Sentencing and beyond- JA General Discussion #8

I realize it's possible, but with what justification? This to me is a separate issue from MDLR's unprofessional behavior, since if present in her contract would apply to any mitigation specialist including those that do respect professional boundaries. This is not contradictory as the...

The defense team should have had one more member: a mitigation specialist for the mitigation specialist.

It seems to me that by the examples given by both you and Rickshawfan that such restrictions are intended to protect some kind of financial interest, such as preventing proprietary information from spreading to a competitor, or lobbyists offering insider information in exchange for favors. In...

I agree, but is too smart by half. Poor thing.

I'm aware of such restrictions that are litigated on a case by case basis, in other words as the result of a specific court action, but not in a standard professional/client contract. Can you give an example?

https://www.maricopa.gov/OPDS/Assets/Documents/Legal_Service_Contracts/Service_Provider_Contracts/11075-c.pdf While contact between the defendant and the mitigation specialist is a contractual obligation, and the contract expires upon sentencing, I don't see anything that forbids...

It shows they had very little to work with as far as mitigation. The defendant was a highly functioning member of society, and where she was lacking in achievement/development it was due more to her choices rather than a necessity borne of a compromised background. She projected an image on the...

The role and job description of 'mitigation specialist' arose gradually as a result of the Supreme Courts 1976 decision ruling capitol punishment once again constitutional for States (initially Florida, Georgia and Texas) implementing, among other things, sentencing guidelines for capitol cases...

In Touch is a tabloid magazine. A 2010 study showed its cover headlines were only 9% accurate and its stories overall were only 21% accurate, In other words 79% of the stories at the time of the survey were simply made up to sell magazines; not the kind of source that can be relied upon to...

Her role was ambiguous during trial, and proved ultimately ineffective. I'm going to look more into the official job description and try to relate it to MDLR's somewhat comical performance. I don't know for sure if a genuine friendship developed, or continues, but trying to find more detail...

I think it was intentional but it will be difficult to prove. My opinion is based on his lifestyle and his behavior. For example, it's said he had a 'history' of forgetting his son in the car, now, most people, I would think, if they did it once, or even twice, and then watched a video on pets...

The system is probably biased towards granting all requested delays since it's a one shot deal and the single opportunity for the convict to redress State wrongs, so they give them all possible advantage regarding logistics. It also allows to hope against hope for awhile longer, I guess.

I doubt MDLR is still in the picture. However above and beyond she went at the time, it was a paid friendship, and that particular contract ended at sentencing.

I'd agree with that, but they have to have something real, and not just character assassination, even if accurate in and of itself.

Guilty as charged. Speaking of which, how the F do you forget your baby is under two minutes, and it's not just a case of putting him in the car and going straight to daycare/work, he stopped and had breakfast with him, if I'm not mistaken, put him back in the car, and then forgot, and then not...

I understand, but the fact there was a change of venue, and that the jury which is eventually seated will claim impartiality support my premise that his character alone will be insufficient to secure a conviction and a determination of intention vs. accident absent hard evidence of the former...

Thanks. I don't think the jury in State vs. CA found her very likeable either, but imo the prosecution didn't make the case, and they ruled appropriately according to the letter of the law, at least in regards to the most serious charges. I'm not saying I think justice was served, on the...

I'd like to look into that, but I don't know where to jump in. Seems pretty complex legally, with high potential for another CA verdict, and I don't know if I can be truly impartial. His alibi at first glance seems ludicrous, and my first reaction is guilt, and if evidence to the contrary...

I don't know if she was thinking of killing him right then, but she was clearly pissed, and if she was gonna walk away from the relationship like he had been begging her to do for months she was gonna get a hell of a lot more from him than he was willing to give at the moment, thus the...
