CM phone first connecting with a cell tower at 9:36 a.m. and connecting with three different towers through 9:44 a.m., allegedly heading north on Interstate 15. From 5:48 p.m. to 9:32 p.m. that same day. (re trial" Boles testified that phone calls to Merritt's phone appeared to be sent directly to voicemail).

9:41am - Summer speaks to her sister in the morning, and makes plans to visit her and her newborn child.

Pomona, CA 8:28 PM CM 909-374 1 – 1 minute call to CM’s phone was registered from JM’s phone.
8:28 p.m.: Joseph calls an employee in Rancho Cucamonga and discusses work. His cell phone pings off a Fallbrook tower.

Thursday, Feb. 4 – 1pm – 3pm - per CM received a legitimate $200 handwritten check from JM. CM used that check to open a B of A account.

Summer:
2:11 pm: Summer made her last cell phone call to a homeopathic medicine company, and an employee remembered it well. It came minutes after an Internet search for the word "Anger" on the company website. (“Summer was adamant that she wanted to purchase a medication called Anger," DuGal said. "They said, 'Ma'am, it doesn't exist.'") Added - Inquiry made via homeopathic company website on home computer for 'anger' homeopathic remedy - followed up with telephone call further inquiring. 2:36 pm: Summer’s credit card is used to buy beach bags, infant pajamas and a jacket from a Ross store in Vista about a 20 minutes drive from their home. Afternoon - someone uses Summer’s card at Ross in Temecula for 4 baby onesies. (source: How the McStay case unfolded)

Thursday, Feb. 4 – Time could be 2:36pm - This is the last known face-to-face interaction Summer and kids have with friends and family.

Summer:
3:52 pm - Home computer is used to search Craigslist for children’s toys. (source: How the McStay case unfolded). There were toys found in the rear compartment of the SUV when found at the border.

Per Preliminary hearing transcripts – McGyver McCarger tries calling both Joseph and Summer to resume the painting. He continues through February 5th. All calls go to voice mail. (page 42-43)


Friday, February 5 – Silveria says Joseph McStay's friend texted him about a soccer game that had been cancelled because of possible rain, Silveria said, but McStay never responded.

From Preliminary hearing (page 84-85) – after the 3:54pm call in the Rancho Cucamonga area, no call activity until 9:17pm; so over 5 hours of no activity.

Saturday, Feb. 6, 10:46am to 1:30pm - CM cell phone pings in Victorville & Oro Grande.
(Merritt's phone pings at 10:46 a.m., Feb. 6, near the intersection of Mojave Drive and Interstate 15 near Victorville and hits on a cell tower from 11:30 to 11:52 a.m. and later at 1:30 p.m. in the same area that prosecutors said the family was buried)-added 3/2/19 from trial testimony of Boles.

On February 6, 2010, Merritt's mobile phone made ten cell phone calls from the Victorville area.
Six of the ten calls pinged on an AT&T cell phone tower closest to the location of the McStay graves near Victorville. A forensic review of the data showed Merritt's phone was located to the east of the cell tower in the same area where the bodies were buried. Merritt has a sister who lives to the west of the cell tower. She told investigators that Merritt had not been to her house since 2009. From Preliminary hearing (page 85-86) – first phone activity is at:

11:30am thru 11:52am contacts cell tower in Oro Grande, north of Victorville in the High Desert, near Interstate I5.

10:59am - The last four texts to Summer, including two messages from Dan Kavanaugh, an associate of Joseph McStay, arrived on Saturday. The final text message registered at 10:59 a.m., presumably just before the mobile phone’s battery was exhausted.

Feb. 6, 3:14pm to Feb 7, 10:35am - CM cell phone disabled.

Feb. 6 - Dan initiated a transfer of $2,000.00 from Joseph's Paypal account into his account.

Monday, February 8
– Their white Isuzu Trooper was impounded from a shopping center near the Mexican border. The car was found abandoned or towed.

February 8 – per CM: he drove to Joseph’s house because he knew something wasn’t right. “We talked many times daily on the phone and now I couldn’t get a hold of him at all for four days, so I thought I’d just drive down there.” On his way to Joseph’s house, he stopped by Joseph’s mother’s house. He asked her if she had heard from her son in the past few days. ‘On the fourth day I drove out to his house, stopping at his mother’s on the way. I asked if she’d heard from him and she said she hadn’t. She called Mikey (Joseph's brother) and I suggested he meet me out there. “She looked at her phone and realized she hadn’t heard from him since Thursday the week before, so I drove on to the house,” he said. I drove out, but Mikey didn’t call me. ‘The family’s dogs were out in the backyard, so I gave them some water and food. I opened up a shed in the back for them to go in because it was cold and wet. He didn’t go in the house but walked around back and found the dogs there. He fed the dogs with food he knew was in the storage shed and left the shed door ajar so the dogs would have cover. “It had been a rainy few days and there was no place for them to find cover but in the shed.” 'On the way back I stopped at his mother’s again and told her to get Mikey out there.

Feb. 8, 1:31pm - CM cell phone pings in Corona, CA and appears to be heading north.
Per Preliminary hearing – page 92-93; cell tower near Auto Center Drive and the 91 Freeway in Corona. Followed by a tower at
1:41pm further north up on the I5 Freeway. Then at

There is one, one incoming call that goes to voice mail, does not generate a cell tower, though. So, there's no location information. Q Why would that be? A It could have been off, airplane mode, out of range. Q And the phone came back, was it fair to say on 1:31, what was the location of the defendant's cell phone?
Q Were you able to opine a direction of travel of the defendant after that 1:31 call? A Yes, sir. He hits the tower that I previously mentioned at 1:31, followed by a tower at 1:41 that's further north up on the 15 Freeway. And then at 1:42 he hits a cell tower adjacent to the 15 Freeway in Limonite -- near the Limonite exit in Mira Loma, which would indicate a northbound travel, presumably on the 15.

February 8
2:20pm – QuickBooks activity – user added check to Charles Merritt for $6,500 (ck #4096/deposited as ck #4241) memo line: “saudi arabia final”, check backdated to 2-4-10 per Prelim hearing page 115; check was printed and deleted and deposited into CM’s BofA account on the next day Feb. 9th.
2:44pm – user canceled QuickBooks online subscription.

8:06am – user again cancelled QuickBooks online subscription per Prelim hearing page 116. Per QuickBooks online customer service rep, Ryan Baker, Per Prelim hearing page 116 & 118 - this is the day someone used CM cell phone to call Quickbooks support and ask to delete account. The caller claimed to be JM, even though the cell phone number was that of CM. Caller wanted to transfer the account to anoher account and then once it was transferred and this subscription was canceled, he need to delete all of the accounts. The call lasted 107 minutes.

(Someone ordered a copy of Joseph’s Quickbooks accounting program four days after the disappearance and before they were reported missing.)

In my opinion, the L&C coverage combined with the lack of local media interest and intelligent reporting, and no mouthpiece per se for the prosecution case, has made a trial that was already hampered with difficulties, due to long breaks, short court days and Machiavellian defence tactics, even harder to bear.

Goodness knows how the victims families cope with all the vileness that is rife on the internet, and how the jurors will cope with it once they are released from their duties. Hopefully it's just an insignificant little bubble in the greater scheme of things that only we see because we are looking for information.

I think it was in the 2/17/10 interview when Dugal and his partner (can't remember her name) asked him about it. He said he cut it on sheet metal. They asked Carmen Garcia from Metro Sheet Metal if she knew anything about it and she testified that she did not.

So what do we think this injury came from?
Was there stabbing involved?
Was it a smooth incision type wound or was is jagged?
So many questions about this now.

I think Cathy with L&C was the worst, and unfortunately she is who we had to follow for most of the trial. Her biases for the defense was obvious from the start, imo.

Once the writer started tweeting it became much fairer when tweeted....not slanted either way. Imo I would like to read the book they are writing about this case. Maybe they will be like Ann Rule (RIP), and will investigate CM closely, and his prior history including his family dynamics.

It does show how tweeting can really throw the followers off base depending on who we are following.

In the Jones mass murder case in SC where the father received the death penalty for murdering his five children, Tim Scott tweeted that one, and was one of the best tweeted cases I've seen recently.

Scott was very detailed, and tweeted often throughout each court day. You felt you were right inside of the courtroom. All court tweeters could learn a lot from him.

Unfortunately, we will never know now.

However it's rather common when someone uses a foreboding bludgeoning weapon like a sledgehammer they can have injuries themselves.

In striking the victims in a frenzy they can sustain blows themselves from miss directed or glancing blows.

It can cause gashes when splitting the skin which would look like a cut.

This one had a short handle so he knew he had to get even closer in on his victims leaving the possibility of striking or cutting himself.

He was probably holding onto them with one hand, and striking with the other to give him more control over them.

The possibilities are endless.

I think you might be thinking about Joey's phone records. Which are in a thread in the McStay forum (linked below). We have never been shown a full list of Merritt's phone records. Could try to piece it all together using about 5 or more different witnesses testimony, but even then, I think there would be gaps and info missing because they were either zoomed in or they were scrolling too fast to clearly see all the info.

I think in the beginning they said 4-5 months actually lol I remember at the time thinking that they must have a boat load of evidence and testimony to fill in all those days and all those hours, but it turns out that they just knew how badly they run their courtrooms there ;)

Agree and understand what you are saying. I can't imagine what a just punishment for someone like that is except for their removal from society. He murdered four people and two of them being the very young little boys of Joey and Summer McStay who had done nothing whatsoever to deserve such evil and cruelty inflicted upon them.
And if CM is a psychopath/sociopath he has no heart or soul as a normal human being has that are capable of feeling love and empathy toward others and would never dare do such a thing because it is not within a decent person to do that ever.
The psychopath/sociopaths in this world have no conscience and are incapable of feeling empathy and are not wired properly. And in so many cases that we follow here we see these traits many times in a criminal, and i think the best thing we can hope for is that these so called monsters become extinct for everyone else's benefit so as no one has to ever live in fear of them again.

It would be far better for society as a whole for these kind of murderers to become extinct where no longer did we see sociopaths or psychopaths murdering so many. Imo, they are the most dangerous of all.

Yet, it seems instead of becoming extinct we are seeing more in our criminal justice system nowadays.

There seems to be an uptick instead. While our overall homicide rate has declined in the past 6 years what seems to have escalated is the violent methods many murderers are doing many of their murders now.

Over the top brutal overkills are being inflicted on many victims which are way beyond what it took to end the victim's life.

It's even happening when the murderer was/is a complete stranger to all of their victims.

Where does all of this rage, and hate come from.. even against victims they didn't know... where they now not only murder them, but many do rapes, and do prolonged barbaric tortures to those they have never known?

The only answer that makes any sense to me is our society seems to have more psychopaths or sociopaths in it instead of less...for only they are capable of doing such macabre barbaric violence.

So instead of them becoming less in our society it seems they are becoming far more pronounced.

I started noticing this change from watching ID, and OWN since the day of their inception. Through the years the way many victims are murdered has changed, and what all they had to endure before finally being murdered.

Now more than ever it seems killers are inflicting such horrors against the victims BEFORE finally taking their lives as if that is just as important to the murderer as the kills themselves.

Now the vast majority of killers dont ever exhibit one ounce of remorse or regret not even if they killed family members who did nothing, but love, and support them.

It's become extremely rare to see any of them show any regret or remorse no matter who they kill. It shows more are souless individuals without any conscience.

They not only don't feel any thing for the victims they viciously murdered, but seem to have felt entitled to do what they did.

Imo, and they will continue to do against other countless other victims to come.

It would be far better for society as a whole for these kind of murderers to become extinct where no longer did we see sociopaths or psychopaths murdering so many. Imo, they are the most dangerous of all.

Yet, it seems instead of becoming extinct we are seeing more in our criminal justice system nowadays.

There seems to be an uptick instead. While our overall homicide rate has declined in the past 6 years what seems to have escalated is the violent methods many murderers are doing many of their murders now.

Over the top brutal overkills are being inflicted on many victims which are way beyond what it took to end the victim's life.

It's even happening when the murderer was/is a complete stranger to all of their victims.

Where does all of this rage, and hate come from.. even against victims they didn't know... where they now not only murder them, but many do rapes, and do prolonged barbaric tortures to those they have never known?

The only answer that makes any sense to me is our society seems to have more psychopaths or sociopaths in it instead of less...for only they are capable of doing such macabre barbaric violence.

So instead of them becoming less in our society it seems they are becoming far more pronounced.

I started noticing this change from watching ID, and OWN since the day of their inception. Through the years the way many victims are murdered has changed, and what all they had to endure before finally being murdered.

Now more than ever it seems killers are inflicting such horrors against the victims BEFORE finally taking their lives as if that is just as important to the murderer as the kills themselves.

Now the vast majority of killers dont ever exhibit one ounce of remorse or regret not even if they killed family members who did nothing, but love, and support them.

It's become extremely rare to see any of them show any regret or remorse no matter who they kill. It shows more are souless individuals without any conscience.

They not only don't feel any thing for the victims they viciously murdered, but seem to have felt entitled to do what they did.

Imo, and they will continue to do against other countless other victims to come.

Hi ocean and thanks and i agree with everything you have said. I read around on the internet and definitely the world is a much more hateful place nowadays it would seem, and can't figure out what changed through the years? Is it because more is revealed now through social media platforms etc. and all the information is at our fingertips instantly. In other words has it always been like this but we just weren't aware of it before? I think if there is one thing about this world i know for sure it's that we always have seen the good vs evil play itself out through the different eras since mankind walked on this earth . They even create entertainment for us with this same plot with good vs bad.
Maybe there have been different ages throughout time where everyone was peaceful but it doesn't last. I think i read a long time ago about a Golden age and it was beautiful, but i think the earth is now going through a very dark time and for a lot of people it's very difficult to be here, and that's very sad IMO. But i guess the people that love will continue to love and the haters will continue to hate, so that seems to be always what we are up against. And in reality we are only here for a short time because this life is only temporary and not permanent anyway.

I agree OBE. I also think our judicial system plays a big part as well, at least in California. The punishments now are not at all like they once were when people were actually afraid to break the law for fear of serious consequences. Ask most law enforcement in Southern California and they'll tell you that people are being released from jail before LE has had a chance to complete their paperwork. It seems like criminals have many more rights than their victims and the criminals know it.

On February 6, 2010, Merritt's mobile phone made ten cell phone calls from the Victorville area.
Six of the ten calls pinged on an AT&T cell phone tower closest to the location of the McStay graves near Victorville. A forensic review of the data showed Merritt's phone was located to the east of the cell tower in the same area where the bodies were buried. Merritt has a sister who lives to the west of the cell tower. She told investigators that Merritt had not been to her house since 2009. – Their white Isuzu Trooper was impounded from a shopping center near the Mexican border. The car was found abandoned or towed.

February 8 – per CM: he drove to Joseph’s house because he knew something wasn’t right. “We talked many times daily on the phone and now I couldn’t get a hold of him at all for four days, so I thought I’d just drive down there.” On his way to Joseph’s house, he stopped by Joseph’s mother’s house. He asked her if she had heard from her son in the past few days. ‘On the fourth day I drove out to his house, stopping at his mother’s on the way. I asked if she’d heard from him and she said she hadn’t. She called Mikey (Joseph's brother) and I suggested he meet me out there. “She looked at her phone and realized she hadn’t heard from him since Thursday the week before, so I drove on to the house,” he said. I drove out, but Mikey didn’t call me. ‘The family’s dogs were out in the backyard, so I gave them some water and food. I opened up a shed in the back for them to go in because it was cold and wet. He didn’t go in the house but walked around back and found the dogs there. He fed the dogs with food he knew was in the storage shed and left the shed door ajar so the dogs would have cover. “It had been a rainy few days and there was no place for them to find cover but in the shed.” 'On the way back I stopped at his mother’s again and told her to get Mikey out there.

There is one, one incoming call that goes to voice mail, does not generate a cell tower, though. So, there's no location information. Q Why would that be? A It could have been off, airplane mode, out of range. Q And the phone came back, was it fair to say on 1:31, what was the location of the defendant's cell phone?
Q Were you able to opine a direction of travel of the defendant after that 1:31 call? A Yes, sir. He hits the tower that I previously mentioned at 1:31, followed by a tower at 1:41 that's further north up on the 15 Freeway. And then at 1:42 he hits a cell tower adjacent to the 15 Freeway in Limonite -- near the Limonite exit in Mira Loma, which would indicate a northbound travel, presumably on the 15.

February 8

8:06am – user again cancelled QuickBooks online subscription per Prelim hearing page 116. Per QuickBooks online customer service rep, Ryan Baker, Per Prelim hearing page 116 & 118 - this is the day someone used CM cell phone to call Quickbooks support and ask to delete account. The caller claimed to be JM, even though the cell phone number was that of CM. Caller wanted to transfer the account to anoher account and then once it was transferred and this subscription was canceled, he need to delete all of the accounts. The call lasted 107 minutes.

(Someone ordered a copy of Joseph’s Quickbooks accounting program four days after the disappearance and before they were reported missing.)

True. Somehow respect for the rule of law, and respect for authority in general has been lost. In fact I think respect has been lost for most now by many.

We are seeing this play out more, and more in our school system as well against our teachers.

Imo, Another contributing factor is we see so many who never take blame or are held accountable for any of their own wrongdoings.

Now more, and more it seems no matter what someone does wrong it's always someone else's fault, and they are never to blame in their eyes. Imo.

Also so many young people are never being told 'no' even when its warranted, and badly needed.

We have seen the tragic results when teens were finally told the forbidden word 'no' that ended with them murdering parents, siblings, or both.

There are so many reasons why we seem to be living in such dark times now.

It's a shame we are the nation who has such illegal demands for drug useage.

The illegal drug supplier will always go where the most demands are, and sadly its America.

That is the very reason so much fentanyl is coming across our southern border now. Thank goodness our officers have found, and stopped enough fentanyl to overdose every person in all states, but much more is still coming across the southern border because there isn't enough manpower to stop it all, and drugs are killing 70k a year.

Yet so many don't seem to care or even find ways to prevent any of it from happening.

Monday, June 24th:
*Penalty Phase Trial (Day 6)-Jury Deliberating (@ 9:30am PT) - CA - McStay Family: Joseph (40), Summer (43), Gianni (4) & Joey Jr (3) (Feb. 4, 2010, Fallbrook; found Nov. 11, 2013) - *Charles "Chase" Ray Merritt aka Charles Ray Mandel aka Charles Ray Morritt aka Chase Meredith aka Chase Jarvis (57/now 62) arrested (11/5/14) & indicted (11/7/14) of 4 counts of murder with special circumstance. Plead not guilty. Held without bond. DP case.
Trial started 1/7/19. Dark on all Fridays. Jurors started with 8 women & 4 men; now have 9 women & 3 men (alternates started with 4 men & 2 women-alternates left 1 men & 1 woman). Took about 22 hours of deliberations for guilty verdict on all 4 counts of 1st degree murder with special circumstance.

6/18/19 Day 2: Afternoon session only. State witness: Kenneth Aranda from Hawaii via Skype (Summer's brother). Done for the day. Prosecution wants testimony from Summer's Sister, Tracy Russell, who is currently on vacation in Greece via Skype tomorrow. If not, the pros will rest in the penalty phase. Penalty phase continues on 6/19.
6/19/19 Day 3: Tracy Russell (Summer's sister via Skype from Greece). Prosecution rests. Defense calls no witnesses. Defense rests. Judge Smith gave jury instructions. Closing arguments were given by Prosecutors. Judge has to leave at 3:30pm, so Defense will begin closing tomorrow, 6/20.
6/20/19 Day 4: Defense attorney Maline gives closing arguments. Judge Smith read closing instructions to the jury. Jurors began deliberations for penalty phase of the murder trial at 11:50am PDT. Again it is stipulated jurors may select their own schedule. Jurors are instructed the verdict must be unanimous. Jurors deliberated to about 4pm (with 1 ½ hour for lunch). Deliberated for about 2½ hours. Jury deliberations continue on 6/21 at 8:30am to 10:30am (because of an appointment).
6/21/19 Day 5: Jurors started deliberations about 8:36am & went home about 10am (~ 1 ½ hrs). Back on Monday 6/24 at 9:30am.
Schedule for Penalty Phase-Week of June 24 thru 28th: Jury deliberations-6/24, Monday; Jury deliberations-6/25, Tuesday; Jury deliberations-6/26, Wednesday, and on….
Jurors have deliberated: 6/20: 11:50am to 4pm (with 1½ hr lunch) = ~2½ hrs; 6/21: 8:36am to 10am = 1½ hrs. Total ~4 hours last week.

I think you might be thinking about Joey's phone records. Which are in a thread in the McStay forum (linked below). We have never been shown a full list of Merritt's phone records. Could try to piece it all together using about 5 or more different witnesses testimony, but even then, I think there would be gaps and info missing because they were either zoomed in or they were scrolling too fast to clearly see all the info.

It was Niners stuff I was thinking of. Tortoise then also helped me with some Chase call info when I was looking at the dogs in the period 5-12 Feb

So I just assumed they had detailed exhibits of it.
