The state said it interviewed witnesses who told them they saw the men at a local bar hours before Nungaray's murder.

According to another witness, Pena confessed he and Martinez did something bad after partying and were looking for money to leave town.

Both men worked construction and allegedly asked their boss for the funds after explaining what happened, the lead prosecutor told KTRK.

It was also revealed in court on Monday that Pena told authorities he tried to tell Martinez to stop, but then Martinez allegedly put his arm around Nungaray's neck and covered her mouth.

After she died, Martinez allegedly tied her up and told Pena to put her body in the water to remove any DNA. Martinez also reportedly admitted to changing his beard to avoid attention and had a bite mark and scratches on his arm.

I think this sequence of events is a bunch of bull. I think she was tied up while she was alive, to control her, and I believe that's what her autopsy will show.

I would tend to agree. These two men did this with very little concern for consequences. Illegally entering the country, cutting off the ankle band, illegal drug use. Just a complete disregard for any rule of law or respect for fellow humans, and preyed upon the most innocent and vulnerable in the community. I understand her grandparents wanting LWOP. I am guessing they may be strict Catholic and against the DP and that could play in to things. I don't think we have heard what Jocelyn's mother wants. It is still very very early in the process anyway. But I just think the DA's office will do anything it can to NOT pursue a DP.

Such a waste. There is absolutely no doubt who the perpetrators are. This trial is a complete waste of time and money. I wish that there was a "fast track" for killers like this. Rather than the system we have, that churns for years, decades, in some cases.

I don't know -- free room & board & clothing, visitors, possibly taking some courses in the slammer -- dunno, probably a library, maybe a TV to watch somewhere, a place to exercise (with good behavior, I would assume), finding buddies to talk with and to play cards (or whatever games), visitors, etc., etc.
Of course, some prisoners wouldn't like what he did that put him in prison so that might not work out to well (such a pity ). Grrrrr.

Texas prisons are some of the worst in this country. Death Row, in particular is brutal. They do not have TV, one hour rec per day, no classes because they've been deemed to be unworthy of Rehabilitation. I will say there may have been changes in the past decade after my pen pal was executed.

Being a convicted rapist in general population of a child is a much worse fate. I'm told they get what they deserve there.
