brauchler, 43, won the state's biggest judicial district with 53 percent of the vote compared to Democrat Ethan Feldman's 47 percent.

A Thursday hearing for the man charged with the Colorado movie theater killings was postponed Wednesday after his lawyers told a judge James Holmes would be unable to attend because he was sent to a local hospital Tuesday.

Sources told KOAA that Holmes stood on his bed and fell backwards, apparently trying to crack his head. He followed that by running headfirst into his jail cell wall and on a third try to hurt himself, hit his head against the wall.

He says that Holmes told him "he felt like he was in a video game" during the shooting, that "he wasn't on his meds" and "nobody would help him." He says Holmes also mentioned NLP -- presumably, neuro-linguistic programming, a much-scorned and outmoded approach to psychotherapy -- and claimed to have been "programmed" to kill by an evil therapist.

He says Holmes told him he "walked up and down the aisles" of the theater three times before he opened fire, and that detail, if true, might have some bearing on the pending litigation by victims' families against the theater chain. Unruh has paperwork indicating that he's been in communication with at least one family member on that point.

Hours before James Holmes allegedly carried out a massacre at a Colorado movie theater he took a series of menacing self-portraits with his dyed orange hair curling out of from under a black skull cap and his eyes covered with black contacts.

A prosecutor told the court after the photographs were shown that Holmes had a "depravity of human heart."

Those haunting photographs, found on his iPhone, were shown in court today on the last day of a preliminary testimony that will lead to a decision on whether the case will go to trial. The hearing concluded without Holmes' defense calling any witnesses.

The judge's decision on whether the case will proceed to trial is expected on Friday.

Federal agents are looking for a man who made numerous telephone and e-mail threats to blow up the Arapahoe County Jail, airliners, airports, and a hotel unless authorities released Aurora theater shooting suspect James Holmes.

An electronic search executed to trace computer servers that handled the Voice Over Internet calls and e-mails sent by the man tracked an e-mail account he was using to Internet protocol addresses that "resolved in Iran," according to documents on file at U.S. District Court in Denver.

The calls may not have come from Iran, however. It is easy to manipulate identifying information about VOIP

The judge in the Colorado theater shootings case on Thursday indefinitely postponed the trial of James Holmes so attorneys can argue whether he should undergo another psychiatric evaluation.

Holmes' trial had been set to begin in February...

At Thursday's hearing, Arapahoe County District Court Judge Carlos Samour set the start of trial for Oct. 14. That is when the first batch of the 6,000 prospective jurors set to be summoned for the case — one of the largest jury calls in U.S. history — will arrive for the first phase of jury selection. Picking a jury could take three months, meaning opening statements in the trial may not actually begin until 2015. A verdict and possible sentence for James Holmes are likely still more than a year away.

A judge overseeing the Colorado movie theater massacre case said on Wednesday he will not delay the trial of gunman James Holmes again, rejecting a request by the defense for more time to study the results of a second court-ordered sanity exam.

Jury selection in the trial of Holmes, 26, is due to start next month, and Arapahoe County District Court Judge Carlos Samour has previously told lawyers for both sides to be ready to present their opening statements in late May or early June.
