I think he confessed to it. (as she is obviously not able to say it.. sorry to be blunt)
unless... there was a witness. but the alleged/reported end of the sexual relationship was the 28th of march.. same day she "vanished"
I thought it was the stepfather who said that. That maybe she had run away to California?
Tha half-brother made comments about her running away again....at one point...the step-father said separately that she may have gone to her father in CA...
I think Montoya probably admitted he sawy Kayleah that night and had sex and told LE that she was fine when she left him...LE may have told him they were seen together...
I think it means as in an on-going thing (can't legally consent if underage) rather than one event...even if Kayleah did consent, she can't, from a legal standpoint, so he would be charged or could be, for each event...
And if that is true, I think it won't be long before he's facing other charges. If he is responsible for her death though I'm not sure he'd confess to anything since it seems getting rid of her would partly be to cover up the "relationship" and more charges ~ which he's now facing since her body was found. MOOI am thinking that LE presented him with evidence (or told them they had evidence) that proved he was sexually involved with her on that day and he confessed.
I agree that violence doesn't need to be present if the victim is underage. The law, imo, doesn't recognize that a minor can consent. It's still sexual assault. MOOI don't think the law really differentiates as to whether it is consensual if underage, if that makes sense, i.e.it does not need to be a violent act, per se, to be considered assault, but I think we will have to wait to learn more.
