Susan left the apartments around 2:00 am with a 20-year-old man who was visiting the shore from Philadelphia. He later told police that he had attempted to escort her back to her hotel, but she was so drunk that she couldn’t recall the name of her hotel or where it was located. The man, who admitted that he had been drinking heavily as well, stated that he eventually gave up on Susan and went back to his own room. It was about 2:30 am when he last saw her; she had been leaning against the wall of Schellenger’s Restaurant on Atlantic Avenue at that time.
Susan never made it back to her motel. Two employees from Schellenger’s Restaurant found her body when they arrived for work around 10:30 am on Sunday morning. The frightened employees called the police to report the grim discovery; the first officers who arrived on scene immediately determined that they were dealing with a homicide.
Detectives re-interviewed a man who was last seen with Negersmith in February, the affidavit states.
The unnamed witness “reiterated the same information provided during his initial interview,” Detective Jennifer Falciani wrote.
He said Negersmith was extremely intoxicated and that he took her from the party May 26, 1990, and tried to escort her back to her hotel, but was unable to and wound up leaving her in the area where she was found dead the next day.
Is that what it says? I am reading that to say there is an "unnamed witness" (also name redacted later in article) who left her in the place where she was later found. They certainly name the man arrested as Jerry Rosado, so why would they use those other terms in the witness statement? Maybe I am *really* misunderstanding this article (possible...it's still early).So it ended up being the guy who told police he tried to help her but gave up.

Update: Rosado can't be tried due to appellate ruling with prejudice that the 5-year statute of limitations of 1990 were in effect, and a 2002 corrective legislative amendment has no retroactivity:
The trial judge previously had rejected an argument by Rosado's public defender that a 2002 amendment to the statute of limitations did not apply to his case.
According to the appellate ruling, the change says the statute of limitations begins to run only when authorities have both the physical evidence and DNA or fingerprint evidence needed to identify a suspect.
It notes the 2002 amendment has no language indicating it was meant to be retroactive.
The Legislature instead “stated that the amendment ‘shall take effect immediately,’” the ruling noted.
