To the great legal minds on this thread- who determines if they are going to need a new trial due to Sgt. Leon? The judge from this trial or a new judge or ???? I sure hope that it doesn't happen. Sierra's family and friends have been through enough. Justice for Sierra.

I think protocol is to start with the trial judge and move up if it isn't granted at this level. It could be granted at a higher level, or all levels could deny the request and then there would be no new trial. However, to get a new trial it would have to be proven that this one was flawed in some way that affected the verdict. I do not believe that even if Leon is guilty of what they are accusing him of it would affect this trial. IOW, no new trial unless they could prove that he lied in this case, falsified evidence in this case, or did anything illegal to affect the outcome of this case. What he may or may not have done in regard to other cases will affect only those cases.

OOPS, I see you addressed your post to great legal minds. I'm certainly not one so take what I have said for what it's worth. It's my opinion only. I do know that defense attorneys talk a good talk sometimes, and reporters often report what sells...just keep that in mind whenever some supposed bombshell news comes out.

It is a very very good opinion. One does not need a law degree to be able to understand such issues. Many of our posters have for years read, and done much research on criminal law including law statutes. I find your post very knowledgeable, and your understanding of it is very sound. IMO

Imo, the sitting Judge on this case will not set this verdict aside even if a motion is filed during the time the jury is deliberating his penalty phase. The verdict will stand.

Of course the defense will use this issue as one of their appeal arguments but it is absolutely as you state. They must prove he committed perjury in this case. What he did in other cases is totally irrelevant to this case, and only relevant to those cases. It is also correct the defense must show that his testimony (IF false) was so egregious it could have made a difference in the outcome of the verdict.

I haven't seen any proof where this officer said something in this case which was not true. If he truly had the defense would have leaked it to Kaplan and even she was silent which she never is if it praises the defense and she never mentioned once that the defense even questioned him about lying in this case when he testified.

I don't think the defense will win an appeal in this case no matter which higher courts finally hear it.

What convicted this suspect was all of the forensic DNA evidence linking him to the murder of Sierra which has no biases either way. It is what it is, and in this case it was plentiful.

Honestly, I remember seeing these constant down times in CA trials only. I find it very odd. No one really seems to want to put in long full days...not even during the trial phase or when they are deliberating. I have never understood why CA cases are like this. JMO
