JUNEAU, Alaska (AP) - Attorneys are fighting over evidence one month before a Utah man is scheduled to face trial in the death of his wife on an Alaska cruise last summer.

I have April 23rd as a pretrial hearing as this sentence I have in my description from 9/18/17:

Attorneys in cruise ship murder case will split up blood evidence, notice says

Both parties in a cruise ship murder case have agreed on how to handle blood evidence in the case, according to a notice the Public Defender’s Office entered Friday into U.S. District Court.

During various warranted searches, authorities took four 10-milliliter tubes of blood from Manzanares.

The notice says that the U.S. Attorney’s Office agrees to keep two vials of the defendant’s blood for testing, and provide the remaining two vials to the defense for independent testing.

Both parties in the case also requested that an April 11 hearing regarding the motion to preserve evidence be vacated, according to the notice.

Trial by jury is scheduled to begin Nov. 5. If convicted, Manzanares could face life in prison and a fine of up to $250,000.

The Federal Public Defender’s Office filed the motion Friday (5/4/18) in the District of Alaska. A defense motion seeks clarification of a Utah man’s federal murder charge.

The motion says the U.S. government’s indictment is not specific enough to allow Manzanares to defend himself adequately:
“What evidence, including words or conduct by the defendant constitute evidence of the defendant’s malice aforethought, deliberation and premeditation?”

Newly filed court documents reveal more details about the murder of a St. George woman aboard a cruise ship near Alaska.

.....In a motion for more detailed information about the federal indictment against him, Manzanares’ defense attorneys challenged the notion that Kristy’s death was premeditated murder.

.....Nothing in the discovery suggests that the attack was planned or designed in advance. Statements from interviewed witnesses are uniformly consistent that Mr. Manzanares and his wife enjoyed a happy, stable, and mutually supportive relationship free of domestic violence,.....

He also said there was no evidence of a weapon being used to kill her.

“By all accounts, the attack took place over the course of a matter of minutes, and involved the use of bare hands,” Curtner wrote.

BBM. This would not have been his first attack on her. Some people are just better at keeping their dirty linen out of the public eye.
He was punching way above his weight with that beautiful woman.
Is that what angered him?
There are different reports on how he killed her. I have read several times that he bashed her with the removable metal ladder on bunk beds.

Attorneys seek later trial date in Alaska cruise ship death

JUNEAU, Alaska (AP) — Attorneys are asking a federal judge to delay until next May the trial for a Utah man accused of killing his wife on a cruise to Alaska last summer.

Attorneys for Kenneth Manzanares filed a written motion Friday asking that the trial date be pushed from November until May 2019. They say prosecutors do not oppose the request.

They say Manzanares’ mental state at the time of his wife’s death will likely be a key issue and that they are ethically obligated to conduct their own investigation into his background “for possible mental defenses.”

NON-OPPOSED MOTION TO CONTINUE TRIAL

A period of excludable delay under 18 U.S.C. § 3161(h)(7)(a) and (b) will occur should the requested continuance be granted. The Speedy Trial Act calculation, as of the date of the filing of this motion, shows that the 70-day mark would fall on December 31, 2018, leaving 220 days remaining from this date before trial must begin pursuant to the Speedy Trial Act.

Defendant Kenneth Manzanares, through counsel, moves this court for an order continuing the trial date from November 5, 2018, to May 19, 2019. Additionally, counsel have filed separately a proposed amended case scheduling order consistent with this motion.
