Judge's Order re: OP's Mental Health Eval

Preferential treatment is alive and well in SA it seems. I wonder if the hospital will receive a large 'donation' from a caring family in the next month?

What I meant was: If the defence hadn't called Prof V to testify about OP's GAD, the topic of diminished capacity wouldn't have even come up. Roux over-reached when he called her to the stand imo. He did not foresee Prof V saying things like "danger to society" for example. Nel simply did...

Nel didn't give birth to the diminished capacity claim, the defence did when they called Prof V to the stand.

If OP is denied preferential treatment for the psyche assessment (i.e moved to the front of the cue), this case could be in for a very long adjournment. If Mannie Witz is correct, the assessment cannot be done on an outpatient basis. No wonder Roux fought the decision so vigorously. I...

Wow, just wow!! Looks like OP could be held in psych custody awaiting assessment for months/years, unless he gets preferential treatment. Advocate Mannie Witz seems quite certain that the assessment has to be done as an inpatient because it's not a voluntary assessment. Tuesday's court...

Thanks for posting those videos Fuskier. Temporary non-pathological criminal incapacity!! If the DT were angling for this defence all along, it's pure genius!! Whether it succeeds is another matter.

Being someone who has undergone this procedure, I can say that your description of it is spot on. :goodpost: While many think ECT is a barbaric form of treatment, there is evidence that it is effective in treating major depression or as you put it "treatment resistant depression" I underwent...

Reeva may well have seen through him, but it may just have taken three months to do so. Attracted to him early because of his fame and charm, but gradually realising that he's not a nice person. Hence texts like: “I’m scared of you sometimes and how you snap at me and how you...

Exactly. It's an evaluation only. For the purposes of the court, I highly doubt they would make any recommendation about treatment.

The psyche testing may be beneficial because, in all likelihood, it will rule out the defence of diminished responsibility in both the trial and as grounds for an appeal. I think that is the reason why Nel pursued the psyche evaluation and Roux vehemently argued against it. JMO

Spot on soozie. :tyou:And Nel called him on that, saying OP was tailoring his evidence. :liar:Blind Freddie could see what OP was trying to do imho.

I too believe that is a possible scenario. A bitter argument (possible assault) that culminates in Reeva locking herself in the toilet. She screams at him through the door that she is calling the police and he snaps, pumping four bullets through the door.

I'm not convinced he is a sociopath but he certainly fits some of the criteria. 1. Superficial charm 2. Untruthfulness and insincerity. 3. Failure to accept responsibility for own actions. 4. A lack of remorse and shame. 5. Inadequately motivated antisocial behaviour. 6. Pathologic...

I have to admit I found it odd that OP chose not to be filmed during his testimony, especially considering every man and his dog knows who he is and what he looks like. I wondered what he had to hide. Your reasoning makes total sense CriLondon. Thanks

Love your posts CTC. Thankyou. Re the bold bit. Oscar's unwillingness to admit to any of the charges in and of itself tells us that there is seriously something wrong with the man. How he can plead not guilty to the charge related to firing the Glock is simply stunning to me. The evidence...

A question for you CTC. What are the chances that OP's evaluation will be done as an outpatient?

No, not anyone. But considering the circumstances of this shooting, I think an assessment would be a very logical thing for a defence lawyer to pursue. Maybe OP refused.

Strange that Roux argued that the psych assessment would be premature when many of the legal experts commenting on the trial believe a proper assessment should have been done shortly after he was charged.
