I saw Mark Geragos in a TV video as he walking in public, years after the trial, being asked by a news reporter why he didn't call the witnesses to trial who said they saw Laci walking her dog that morning. He said, and I paraphrase, that he couldn't call them because their witness statements varied and he thought this would benefit the prosecutors more than the defense. I have tried to find this video but haven't been successful. Based on this, it was his decision to not call witnesses who thought they saw Laci and her dog that morning.

Thank you for that information: Translated - the witnesses had no credibility and would harm the defense--- Scott Peterson supporters always talk about those alleged witnesses who saw her walking her dog-- yeah right- If they were credible they would have been called.

The technical term is called "false sightings". There are many brunette women who walk dogs but aren't Laci.
 

Two years after his death sentence was overturned Scott Peterson has been moved from San Quentin to another prison. check out his mug shot recently taken- he doesn't look so cute now, does he? He is 50 now- hope his conviction stands.

Other than the one juror who the defense now objects to, what will be their evidence that he is not guilty?

  • “Laci’s and Conner’s bodies washed ashore 90 miles from their home but within sight of where Peterson admitted he went fishing the day they disappeared.”
  • “Research Peterson did on bay currents in the weeks preceding her disappearance and the fishing boat he bought but mentioned to no one.”
  • “Peterson’s inability to explain what he was fishing for in the middle of the day.”
  • “His repeated subsequent surreptitious trips to the marina in the weeks after her disappearance.
  • “The many steps he took in the weeks after she went missing — selling her car, exploring sale of the house, turning the nursery into a storage room — that indicated he already knew Laci and Conner were never coming back.” KRON4 news

No question there is ample evidence of his guilt but the defense is attempting to negate all that by way of a technicality involving a juror--that she should not have been on that jury and that she was biased against him because of her history-I hope this weak attempt to get another trial fails.

Yeah I think Geragos knew that was not going to fly.

And points out that they located the pregnant woman who was walking her dog- it wasn't Laci, even if said pregnant woman was wearing a white top and black pants.

Wow! Coming up on 20 years this Christmas Eve.
 
Yet Geragos wanted that particular juror on the case. He could have challenged and had her striken in jury selection.

She was ready to walk out the door at jury selection, but Geragos called her back - so hoping this will be argued also! The Judge should have a decision in 90 days my notes say - so sometime in November....

The judge who will decide if Scott Peterson gets a new trial will announce her decision in court during a hearing next month. Judge Anne-Christine Massullo has scheduled the hearing for Dec. 2 in San Mateo Superior Court, where Peterson in 2004 was convicted of killing his wife, Laci, and their unborn son, Conner.
 
Anyone reading here have access to the San Mateo court site? Just wondering what time this hearing will be.

Scott Peterson was scheduled to go to San Mateo Superior Court on Friday, and learn during a hearing that was to be broadcast live on television, whether his murder convictions would be overturned.

But the hearing was vacated Monday in an order by Judge Anne-Christine Massullo. The order said she will instead issue a written ruling only. The order also vacated her previous order to transfer Peterson from prison to the San Mateo County jail so he could be present for the hearing. Instead, he will remain in prison and await word from his attorneys.

The ruling gave no explanation for her decision to vacate the hearing, which was scheduled earlier this month. Nor did it say when the written ruling would be issued, other than that it will be before the Dec. 16 deadline.

I think this is a good ruling, it costs a lot to bring a defendant to court for a hearing, I wonder if anything can be read into her decision to not have the hearing and just to issue the ruling, I think it would be a bigger impact if she vacates his conviction,

Friday, December 2nd:
*Judge’s Decision Hearing (on retrial)-Vacated by Judge (@ 10am PT) – CA – Laci Denise Peterson (27) & Connor (unborn) (missing Dec. 24, 2002, Modesto; found April 13, 2003 in the San Francisco Bay) - *Scott Lee Peterson (30 @ time of crime/31/now 50) convicted & found guilty (11/12/04) of 1st degree murder (Laci) & 2nd degree murder(son) & sentenced (3/16/05) to death by lethal injection.
His case is currently on automatic appeal to the Supreme Court of California. Sits on San Quentin's death row. Calif. Supreme Court denied a new trial in the guilt phase but reversed the death penalty sentence for Stanislaus County. Also the San Mateo Superior Court will now consider whether there was jury misconduct. Stanislaus County district attorney’s office said it won’t seek the death penalty if there is a new trial.
Re-Sentencing Hearing on 12/8/21. Peterson was moved to San Mateo County jail on 11/29/21 for sentencing hearing. Ordered Peterson to serve life in prison without the possibility of parole for the 1st degree murder of Laci & a concurrent sentence of 15 years to life for the 2nd degree murder of Conner. Peterson was transferred from San Quentin State Prison (~10/21/22) to Mule Creek State Prison.

6/29/22 Update: One of Peterson's attorneys tested positive for the virus, according to Deputy Court Executive Officer Sarah Lind & Peterson himself was exposed to COVID in his pod at San Quentin. Peterson is on "loose quarantine," she explained. Peterson was scheduled to have a status conference on Monday in his juror misconduct hearing. The hearing was rescheduled to 8/11/22.
8/11/22 Update: After more than five & a half hours, the day's proceedings closed with the judge asking both sides to submit memorandums, if they like, by mid-September. The jurist has up to 90 days to release her decision. The hearing stemmed from defense attorneys' argument that juror Richelle Nice was biased. They argued Nice lied to get on the jury that convicted Peterson in 2004 & put him on death row for the murders of Laci & the unborn child they planned to name Conner. Sometime mid November.
10/24/22 Update: Peterson has been moved off death row more than two years after the California Supreme Court overturned his death sentence. Peterson was moved last week from San Quentin State Prison north of San Francisco to Mule Creek State Prison east of Sacramento.
11/3/22 Update: Judge Anne-Christine Massullo has scheduled the hearing for 12/2/22 in San Mateo Superior Court, where Peterson in 2004 was convicted of killing his wife, Laci & their unborn son, Conner.
