Mawhinney is a founding member of the Bloomfield law firm of Markowitz & Mawhinney, according to the firm website. Mawhinney is accused of rape in his hometown of South Windsor on January 21, 2019, court records show.

Kent Douglas Mawhinney, 54, is charged with sexual assault in a spousal or cohabiting relationship, second-degree unlawful restraint, and disorderly conduct.

He is accused of committing those crimes Jan. 21 and was arrested that same day, according to the records, which show that he is free on $5,000 bond.

Mawhinney’s case has been transferred from Manchester Superior Court to the section of Hartford Superior Court that handles the region’s most serious criminal cases.

Connecticut’s law on sexual assault in a spousal or cohabiting relationship prohibits anyone from compelling the person’s spouse or live-in companion to engage in any act that the law defines as sexual intercourse through the use or threat of force.

The crime carries a mandatory minimum sentence of two years in prison and a maximum of 20 years.

Mawhinney was originally charged with second-degree sexual assault rather than the current charge, according to a news release issued by South Windsor police shortly after he was arrested.

That information comes from a report by South Windsor police Officer Edmund J. Klein that police gave the Journal Inquirer in response to a freedom-of-information request. Police had initially denied a reporter’s request for the report.

Think about this timeline:

"The wife, who is not identified in court papers, initially met with Dulos at Max’s Oyster Bar in West Hartford on May 19, but after telling Dulos she would not meet with Mawhinney unless their lawyers were present, Dulos abruptly paid the bill and left, according to the warrant. On May 20, Dulos called the wife again, telling her Mawhinney was willing to meet with their lawyers present. On May 21, Dulos called again to set up a meeting, but the woman told him she had talked to her lawyer and did not want to have any contact with her husband, the warrant says."

May 23: FD and MT dinner party at 4 JC (who were the guests? planned guests? Was Mawhinney present/invited? Was his wife planned for/invited??)

I think it’s important to note that it took that woman 2 weeks before she came out to police about the weird phone calls and meeting with FD. If everyone in CT saw news or heard about JD missing and you called and met with that missing persons husband wouldn’t you think she would have contacted police earlier

The victim in the case no doubt had personal reasons for taking time after the event before speaking with LE. Trauma is handled differently and there is no clear 'right' or 'wrong' in terms of how events should unfold IMO. The circumstances of the meeting with FD could have been interpreted as being threatening and the victim could have been fearful IMO. Frankly I wonder why FD seemed so vested in resolving this entire marital situation? FD the great mediator in divorce court? I just don't see it IMO. Wonder what it was though that motivated him to attempt to intervene in a matter that on the surface had zero to do with him?

It is also unclear if the victim was still living in the house with the Defendant as well at the time that the meetings with FD occurred. The victim was dealing with alot at the time this event happened in terms of contentious divorce, custody battle, and FD imposing himself on her life with motives that are not immediately clear to us but might have frankly frightened her immensely IMO. All this happened to her while it appears she was still living with her STBX as it doesn't appear that either party vacated their shared residence during the divorce proceedings. Can you imagine dealing with everything that is going on and still having to see the person that is the other 1/2 of this legal battle every day?

New documents filed over the past few days in the divorce action but there is a reference in the documenting listing to Fotis Dulos/FD. Could this be related to the events detailed in the HC article yesterday?

His 3 conditions were a pretty good tip off that the meeting was not the greatest of ideas. Surprised that FD master negotiater didn't come up with something a bit more subtle! But it looks like KM and FD were in a hurry to patch things up with STBX. I'm scratching my head and wonder what does she know and why is she valuable to whatever scheme they might have had cooked up?

I really wonder where he planned to take his STBX on 'vacation' so they could 'reconnect'? Cruise ship with a balcony, mountain climbing, Greece perhaps?

It at least sounds like victims atty's protected her from herself and she listened to her gut to stay AWAY from 4JX! Hope the victim gets the support and counseling she needs as the DV through this sad story looks to have been awful.
