In court Monday, the judge in the case asked about an insanity plea, but Maye's attorney said she will be competent to stand trial.

"I'm not at this point concerned about competency," Maye's attorney, Sam Shamansky, said. "I’m concerned about my client's mental state at the time.”

Shamansky said he believes Maye understands the charges brought against her, though he wants to focus on her mental state at the time of the alleged crime.

"Competency means right now you can’t understand who is who, and you can’t help your lawyer with the defense," he said. "NGRI means at the time of the offense you are unable due to a mental disease or defect to appreciate the wrongfulness, so there are two different concepts, so we're focused on the latter."

The defense lawyer is right, focussing on NGRI before competency is putting the cart before the horse. In the interests of justice, there needs to be no question of competence before proceeding to a plea. And this is a case where sanity might actually be a realistic defence.

There is body cam footage of Pammy Maye confessing to killing Darnell. I'm posting several links, because some show different portions of the footage. She says that his murder was premeditated (her word.) She was angry with him because, earlier, he was eating snacks in bed. She suffocated him by putting a trash bag over his face while he was sleeping, and holding it there until he stopped moving. It is hard to watch.





 
I don't see any news about PM's court appearance today other than this. Looks like we may have to wait until May 23 for an update. :( MOO

She's accused of suffocating the boy and putting him in the sewer. She has pleaded not guilty.

Maye was indicted in February on charges of aggravated murder, tampering with evidence and abuse of a corpse.

A status hearing has been set for May 23.

A woman accused of killing 5-year-old Darnell Taylor is expected in court Thursday.

Pammy Maye was Taylor's legal guardian, and is accused of killing him back in February.

The 48-year-old is charged with aggravated murder, tampering and abuse of a corpse.

A woman accused of killing 5-year-old Darnell Taylor did not appear in court as scheduled on Thursday.

Pammy Maye's court date has now been pushed back to June.

The young boy, who police say died at the hands of his legal guardian, died of asphyxia, ABC 6 confirmed Tuesday.

The Franklin County Coroner's Office released the report that said 5-year-old Darnell Taylor was smothered. He also suffered several injuries to his neck, face, ear, lip, and back.

According to the report, Darnell's death was the result of "asphyxia by smothering with cervical neck compression." Franklin County Municipal Court documents claim 48-year-old Pammy Maye suffocated Darnell around 11 p.m. on Feb. 13, approximately six hours before an Amber Alert was dispatched. Maye later admitted that after killing Darnell, she put his body in a sewer in the 1600 block of Marsdale Avenue in south Columbus, records say.

Sam Shamansky, an attorney representing Maye, said Maye is likely to change her plea to not guilty by insanity at a later date.

The autopsy report also revealed that Darnell choked on the contents of his stomach and that his body had begun to show signs of decomposition.

The report also showed the boy had alcohol in his system at a level that would have been more than may have been generated by any decomposition process. The report does not indicate how Darnell would have ingested the alcohol or whether it could have come from cough syrup or other medication.

Darnell had bruising on his face and around his right ear and bleeding, called petechiae, in his eyes. Petechiae are commonly seen in strangulation and suffocation cases.

Maye's trial date is currently scheduled for late June, but it's unlikely that it will take place that day. Maye's attorney has said the case will hinge on Maye's mental health. She has not yet undergone a forensic interview with a psychologist, according to court records.
 
Why…my god why? This isn’t the first premeditated murder of a child for eating. Do these people starve their children and then go nuclear when the child is hungry. I feel like this poor child was probably hiding food. Then got caught and this person killed him for it. God knows what kind of abuse he had been through before he passed. At least the husband had some decency and reported her. At least he didn’t end up another ‘disappeared’ child that years go by before someone reports to authorities that they haven’t seen or heard from the child. Rest in peace little one.
 
Grrr...I can't find anything further than this. It was just a status hearing, so maybe nothing to report, or it was continued. ? MOO
