Actually, in Florida, the assets would still be divided in half. Look at what is happening with the Julie Schenecker case, the woman who killed her teenagers earlier this year. She is trying to get half her husband's assets even though he is fighting her and fighting for divorce.

Does the jury know this is a DP case? Don't they do the penalty process after the sentencing? Do they call the original jury back? I think all they would be deliberating would be Murder 1 vs. lesser charges. Personally, even if they can't PROVE premeditation, I do think it is aggravated child...
