His attorney in his press release said Filler was mortified, and would have reacted differently if he had known she was a child. Not that it was unacceptable altogether, but had he evaluated this to be someone else's child he wouldn't have beaten her. If she was 19, 44, or 90 maybe? If it was a grown man that could have defended himself, yeah I am sure he would have reacted differently.
I don't think unless you are very predisposed to violence you punch anyone in the face. Repeatedly. And if you are a man you are probably less likely to punch a woman in the face. Repeatedly. And if you are an adult man who has not already lowered your inhibitions to violence you don't punch a fourteen year old in the face. Repeatedly. Until someone intervenes.
A parent that thinks their child is seriously hurt attends to their child's medical needs.
There are many highly educated, highly structured, respectful members of society that are control freaks in every aspect of their lives. And some of them are reknowned egomaniacs.
I am not buying this attorneys sales pitch and he should rethink it.
Rage filled parent, okay, I get that.
It was an accident first of all.
He didn't grab and shake her.
He didn't scream at her to watch out (for an accident that resulted from her avoiding a fallen skier).
He didn't throw her to the ground.
He didn't attend to his child.
He wasn't protecting his child from an ongoing threat.
He was mad and his response to his anger (not protective over-reaction) was to closed fist punched a fourteen year old girl in the face.
Repeatedly.
Until someone intervened to stop him.
Don't get me wrong, if he encountered anyone of any age attacking his child I probably be completely on his side even if in the aftermath people wanted to dissect what was acceptable and what was overkill to stop said threat. That is primal, that is adrenaline, that is judging split second reactions and decisions. This was a skiing accident. Someone swerved around a fallen skiier. It wasn't a group of reckless drunken teens with no regard for those around them.
And last on my rant, Misdemeanor child abuse?
If this wasn't an esteemed doctor with a high price defense attorney and was instead your run of the mill Joe Blow with a public defender do you think this would be a misdemeanor charge? How in the world is this not a felony charge, at least as a starting point, on the part of the prosecutor.
And the victim is visiting from Mexico, want to take bets on whether the witness is available when trial rolls around? That will either be convenient or cost effective for the esteemed gentleman..... or let me guess, deferred sentencing while we go to rehab and the criminal record gets erased? Not sure which one I would bet on. Probably the witness not being able or willing to testify. But rehab, that is a close runner up.
