should especially not be used to destroy people who are not on trial. I have to say that I don't think most defense attorneys would do what Jose did in his opening statement. Maybe partly because everyone agreed it was a stupid move back when he did it. And it was. Why would a defense put out a story that a jury would expect them to prove when they don't have to provide any "story" at all. How did he know he would get the only jury in maybe the history of this country who accepted a defense attorneys opening statement as though it were evidence even though he never provided any evidence to back it up. Most juries would have then not believed anything the defense said as they would conclude the attorney basically made it up of whole cloth and thus not have a real story of his client's innocence to tell. But not this jury.

This is Opening Statement instruction for lawyers:

The primary purpose of an opening statement is for counsel, at the beginning of the case, to share with the jury the issues and a storybook summary of what counsel believes s/he can support with competent testimony and admissible evidence....Obviously, what you have to say in opening statement is of importance in creating juror belief in your character and credibility....When you stand up in court to deliver your opening statement, you'll be providing the jurors with factual information that is intended and designed to create an embedded memory... Keep in mind that your opening is when the jurors will begin to form their first mental pictures of your case. You want the mental images to be vivid, but they also have to be factual. They must make logical sense...Recognize that your opening statement differs from your jury argument. In opening statement, you tell the jurors what the evidence is. In jury argument, you tell the jurors what the evidence means. In opening, stick to the facts or absence of facts...Don't overstate your case. Don't make promises in opening that you won't be able to keep. Having the last word in opening may encourage you to gild the lily. Don't do it.

The above is all normal and good advice. Compare that to what Jose did. I seriously think that based on that alone this defense would have likely lost with any other jury that could be assembled. It still doesn't make sense....

Hearing for ZG lawsuit tomorrow morning; Casey will not be present; still incarcerated. According to JVM, her attorneys saying she is emotionally and psychologically exhausted from her criminal trial.

Mark E. is saying he doesn't believe the lawsuit will hold water.......
 
Casey is exhausted per JB so she can't participate in Morgan's depo.

ICA looks like she's crying to hear GA saying he wants little Caylee back and she knows she never will be back. GA even said he'd switch places w ICA if he could. Sounds so sincere to me.

I agree. And (this coming from someone who despises Ga) in that video, he is begging her to talk, begging her. This is killing your mother. That is heartbreaking and no way this man was involved in any transporting or disposal.

Mark is cute but he's been wrong before. and --he seems to think all that lying JB did was just okie dokey for a defense attny

Jacking her chair down? Making a right royal spectacle of herself? Hooking up laptops? Writing inane ICAisms and folding paper? Tying a knot in the back of her shirts?

Mark E. doesn't think so - but he was so shocked by the not guilty verdict I think he is gun shy about predicting anything against her.

And Harry Krop is back on the show tomorrow night, Dr. Krop with the interesting hair and the interesting answers.

I get it, and I somewhat agree, but this is civil court, and Orange County - much more likely to award some kind of damages, give ZFG her piece of the pie (which I think jurors relate to as we've all seen lately) and get the hell out. Plus Morgan has benefited from seeing how the ball lies on this course. He's purdy good. We will see.
