With Mother's Day approaching, I was thinking of all the family time the two timed felon has missed out.

Since his arrest in Nov 2014, he has missed:
5 Christmases,
5 New Year's Days
4 Father's Days
His young son growing into a young man.
His daughter Taylor blossoming to a poised young lady.
His own birthdays
Companionship of his lady friend

Why didn't they try harder to find DK? Why didn't they subpoena DKs phone records? Why didn't they find corroborating evidence of alternative accounting? Why didn't they secure a strong alibi for CM for the 4th?

Either the defense knows or strongly suspects the two timed felon is guilty, or........sitting in a cage for 4 and a half years is no biggie.

IMO MOO etc etc

What is the point of your comment? Are you suggesting the reason CM has been confined to jail for the last 4+ years is because the DT couldn't find DK?<modsnip: unnecessary>

Just watched Mr.Robertson on the stand.
He seemed pretty lackadaisical to me.
Not a bit embarrassed that he couldn't get the job done and locate DK.
It was just like --- hey, I couldn't find him!
So weak. MOO.

Well if the two timed felon is convicted and continues rotting away in his cage, maybe, just maybe if the defense had found DK or kept better tabs on Riccobene, he could have had his freedom again. IMO.

I like Smith. Probably a bit too liberal with how he runs things but I think he is on his game. I also believe these jurors to be very sharp and would not be surprised if every one of them, including alternates have decided he's guilty.
I hope you are right. He is a patient man but I am getting annoyed that we are coming down the home stretch and he is bending over backwards for Maline. I feel for Maline because he is left holding the bag. The way I see it is that McGee has been allowed to call the shots.
Then hearing he allegedly was out partying on Saturday just slays me. MOO.

The two timed felon has been caged and shackled for the past four years because he decided it was a good idea to engage in alternative accounting and tried to delete QB at a most unfortunate time, and could not come up with an alibi for the night his boss and family was bludgeoned to death. IMO

Then why did you initially indicate otherwise?

If the DT had found him then DK would have taken the 5th resulting in a similar circumstance as we now have. It may have played out a little better for the defense if they would have found him but not enough to change the final outcome.

How do you know for a fact DK would have plead the 5th? You don't know. The only person who can say for sure is DK and he isn't talking.

Isnt just amazing how a totally (cough cough) innocent man is so willing to give up all of his freedom, and would rather live inside a jail cell for many years? Lol!

I guess he enjoys the cot, and three hots he gets a day! Lmbo

Maybe he enjoys not having any responsibilities? Plus now he has a legitimate reason for not being a present father and providing financially for his family. I bet he misses the ol' casinos though.
 
If the defense has a witness on their list that they decide not to call, does that witness then become available to the prosecution to call?

I am thinking in terms of his medical records.
Thinking in terms of Merritt's medical records? I'm no legal eagle but I would think the witness would be freed up for whichever side.

I would think so too.

I'm just trying to think of who their rebuttal witnesses could be, and if it necessarily needs to be evidence to refute something presented by the defense or if it could also be just a witness that the defense had listed but didn't call.

Medical records were subpoenaed and received from Arrowhead Regional Medical Center and San Antonio Regional Hospital. I assume at least one if not both of these records belongs to CM. The attorneys have these records. No mention of any witnesses from either side to testify about them.
