Here is a hypothetical situation:

A person falls and breaks their left arm. That person is in bad pain so the doctor legally prescribes Percocet for pain. The person takes their prescribed dose of Percocet, gets in the car to drive home and runs over a child on a bicycle. This person could then be arrested for DUI and possibly manslaughter even though the drug was legally prescribed and he had a valid drivers' license.

Now look at this situation. GZ had a license to carry a concealed weapon and he was taking some legally prescribed meds that could have had effects on his thinking or ability to make a good decision. If those drugs caused him to make a poor decision (such as to follow and shoot someone), he can still be in trouble just as the hypothetical person was. After reading the information on the links upthread, GZ could have even thought he was in danger when he wasn't while taking those two meds. IMVHO the fact that he was taking legal medications and how they could affect him is very relevant to what went down that night.

Do you have any examples of a person who was taking legally prescribed medications (and not over dosing on them) being arrested for DUI manslaughter?

IMO, he is having side effects from the Librax, "restless muscle movements in your eyes". He did it 7 times in that 2 minute video. I remember people commenting about it when the video was first viewed.

My take on that is completely different. Librax and other benzodiazepines can cause nystagmus (tremors, not rolling or wandering, which is strabismus) that is most pronounced with a lateral gaze. I discussed this very issue at another site. Some there opined that he appeared to be on benzodiazepines.

I have a much simpler interpretation. I thought right away he appeared to be someone who wears contact lenses who had dry eyes or blurry eyes, and was trying to "clear" them by rolling his eyes around. (I wear contact lenses.) And he was in handcuffs, so could not rub his eyes easily (waist chains).

Well, right after that, his commissary list was released, and one of his first purchases from the jail commissary was contact lens solution. Generally, prisoners are allowed to keep corrective lenses and associated solutions in their cell-- as long as solutions are purchased thru the commissary.

So my take on the rolling eyes at the hearing is dry eyes and contact lenses.

Both of these site Florida Statute. This state does not allow any impaired driving whether it is by prescription or not. It is about public safety.

We are off the topic of the thread just a bit because this has to do with a concealed carry permit and not my hypothetical. My point is that any drug even if it's prescribed can impair a person enough to cause safety issues. That is why so many meds say not to drive while taking them on the label in great big letters. I am not saying GZ was impaired only that whether or not he might have been impaired by taking his meds is very relevant to this case if those drugs could have impaired him.
 
Librax is an older tried and true medication that really works...IMO and if my memory is correct.
As I said up thread the Librax acts as a smooth muscle relaxant for the stomach. Again IMO.

Yeah, my friend who has IBS takes Librax for that.

In my book, any med that states not be use machinery while on it probably is one you shouldn't be using a gun while on, either, but that's jmo.

Zimmerman takes Temazepam, an insomnia medication, and Adderall — which is prescribed for attention deficit hyperactivity disorder or narcolepsy — “medications that can cause side effects such as agitation and mood swings, but in fewer than 10 percent of patients,” ABC reported.

Did anyone do a tox on GZ? I wonder if he had anything else on board other than what he states he was taking.

I asked for examples of somebody sentenced with DUI for using prescription meds.
 
Where does it talk about an actual person actually sentenced for this?

Everyone knows you can't take narcotics/prescription drugs and drive. They aren't going to publish people's names.

From what I have read, no tox screen was performed the day of the murder.

How infuriating they would do a tox test on the deceased person who was shot for no apparent reason and not do one on the shooter!! Unreal!! Just shows that the SPD needs the Feds to investigate them. Talk about Hinky!!

The no apparent reason appears to be because he was beating the bejeebus out of GZ.

Was it legally prescribed and taken in appropriate doses?

In DUID cases, it does not matter if the driver is under the influence of a drug that is legal or illegal.

it doesn't matter how high of a dose you have in your system, if you're pulled over and drug tested and you have vicoden or some other narcotic in your blood you'll be arrested. At least in Calif. Who knows in Florida though? They seem to have a whole different set of laws that are somewhat SHOCKING to say the least.
