If the jury concludes premeditation based upon all the evidence of events that happened prior to Jodi arriving at Travis' house then the dura mater don't mean jack. It doesn't matter if she shot him first or last or somewhere in between. It doesn't matter if he was incapacitated or wide awake.

In truth, the jury doesn't have to believe or consider ANY of this. If they believe the she stole the gun from her grandparents house and used the gas cans and removed the license plates to hide her tracks premeditation is established which then tells you the rest of the story. Period.

Why does juannot clarify that being rendered unconscious = incapacitated. This is so dumb that they talk as if in apacication must mean motor skills are destroyed. Your motor skills are useless if you are unconscious from trauma to head caused by vibration, bullet entering and exiting skull.
