As indicated in the Trial Decorum and Media Order, the Court will be using a badge system to monitor seating for the public and the media during the trial and also during the pretrial motions the week of June 6-10.

NO courtroom seating will be available for the weeks of June 13-17, June 20-24 or June 27-July 1, as all courtroom seating will be needed for jurors during the jury selection process. Overflow seating will be available in another area of the courthouse during jury selection. Currently it is not anticipated that the Court will need to utilize the badge system to assign overflow seating for interested members of the public or media during the jury selection process. Actually - if I have this correct - jury selection start June 13th thru July 1st. A pretrial motions hearings from 6/6 to 6/10.

But I do see that article has June 20 as jury selection starting. Makes more sense than on 6/13 thru 7/1 - if it starts 6/20 thru 7/1.

@Emi - does the court site have any dates yet? I don't recall & I'm on the wrong page to look right now.

It's been awhile since I last posted this - so I shall shorten it up a bit.

Monday, June 6th:
*Pretrial Motions Hearing (Day 1 of 5) (@ 8:30am PT) - CA - Kristin Denise Smart (19) (missing May 25, 1996 while walking back to her dorm from a off campus frat party at Cal Poly, reported missing on May 26, 1996, San Luis Obispo, still missing; legally declared dead on May 25, 2002) – *Paul Ruben Flores (19 @ time of crime/44/now 45) arrested (4/13/21), charged (4/14/21) & arraigned (10/20/21) with 1st degree murder. Plead not guilty. No bond.
*Ruben Ricardo Flores (55 @ time of crime/80/now 81) arrested (4/13/21), charged (4/14/21) & arraigned (10/20/21) with accessory to murder after the fact. Plead not guilty. $250K bond. Bond was lower to $50K. Has posted bond (4/22/21), out of jail.
Trial was set to begin on 4/25/22 was continued to 5/31/22 continued due to change of venue with jury selection starting on 6/20 thru 6/24 for Paul & on 6/27 thru 7/1 for Ruben. Trial set to begin on 7/6/22. Trial has been moved from San Luis Obispo County to Monterey County in Salinas.

4/4/22 Update: In a hearing this morning, the courts established that they will convene on 4/20/22 to decide where the Smart case will be moved to. Deputy District Attorney Chris Peuvrelle expressed concern about being ready to establish it on that date, as they have not been told which counties are options yet. If needed, the court will push out the date to 4/27/22 to decide where the trial will be move. Pretrial readiness hearing on 4/6/22 has been cancelled. During a virtual San Luis Obispo County Superior Court hearing, Paul waived time for 60 days & a 5/31/22 trial date was set. The new trial date was selected during a virtual San Luis Obispo County Superior Court pretrial hearing on Monday, Apr. 4.
4/20/22 Update: Today Judge Craig van Rooyen is set to propose the new location for the trial. Paul & Ruben in court. The case has been move to Monterey County. Next hearing on Monday, 4/25/22 @ 1:30pm via zoom to work out details. 4/20/22: Robert Sanger, an attorney for Flores, also filed a motion on Wednesday, requesting that the court help Flores' defense obtain evidence from the prosecution, including three dozen soil samples that may be re-tested.
4/25/22 Update: Case has now been assigned to Judge Rafael Vazquez for all purposes in Salinas, Monterey County. 4/28/22: Affidavit of Prejudice pursuant to 170.6 CCP against Judge Rafael Vazquez by prosecution submitted to Judge Pamela L. Butler for reassignment. Peremptory challenge to Judge via Code of Civil Procedure #170.6 submitted by Deputy DA Christopher G. Peuvrelle. Case assigned to Judge Jennifer O'Keefe in Salinas.
5/4/22 Update: Monterey County Superior Court officials confirmed the information Wednesday that the trial will be held in Salinas & also announcing that Judge Jennifer O’Keefe will oversee the trial. Prior to Monterey County being selected as the trial location, a May 31 date was set as the start of the trial. Monterey County Superior Court officials Wednesday said they did not have an update on when the trial would begin or whether it would be delayed at all. There was also no upcoming court date for Paul or his father listed on the court website.
5/23/22: Order: It is ordered that Ruben Flore's bail release conditions are modified as follows: Flores is permitted to SLO County to attend all court proceedings in Monterey County. Flores is permitted to travel to & from Monterey County to attend all court proceedings. Floris is permitted to travel within Monterey County during the pendency of his court proceedings. Flores will continue to be electronically monitored by the SLO Probation Dept. by Judge Jennifer J. O'Keefe.
5/31/22 Update: State filed 2 motions (under seal) for Paul & 2 motions for Ruben. Paul’s defense filed 4 motions (all under seal). 5/31/22: Request & Brief. The trial against the Flores men was moved to Salinas after San Luis Obispo Superior Court Judge Craig van Rooyen ruled that they would likely not receive a fair trial in San Luis Obispo County because of pretrial publicity. Hearings in the case are scheduled daily Monday through Friday regarding various pretrial motions.
