Over the weekend a judge in Fla declared the DP unconstitutional, under certain situations. I saw the link last night, but I don't have it. Take this with a grain of salt. I think the closed ex-parte meeting on Saturday was related to the judge's ruling re: the DP.

Ann Finnel has filed a motion for mistrial based on a recent opinion from a federal case. The motion asks for a new jury to be seated that is not death penalty qualified.

The Jurors we have were all qualified for DP- willing to impose the maximum penalty if appropriate.
They want another Jury who are not willing ?
