    Based on the state's evidence 2nd degree by definition is not a valid choice for the jury. Take the variation in sentencing b/w 1st, 2nd and NG, it falls as a compromise.     I'll recheck the warrant so how about your thoughts, specifically in regard to the theory of CY being taken from the home. I'm well aware HY took possession of the Lexus after the murder. I don't find that significant.
