Human remains located on Sept. 22 during an unrelated search in the town of Moffat in Saguache County were positively identified as Suzanne Morphew on Wednesday, the Colorado Bureau of Investigation said.

"Specific information about the location and the state of the remains are being withheld at this time," the agency said.

Melinda Moorman Balzer, Morphew's older sister, told The Denver Gazette that Chaffee County Sheriff John Spezze let her know Wednesday morning that Morphew's remains had been found.

"This is a miracle. It’s like looking for a needle in a haystack," Moorman Balzer said. "Colorado is a vast and rugged place and we have prayed that God would put light on where she is. We have been praying and here we are today. It’s day of great sadness but a day of celebration."

In February 2022, Barry's defense team filed a motion to dismiss the first-degree murder case against him, noting that an investigator had recently called the arrest "premature." They asked the judge to dismiss the case because of “prosecutorial discovery violations.”

On April 19, 2022, a Fremont County judge granted the prosecution's motion to dismiss the murder case against Barry. The motion asked the court to dismiss the charges without prejudice, meaning he could be tried again if prosecutors refile charges.

Family notifications have been made following the formal identification of Morphew.

Lauren Scharf, former Fox21 reporter who had covered the case, said, “Definitely this was an answered prayer for the family. I was just overwhelmed by emotion when I found out.”

Suzanne’s family informed Scharf of the news, she said, but said they don’t wish to comment on the record until there is more information.

Tisha Leewaye of Salida, an instrumental organizer of searches for Suzanne, said, “It is great news and sad news, I guess. Great in that the family can find peace, but sad obviously because we all know now that she’s gone. I hope now we can finally find full justice for her and find answers to what happened to her.”

No arrests have been made since the remains were located. Updates will be provided as information becomes available during this ongoing investigation.

“While this case has garnered attention from around the world, it has touched our community and the sheriff’s office deeply,” said Chaffee County Sheriff John Spezze. “We have never stopped our investigation and will continue to follow all leads in pursuit of justice for Suzanne.”

The remains were located in the 12th Judicial District, and District Attorney Anne Kelly has been notified.

Perrin was called to the scene to collect the remains on Friday, and transported them to El Paso County for an autopsy. Wednesday, they were positively identified as Morphew's.

Morphew's remains were found in Saguache County during an unrelated search, CBI said. Sources close to the investigation told The Denver Gazette that her body was found 30-40 minutes from the Morphew home, but would not elaborate further.
