This is the first article in the AZ Victim's Bill of Rights http://www.azleg.state.az.us/const/2/2_1.htm:

1. To be treated with fairness, respect, and dignity, and to be free from intimidation, harassment, or abuse, throughout the criminal justice process.

So I guess you'd have to ask Sam how she felt if this was harassment or abuse being confronted unwarranted like that in the courtroom by this defense witness.

I know my attorney told me that Victims have the right to not be contacted by agents of the defense.

5. To refuse an interview, deposition, or other discovery request by the defendant, the defendant's attorney, or other person acting on behalf of the defendant.

This one speaks to more what happened to me. They can't ambush you, you have the right to be contacted then refuse.

I guess it's how you interpret this law. But again, my attorney Keli Luther as well as our prosecutor both told me "as a victim you have the right to not be contacted".

So...I do take this unwarranted and uninvited contact seriously. No matter what was said.

There is no way a FB page generated from Australia has any inside info as to who will be called. None. I would be surprised if even the Family of Travis would know, KCL may be able to clear that up i.e. if Mr. Martinez informs them of who will be called. That I would have no way of knowing as I am not a victim. However................there are many things floating around on many different topics which all should be taken with a grain of salt.. it is like playing the phone tag game, and how the beginning of the story is never the ending of the story.

OK I understand that there may be some "international" rivalry - but I think we have to be careful about trashing people and pages. I don't think it's really necessary - trashing someone for what ever reason in what ever environment doesn't make the person being trashed look bad, it makes the person doing the trashing look bad.

I don't mean to offend anyone but that's how I see it.

IT'S NOT PERSONAL? If that's what she said then she's sicker than Jodi which says a helluva lot. I'm SO sick of the current phrases like " this isn't about you" and " it's nothing personal " what a cop out for taking responsibility for attacking someone, then wanting to step away from ownership of it.

I hear you but oh my gosh we don't know what she said. We can only suppose!

We can imagine but IMO this shouldn't grow legs! Just the mere fact that she approached a family member after trashing their brother on the stand after being brutally murdered is bad enough. Karma, Karma, Karma.
 
Maybe part of that "hallway conference" at the end of the day was not only to admonish her for her approach to Sam, but to tell her that her friends are no longer welcome in the courtroom either... at least we can hope!





I am beyond belief that there was a "hallway conference" to begin with. They should have met in chambers, and had it on the record. I am very disappointed in this Judge, especially presiding over a DP murder trial. Many ears lurk around the water cooler, and it was not to discuss dinner reservations. Juan should have demanded it be put on the record... well, maybe he did, but with no record, it's like it never happened.


As for ALV's pep squad, they, along with DB and the mitigation specialist should have been openly reprimanded with a strong voice, and told if any further outburst occured, they would be banned from the courtroom. I have never seen a Judge rule a courtroom in such a disgusting manner. :furious:

Not trashing anyone, I am stating that if anyone would know it would be Travis' family not a FB page. I love the Aussies no rivalry here at all, been to Perth, Sydney, all over, beautiful country beautiful people. If you mistook that as trashing I am sorry. Just stating that it is highly and I mean Highly unlikely they can confirm that, whether they are in USA, Australia, Bulgaria, Siberia, all the same to me.
 
I just watched the longer version of Det. Flores' interviews with JA's parents (link posted on the media thread). After seeing how devastated Sandi Arias is during that interview, I don't understand her demeanor in court. The smirks, the apparent lack of empathy for TA's family. On the most basic level this is a horrific crime. How can she not feel awful about what happened to Travis? And why would she blame his family/siblings or at least not feel terrible for them? I just don't get it. She can't possibly believe the lies about 'domestic violence?' She knows her daughter is a liar.[/QUOT

Well, its been 5 years since that interview...and you know the old saying..."blood is thicker than water"....the JA clan reminds me of Honey Boo Boo's Family...and even they have more class.
 
I should add that I do see JA's father not giving her a pass on this. The sense I got from his interview is that he wasn't quite as shocked as his wife. He seemed to accept where the investigation was headed and conceded to JA being involved pretty quickly. So, with the very little info available, it appears to me that JA's mother is more in denial about this than her father. To me her father looked rather disgusted his few times at the trial. I suspect she hasn't pulled the wool over his eyes.

SA has had nearly 5 years to numb herself that her daughter is a murderer. She has also had the same amount of time knowing that JA can't actually walk into her home and terrorize the family. No more wondering where her daughter is, who she is with, who she is stealing from, etc.

She is in court because the DT wants her front and center for appearance sake. Think about it SA is probably relieved JA is someone else's problem and really believes JA will not be freed. As for her behavior re TA's family....not sure what to think. But SA can do what the DT asks for 5 months or so and then she can go back to her life. :twocents:

I think the Judge would and did admonish/instruct the witness to not behave in such deplorable ways in the courtroom.

I adore AZ Lawyer and respect her knowledge completely and I'm just speaking as a lay person who has been on the receiving end of something like this. But she knows what she's talking about. I just know I was instructed that I had the legal right to not be contacted and when that (horrible, lying) investigator for the Legal Defender's office ambushed me in my home I said to her "isn't it illegal for you to be approaching me like this?" (once I came to and realized what was going on...how disorienting, I assumed of course she was representing OUR side when she showed up unannounced on my doorstep 2 weeks before the anniversary of Cindy's death). She immediately responded with some law, some loophole she knew and had calculated that she was slipping through.

She lied to my face saying if I helped with this "retardation" argument (um why WOULD I?) that he would get Life without Parole. That was never, not once on the table as it wasn't an option when he was convicted so not an option now. She had been working on the case for years so of course knew this important FACT. We were talking life WITH parole which would have had him go from Death Row to eligibility for parole in 5 years...FIVE YEARS.

I knew she was lying or at best uninformed. Then I interrupted her and said "really what has happened to you in your life that youv'e become a person who would walk in to my house, right before Christmas which is the anniversary of my sister's murder and stir all this up for me thinking I'd cooperate with you? What is wrong with you?" (obviously I was pissed)

She started crying and said "I'm sorry I'm tearing up, I don't know why I'm reacting this way" and I said "you are reacting this way because you are having a normal human emotion to a true victim, ME, not the man you are championing. ME who was going to decorate my house for Christmas today, can you imagine what this is doing to me? In fact you need to get out of my house". Then I walked out of the room and in to my kitchen, shaking, and said "you can let yourself out the door you came in". Then she left her card saying "well here's my card, you can contact me anytime" to which I said "oh I will use that card to contact someone about you, you can be sure of that" and kicked her out of my house.

I immediately called Cathy Hughes our prosecutor who put me in touch with Keli Luther who was then with the AZ Crime Victims Legal Assistance Project and represented me in this and got that loop hole at the legislative level changed. She wrote me back that very day and said she'd been waiting for a case to take to argue this and she used this incident.

My friend then came over to go to brunch with me and said I was shaking hours later. And I"m a very strong person. 18 years later this got me shaking for hours. That's what these people do to victims.

You can see why i feel so strongly about this.

I am sad to read this.....I was so hoping MM was gonna testify...dangit!! I just have that nagging feeling he knows more...a lot more.

I don't want MM anywhere near that witness stand. After reading what he posted on the pro-Jodi site [ he was verified by the admin] ---I don't want him to speak to the jury. He would probably continue to lie and say he saw handprints on her neck and bruises on her. That could result in 'reasonable doubt' imo.
