An investigator and an attorney who left the 11th Judicial District's prosecution team that tried to prosecute the Barry Morphew case said they grew frustrated with a case that was floating along without leadership, even up to the final days before a scheduled murder trial that never happened.

"It was pretty darn bad," said former investigator Alex Walker.

"Who was in charge of the trial?" asked Office of Attorney Regulation Counsel panel member Byron Large.


"I have no idea," responded Walker.

The exchange happened on Monday, part of a disciplinary hearing, in which 11th Judicial District Attorney Linda Stanley could get disbarred, publicly or privately censured, or acquitted. She is accused of professional misconduct associated with the Morphew case. Complaints filed against her claim she spoke. too freely with the media, specifically YouTubers, had "continual discovery violations and was a poor leader."

In an email, Edwards wrote "We need to get this filed tonight. I’m a little embarrassed by what we might be filing." He left the case ten days later. Deputy DA Mark Hurlbert on stand as we break for lunch in Linda Stanley's disciplinary hearing.


Hurlbert is still on the stand. Attorneys are trying to get to the bottom of why the prosecution team wanted to investigate Morphew judge Ramsey Lama for bias. Hurlbert said "were so off the mark it felt like he was biased against the prosecution’s case." Lama's ruling to



disallow domestic violence testimony was a major blow to the case. It was the investigation's theory that #SuzanneMorphew was a victim of domestic violence. She wrote about it and #BarryMorphew admitted to it.


Interesting nuggets revealed from attorneys and investigators who were not allowed to speak of the case publicly. Hurlbert admits that the #Suzannemorphew murder is "in much better shape" now that her body has been found. "We thought she was deep in a mine. We were wrong.”

-During an almost full day of testimony, 11th Judicial District Deputy District Attorney Mark Hurlbert told a different story. He said that in 30 years of practicing law, he had never been treated as poorly as he was by then-Judge Lama. “It was so far beyond the pale that I’ve never seen before,” said Hurlbert.

Lama disallowed domestic violence testimony in the Morphew case, which hinged on domestic abuse as the cornerstone of motive into Suzanne Morphew’s death. It was a ruling that perplexed and frustrated the prosecution team. Lama’s rulings "were so off the mark, it felt like he was biased against the prosecution’s case,” Hurlbert testified.

-The four-year-old case is no longer being prosecuted by Stanley's 11th Judicial District. It is now being investigated by the Colorado Bureau of Investigation and the prosecution work is now in the 12th Judicial District of the San Luis Valley, where Morphew's remains were found.

Hurlbert testified that because of the discovery, the case is "in much better shape" now.

Stanley's attorney Steve Jensen explained that she understood that she was off-the-record when she made the comments, but reporters said that she had a microphone on and should have known she was being recorded.

The order granting the motion to dismiss was filed by Fremont County District Court Judge Kaitlin Turner. Turner has been present listening to testimony in the gallery of the courtroom but is not scheduled to testify at Stanley's hearing.

In addition to the Fremont County case, Suthers was also asked about extra-judicial statements made by Stanley as lead prosecutor in Barry Morphew's murder case: First when he was arrested on May 5, 2021, and then on a national podcast after the evidentiary hearing.

Suthers said that he is being paid $250 dollars an hour with a cap of $5,000 to testify.

Also testifying Friday was Stan Garnett, former Boulder District Attorney, and Grant Grosgebauer, a prosecutor who was borrowed from the 18th Judicial District to help in the month leading up to the oncoming trial. He described those last tumultuous weeks as “a snowball that kept rolling down the hill.”

Grosgebauer said that Morphew's attorney, Iris Eytan, whom he described as "fierce," made prosecutors' lives difficult in the month-and-a-half before trial by filing motions which he felt were stretching a prosecution team which was outmanned.

“The defense had three full-time lawyers and six paralegals, plus investigators. They were filing every motion they could file but they were hammering the case” said Grosgebauer.

Grosgebauer, who got out of the prosecution business partly he said because of how difficult it has become to do that kind of work, is now a defense attorney in private practice. He told a three-person panel overseeing the hearing that it felt like former 11th Judicial District Judge Ramsey Lama treated the prosecution and the defense differently, particularly when he struck 13 of 16 district attorney witnesses as sanctions on the eve of trial, because the prosecution had engaged in “consistent” discovery violations, missing "already extended deadlines" for data involving the witnesses.

Grosgebauer countered that this was not true, and that Lama’s ruling was "really quick," based on the word of the defense, which was filing motions, he felt, for the sake of keeping the prosecution on its heels.

Former Colorado U.S. Attorney and Colo Attorney General John Suthers is now on the stand as an expert in prosecutorial ethics. He said he was hired to look at complaint and allegations made against DA Stanley. This should be interesting.


Suthers’ testimony does not help Stanley’s case. He says that her comments to a reporter about a baby’s alleged murder in Fremont Co were the worst he’s ever seen. The court is now listening to the 14 min press conf after #morphew’s arrest May 5. 2021.


Stanley will have her chance to answer to scathing comments made during the hearing on Monday. She has sat quietly working on her computer.

Embattled 11th Judicial District Attorney Linda Stanley took the stand yesterday to testify in her own defense during a professional disciplinary hearing in Denver. State regulators have accused Stanley of violating seven rules of professional conduct for attorneys, putting her at risk of losing her license to practice law.

The disciplinary hearing is being overseen by a three-member board, including a judge and two board members. DENVER — A disciplinary complaint filed Monday alleges 11th Judicial District Attorney Linda Stanley violated the state's professional code of conduct for attorneys during the initial prosecution of Barry Morphew.

In the 20-page complaint filed Monday, the Office of Attorney Regulation Counsel alleges Stanley interacted with Mike King, who hosts a YouTube channel devoted to true crime, from April 2021 to August 2022.

During a May 2021 press conference announcing the arrest of Barry, Stanley told the media gathered at the Chaffee County Courthouse, "I am sure you are all aware and know that we can not talk about any open or active investigation, and that is per the rules of professional conduct that we will abide by."

The Office of Attorney Regulation Counsel also alleges Stanley conducted a domestic violence investigation into Judge Lama following unfavorable rulings.

Barry’s attorney, Iris Eytan, filed a complaint in March 2023 with the Office of Attorney Regulation Counsel asking for discipline for Stanley and the other prosecutors. The 83-page request for investigation states that judges overseeing identified violations of court orders and discovery rules, including "providing false information to the court."

The Office of Attorney Regulation Counsel alleged similar conduct, including withholding evidence from the defense and a perceived failure to send discovery to the defense team in a timely manner.
