The death of Roger likely has little impact on any prosecution of Rebecca due to spousal privilege. Just as Rebecca ultimately could not testify against Roger due to privilege, Roger would not be able to testify against Rebecca. Eugene Kimmi or any other parties would not be covered by this...

Now that RoHo has been convicted is anyone being granted the $50,000 reward that was offered? It seems like LE tracked down the leads on this but was there one tipster that broke the case open for them? http://www.patriciakimmi.ezweb123.com/

KSNT has a report out with a quote from Kuckleman stating that charges may be coming for two more people. I presume this is EK and ReHo. Is there another mystery person out there? Also, I don't agree that spousal privacy is voluntary. Quite the opposite - it is on par with doctor-patient...

I agree with every bit of your explanation. Everyone, especially the jury, has connected the dots but we haven't yet seen the whole picture. The public statements from the prosecution and the news coverage are necessarily simplified but I'm trying to understand the what must be the complex legal...

I wrote the following back in June: http://www.websleuths.com/forums/showpost.php?p=5263454&postcount=68 So, the capital murder conviction must reflect this evidence that was likely introduced at some point during the trial (and that I missed). I think my statement still holds true that the...

I will speculate that this means they've already reached a unanimous verdict of guilty and they are now trying to hash out the question of capital murder vs. 1st degree murder. That portion of the testimony was trying to establish the existence of an (oral) contract between EK and RoHo.

In short, probably not. There are a couple of legal issues here. First, RoHo enjoys spousal privilege with ReHo and for the most part she is prohibited from relaying any conversations she has had with him (unless RoHo releases her from that privilege). This was discussed several month ago by me...

I believe there was testimony somewhere deep within the extensive Herald blog coverage that no large sums were transferred from EK to RoHo and the only large sum transferred from RoHo to a third party was confirmed to be the purchase of a tractor. While that Sabetha Herald blog coverage was...

Last closing argument from the prosecution: If what the prosecution says is true, that the evidence need only show that Hollister was there that night to prove guilt, then there is no doubt that he's guilty. Hollister himself said he was there. Saying that someone else was there isn't going to...

From the Sabetha Herald's reporting of the prosecution's closing statement: And, in case (like me) you were wondering what the judge said with respect to capital vs. 1st degree murder: I may have missed it, but it doesn't seem like the prosecution did much to prove that there was a contract...

As far as I know a defendant can agree to a plea bargain at any time prior to a jury delivering the verdict. But, one thing to note on this trial is that Roger Hollister did not take the stand in his own defense. A lawyer can't knowingly allow his client to purger himself so I presume that...

This was an interesting legal detail from today's testimony. I've suspected all along that law enforcement had to tread carefully when speaking to RebHol... It sounds like they could not introduce any new evidence based on her testimony but they could ask her to corroborate previously...

In testimony given at the attempted murder hearing, a statement indicated that RoHo "wore a wire" presumably in an effort to obtain evidence incriminating a co-conspirator and possibly be rewarded with a lesser charge. It appears he was unsuccessful and as a result the prosecution has no proof...
