Whether someone is guilty or innocent, it has to be an incredibly tough decision to either accept and reject a plea deal. It's a huge gamble either way.
Look at what happened recently with the former governor of Virginia. He could have accepted a plea deal where he would plead guilty to one...
To be fair, most of those who question what she said don't appear to be doing so simply because they don't want to believe her. My impression is that they are looking at factors surrounding her testimony and questioning whether or not what she has said is accurate.
Even though I am not one of...
How soon after arriving back in Raleigh did JY get a lawyer? If I recall correctly they stopped briefly at Applebee's while his sister tried to contact her lawyer but they continued after she was unable to do so. That would seem to suggest that he did not yet have a lawyer when he arrived so I'm...
Personally, I think the whole thing with the hose being left on is nothing more than a red herring. It could have been left on earlier in the day after JY did yard work or it could have been left on by the killer after the murder. Someone correct me if I'm wrong, but I don't recall any evidence...
I think the shoes may be the biggest problem in the prosecution's case. They didn't really explain where the extra set of shoe prints came from. Although it can be theorized that the size 10's were used to throw off the investigation, there is no strong evidence to back that up. So the...
The second part is iffy. The question on the insurance form asked whether or not he had smoked cigars during the previous year. It's possible that an occasional cigar smoker could answer no and still be truthful.
Uggh. Here we go again with the prosecution asking a bunch of seemingly pointless questions that go nowhere. Why did the PT ask about the awards JY won in high school? Has that ever been even slightly important to this trial?
This PT team is absolutely terrible at cross examination. They ask a question, receive a response, and then move onto a completely different question. None of their questions go anywhere or do anything to cast doubt on anything a witness says.
On the policy he stated that he did not smoke cigarettes or cigars within the past year. Since he testified that he only occasionally smoked cigars, it would be easy for the defense to claim that he hadn't smoked any during the year before he filled out the form. This doesn't seem to be a strong...
I agree. If he was a regular smoker I would be more likely to believe that he went outside in those conditions. Since he was only an occasional smoker, it seems less likely that he would smoke it that night.
But most of us have seen people smoking in pretty nasty weather so it's not entirely...
I don't think the problem is that JY was able to dominate BH. The problem is that BH kept trying to catch JY in a lie, he would answer with a seemingly reasonable explanation, and then she would move on to another question without challenging any of his responses.
Even if it's true it may not mean much. If it did happen years later then her memory could have been manipulated, even unintentionally, by MY's family.
Perhaps I missed something, but if a hotel employee noticed the rock at 5:50, then how was JY able to enter the hotel at 6:30 with the door shut? Did the hotel employee not remove the rock?
Did the previous witness confirm that there was hair under the victim's body and in her hand that was pulled out of someone's head with force and was from someone other than JY?
I could see this as possibly being a problem with the jury. They would have to believe that he planned things so perfectly that he was able to cover up all physical evidence linking him to the crime. But they would also have to believe that he did not plan things well enough to cover up the...
Can someone refresh my memory... back in the first trial, I seem to remember someone from the hotel saying that the door had been found propped open multiple times in the months before the murder. Am I remembering that correctly?
