It does say that, but it looks like he appeared in 2 different court room on 7/24. One is for the attempted rape charge of the victim from 2011, which he was released for.....but not actually.....because he also appeared on another court room on 7/24 for the murder charge, in which you can read...

Yeah that could be a possibility. There's a lot of scenarios I guess that could fit the charges if you really think about it. And we may never know, whose to say he's gonna actually say what happened, or even go to trial. He may just take an offer. It definately takes a certain kind of monster...
I agree, how is it attempted rape when there was definate evidence of sexual assault? And I'm pretty sure the medical examiner would be able to tell whether the sexual activity was consensual or forced. Maybe it's just some "legal" terminology, that they have to use......or till they get DNA...
Yea that is strange wording MOMOFFOURBOYS. Maybe just a grammar error, but I read reports there was semen and it was awaiting DNA testing. So I think "ATTEMPTED" is inaccurate, we know for sure a rape took place. Bad choice of words in my opinion. Do we know how long DNA results take to come...

From what I've read, overcharging is common among prosecutors. By using multiple charges it increases the chances of getting a conviction. This allows the jury to agree on one theory and possibly reject another. It reduces the possibility of a hung jury or conviction of a lesser charge...
BTW.......I am in no way, trying to defend, justify or minimize the rape charges. Just stating my opinion why it's an "attempted" rape charge. Have a goodnight WS's :bed:

From the story I read, I gathered that there was not an actual rape. He had a female in his bedroom and at knifepoint demanded she disrobe. I don't know the details but was able to escape. But I guess that enough to charge with "attempted" rape. I will try and find the article.
When u read the charges in webcrims.... Murder in the first appears 2x.... So I'm assuming that's the 2 counts. But under one docket it says "indictment count-1" and the other says "indictment counts-2". Let's say for example the victim is not pregnant, how would a person get more than 1 charge...
I'm not sure exactly why it's 2 counts or how they decide that, but channel 12 news had some small coverage on the story, and the reporter stated he was indicted today on 2 counts if first degree murder. You can also view the charges on webcrims, but it's hard to decipher...
It doesn't make sense....says added 7/24 which hasn't even passed yet?? I was thinkin maybe they upgraded charges without his appearance?? And 7/24 he will appear and actually hear the new charges???
Absolutely it's intentional, but the difference between 1st n 2nd degree murder is if the murder was planned ahead of time, thought out.....both are intentional but 2nd degree is more "heat of the moment". Regardless he's being charged with 1st degree and he has no indifference for human life.

When I went on webcrims this morning it seems it has been updated since last night. There was a grand jury appearance 7/18 today ( I'm not sure if was present or not) but that's what it says-and when u check out the charges, there seems to be more added and upgraded.
125.27 appears 2x that is...
