I’m watching a bit of this morning’s testimony now trying to catch up what I missed - had we heard that CD had searched how to shut off an iPhone’s GDS in Jan 2019 before? As an answer to JP’s question about GD having an android, he probably had already been doing that for his own phone for quite some time by Jan 2019 - perhaps even when chasing other married women prior to LVD. Did LVD have iPhone? If so, my guess is that Jan 2019 search was to tell her how to do it. Had we heard about the August request to Google to delete all location data for CD’s account previously? I wonder whether there was another request later or whether he just kept his Location services turned off from that point forward.

Whether we heard it before or not, I do think this was good info for the jury to have - I guess I’m just a little surprised it wasn’t included in the state’s case in chief - but perhaps it was and I missed it.

On Tuesday, prosecutors had planned to call Rexburg police detective Ray Hermosillo and Tammy Daybell’s former co-worker, Janice Olsen; both of whom had already testified. The defense previously filed a motion to block Olsen from testifying again because she had been watching the trial after her time on the stand.

Chad Daybell’s lawyer, John Prior argued that even though Olsen had been previously cleared by the court to come back, he was concerned about her testimony being “prepped” by prosecutors.

“Each time, magically, she seems to change her testimony and modify her testimony. Ironically enough, both times the testimony changed to help the state!” Prior said. “It’s shocking.”

Judge Boyce ultimately ruled that it wouldn’t be fair to the defense if Olsen were allowed back on the stand.

ETA: The Idaho supreme court's instruction about reasonable doubt has changed 6 days ago. They are discussing whether to use the old or the new definition. JP is arguing in favor of the new one while the prosecution prefers the old version.

Someone mentioned in the previous thread that the jury may take time to get to know each other before they start voicing opinions on the evidence. They have already gotten to know each other in my opinion. They have been stuck together for quite awhile now, only having each other's company during every break -- bathroom trips, smoke breaks, snack or food breaks, downtime while lawyers hash out things without the jury present,.... So while they won't have been discussing the case, they have already likely bonded, found out about each other's lives, and have a pretty good read on each other. I can almost guarantee they are ready to immediately start talking about all they have heard. MOO.

(Basing my comments on my own jury duty stints for county and federal trials. And in the cases where I served as a juror, we had only days of testimony, not weeks.)

Agree. Also would add they are probably ready to get down to business and get back to their lives.

Boyce just ruled that they're going to use the old one, and that was exactly one of his reasons. (The other main one being that it could confuse the jurors.)

Instructions will be read to the jury at 10am tomorrow.

Boyce has been such a paragon of reason, evenhandedness, and sheer patience throughout this trial. I sure hope they're letting him take a nice, long vacation after all of this. He's earned it.

OMG, this is ridiculous! Judge needs to get his law clerk on this ASAP and figure it out. I would say go with the law in effect when you started trial.

They are going with the old one. Another issue was about specifically mentioning questions (not just testimony) that were successfully objected to to the list of things the jury should disregard. JP was against adding that part - no wonder, considering how often he tried to testify for Chad.

Boy do I agree. I have never kept up with a trial at WS where the judge was so even handed and calm and shows wisdom to both sides. Thank you for the post.

He ruled to stick with the old instructions (the ones read to the jury at the beginning).

I'd love to hear attorneys opine on this given that the Idaho Supreme Ct order says that the new instructions apply "effective immediately" without qualification.

The May 22, 2024 order also indicates that the Order will be published for three consecutive weeks on the Idaho State Bar's website and in its weekly e-Bulletin and that, as soon as practicable, a summary of the amendments impacted by the Order shall be published in one issue of The Advocate.

IANAL, but I would expect that the fact that Prior brought this up would be adequate notice to this judge to seek out and read the Order and follow it.

What typically happens regarding implementation of new Orders to be implemented effective immediately when those Orders are relevant to proceedings in progress?

I might be the one who said that. If so, i was referring to them having their voices heard about trial testimony to each other, without the judge or attorneys or the public listening in.

At this point they likely know where each works, their hobbies, if they have children, etc. I’ve never served on a jury.

I can just imagine standing up and holding my head and saying “what the crap did we just hear for two months?!” I mean, this is the weirdest case I have ever followed. Then I would volte guilty.
