Sorry, JBean. Last time I recall this being discussed, I came away with a totally different understanding. I thought if documentation was requested, a poster should provide it or clarify their statements are their own speculation. Is that still valid?
ETA: Otherwise, seems to me that...
Sort of both. It's a normal motion done in an abnormal way. Usually the defense tries to make a credible case and I think the timing is a bit premature.
The post to which I responded, above, referenced an uncontrolled environment and replication of the body as originally found. To record how the body was found, it would necessarily require photographing at the scene under the parameters set forth in your post, including weather conditions...
Is there any evidence to support the allegation that this was done "in an uncontrolled environment" or that it wasn't an accurate representation of the "way the body was originally left"? Where is this allegation coming from? I saw nothing like this in the pleadings. Please cite the source of...
Will you please direct me to "a video of the hearing yesterday" to help me understand how you came away with such a different interpretation of the defense motion? Photos of the duct taped remains of Caylee may not be disseminated per court order so there's no use waiting for those.
On...
As always, you're not wrong. This is a ridiculous farce and so far every authority on the subject has opined thusly, including local experts. Like the local experts, I expect the court to rule against the defense without much effort expended by the prosecution.
I still don't see that as "tampering" with the evidence as alleged in your post. The only "tampering" alleged by the defense that I saw was the actual processing of the crime scene, as I responded to that post.
To give the passage you quoted some context:
"The only evidence to suggest a...
Thanks but I tried that spelling too. There are several civil cases including two from 1935 regarding estate taxes but no criminal cases that I found. This is more of the way they do things up north not matching what we do here, at best. My personal opinion is it's more grasping at straws and...
Believe it or not, I am truly not easily angered. However, it really infuriates me to no end the spurious and mendacious allegations made by the defense et al about the actions of the state, desperately trying to find every tiny little bone of Caylee's; night and day; bugs, snakes, mosquitos...
I looked for something regarding the defense's initial requests to visit the remains site; so far haven't found it but did find this quote from Strickland in reference to a subsequent motion to immediately examine evidence while LE was still processing the scene...
I downloaded the pdf of the Motion to Dismiss and converted to searchable text so I could find the word "tamper." The only accusation that came up in my search was on the memorandum, page 6 of the pdf, Summary of Argument first paragraph:
"Here, the State effectively destroyed exculpatory...
I didn't read their motion that way. Will you please quote the part to which you refer? I read their motion to indicate that processing the scene destroyed evidence and caused them to be unable to gather exonerating evidence. I don't recall reading anything about the state deliberately...
I went to WFTV looking for the Shaeffer video; didn't find it but did find another quote regarding the 'spoilation' of evidence:
http://www.wftv.com/news/20972889/detail.html
"WFTV legal analyst, Bill Sheaffer, said there is no chance the motion will be approved.
"This motion is without...
Hal quotes Bill Shaeffer:

IIRC, the defense request was denied but not solely because the remains had not yet been identified. As I remember it, the court ruled that it did not have the authority to tamper with the investigation. What I think you're remembering is the court didn't allow the defense at the autopsy...
