Scott Ellington, District Prosecuting Attorney for the Second Judicial District of Arkansas, announces the filing of formal capital murder charges against a Bay man accused of the July 3 abduction and killing of Lavinda Counce, 90, also of Bay.

In a seven-count felony Information filed Thursday in Craighead County Circuit Court, Ellington charged Richard Jordon Tarver, 30, of 309 Harris Street, Bay, with capital murder, aggravated robbery, kidnaping, aggravated residential burglary, abuse of a corpse, theft of property and possession of a defaced firearm.
 
Trial reset for May in death of woman

JONESBORO -- A Craighead County man will be tried in May for the capital slaying of a 90-year-old Bay woman last summer, Prosecuting Attorney Scott Ellington said Wednesday.

Richard Jordan Tarver, 31, of Bay will be tried in Craighead County Circuit Court on May 23 after Craighead County District Judge Tommy Fowler changed Tarver's original trial date from March 14.

A Craighead County circuit judge will hold a hearing in Jonesboro to determine if 20 photographs of a 90-year-old woman's fatal injuries will be allowed in the capital murder trial of the man accused of killing her.

Tarver's attorney, Randall Miller of Jonesboro, filed several pretrial motions, including one that sought suppression of autopsy photographs of Counce's wounds.

In a hearing Thursday, Miller contended that the photographs were graphic and prejudicial against his client.

Craighead County Circuit Judge Cindy Thyer set an Aug. 31 hearing to determine the admissibility of the photographs for Tarver's trial. Ellington said a state Crime Laboratory medical examiner will testify on whether about 20 photographs are necessary for the prosecution.

Tarver's trial is scheduled to begin Sept. 26 and could last for two or three weeks, the prosecutor said.

Tarver, 31, of Bay is accused of forcing Lavinda Counce, 90, from her Bay home and into the trunk of her car July 3, 2015. Police say he drove her to a cornfield east of the Craighead County town, forced her to walk into the rows of corn and then shot her in the back of the head with a .38-caliber handgun.
