Even after FD was believed to be cleaning his tacoma, he had told MT that PG intended to sell the vehicle and told PG to find a replacement - also told him to replace the car seats - PG was combing junk yards looking for seats
FD told PG not to refer to the seats except as 'hardware'
Then you saw pic and took Porsche seats and put into his vehicle in a haphazard way - driving Tacoma with seats held up with buckets
All these red flags - FD was worried about possible DNA of JF in PG truck - PG did all this even with full immunity
Still insisted that he didn't believe FD would harm JF - he knew more than MT and PG still did what FD wanted

All I can say is HORN IS BAD LUCK.

I do have to say that hearing Horn Horning on the issue of MT mistreatment at the hands of LE really is quite stunning but my guess is that Troconis Crew will fund the Defence via some nonsense litigation against CSP to simply drive Det Kimball to flee himself to Outer Mongolia for some peace in retirement.

Re: Petu's testimony about being unable to speak to MT for awhile because she was going through Customs...I don't believe US Citizens or Non US Citizens need to go through Customs when leaving the US. This occurred to me live when she said it, but only got around confirming today. Probably nothing, but odd. JMO

FD put up facade until his last dying breath and he died without ever ack his actions or even admitting his role to his own children and never gave answers, he can't be held to answer - everyone wants closure

Most of this trial has been about FD in absentia - you have heard about fingerprints, blood, DNA etc.
You also remember biologist - KM and the presumptive tests only suggest the possibility of presence of blood - place to swab
Suggestion of Prosecutor of blood and DNA on the faucet and we are to assume FD was in the house and if you recall there was a mixture of the DNA of FD and JF
Only place in house where it was - Why was his DNA there? Only reason was cake and chocolate she took from him
JF took cake and chocolate from him
Children all touched him and touched his hair and it stayed there when children washed their hands in the kitchen sink
Small amt of DNA was there and it just stays there

PG said that JF had been in his truck
Underside of sponge rubber seat was where her DNA was found - someone had sat on that seat

Absence of evidence is not evidence - can't infer facts in a vacuum - 0x0=0
How much blood would have been in the Tacoma if it hadn't been brought to car wash
How much blood would there be iif FD hadn't taken out the car mat that had never been found
Why was nothing found in the Cherokee that maybe MT was driving and not PG
Nothing in the Cherokee - there was nothing to find in the Cherokee because there was nothing to find in the Cherokee
What might have been discovered at 80MS if FD and MT hadn't done a little bit of clean up and where we have proven that the showing happened the next day

Lets speculate about a smoke coming out fireplace and chimney
You were shown videos - 2 are within minutes of each other - motion activated camera - to suggest only 2 times is misleading in many ways - unreasonable

LE continued to investigate and went to Albany Ave and got the C4 footage which showed him and not MT putting garbage in black bags in 3 receptacle (not 6 and not 30) - showed FD putting black bags in receptacles
Now, State asking you to evaluate in hindsight she must have known what was in the bags and FD told her they were going to Starbucks but FD went beyond this 1.5 miles - I have to get rid of a few bags - MT told LE that FD had done this before

Spec houses - rent another dumpster come right off the bottom line - how many builders dump that way to save money
Friday am is garbage day in Farmington

What do we know now that we didn't know then
We know that JF missed her appt with Dr Roy Geronomous in NYC in am
We know that she was supposed to go to NY and children and babysitter had already gone to NY

The call came into NCPD at 7pm that JF was missing
went to house
noticed something that looked like blood and that was when investigation started - multiple agencies participate
They went through every point and garage at 69 welles
Found signs of violence
At 8pm found suburban in Waveny
Had not been seen since 1030 am
Not seen Suburban on the school cams - where was it
Police learned about FD from JF friends - he was manipulative
Volatile years long custody battle

MT was in Raptor on Albany and Police knew what was inside them - Michelle didn't know
They found nothing at 80MS - there was a coffee cup
that was in recycling bin in garage - nothing of evidentiary value but they didn't take the cup - couldn't this coffee cup explain what FD was telling MT that he was cleaning up spilled coffee in the Tacoma
That doesn't fit prosecutions narrative so they didn't even collect that as evidence
So MT handcuffed taken to NC 80 miles away and she was kicked out of her house

Police accused FD of something that MT found impossible to believe and they accused her of helping him without proof. She was tired middle of night and cold and had blanket to keep her warm
MT was told she didn't know real FD and he used her and she needed to tell them where JF was - they lied to her, scared her and told her they would lose her daughter and family - told her about murder charges
Kept saying she didn't know
They didn't let up
No evidence who had travelled the world and who wanted to be a mother to 5 additional children that had just lost their mother
She had her own family - large
Good relationship with her daughter - on phone with mother, sisters all while helping dispose of evidence from murder
MT was not trying to replace JF - she liked these children - that is a far cry from wanting to replace JF
Toxic custody - she thought things were working out in her favor

Okay so I cornered my son to get an outsider’s opinion as he knows nothing about the case.

He is 14.

To be completely fair I shared both sides so I could really truly get a sense of what a juror may think.

I shared everything. I mean everything!

I shared all details of the case we have been following for almost 5 years and what the defense said and p. About everything for both sides as I really want an honest opinion. I explained how she has a young daughter …. I wanted him to be unbiased.

These are his responses:

“If you are innocent, and telling the truth your story wouldn’t change.”

“No way would the guy leave his phone all day… he’d get down the road and return for it.”

“No way would he give his pw.” “If his phone was there by accident, no way would she answer it.” “Why would she?”

“No way would she (Michelle) make that many trips to 80 ms. Did she make that many trips any other day?”

“No way would she clean the house, she’d use the cleaning people.”

“She wouldn’t have a fire if she was cold in May…she’d just turn up the heat. Too much effort to build a fire in the daytime.”

“She wouldn’t drive that far for Starbucks.”

“If she were innocent, she’d turn him in as she’d add up all of these weird things and would want to be safe for her daughter’s sake!”

Guys - still not done with closing, but I did get more rose.

I am getting close to the end; my impression is the defense is stress-testing each piece of evidence, out of context, causing a scrambled egg effect. I am putting all the eggs in the easel-person’s basket.

I rearranged the D closing arguments into categories.

Discredit the Forensics

Defense sticks to the cake and the bunny touch-transfer. But, the State’s testimony is that LE observed blood like, not cake like substance, on the faucet from which FD’s DNA was developed.

LE didn’t pursue the phone connection from a cell number associated with Jennifer to the Suburban at 2:56 pm. Defense purportedly isn’t suggesting Jennifer got on the gone girl train (that would reflect badly on MT), but Jennifer was probably dead at the hands of -somebodies - that aren’t MT; and LE’s failure to follow the phone lead means LE prejudged who the suspects were to the exclusion of the real conspirators.

Defense says there is no evidence that the cleaning at 80 M was related to a murder, or that MT could have known she was cleaning up a murder. Well - this requires the jury to ignore phone manipulation and the car circus and fires for starters. Defense also says “no evidence is not evidence.” That doesn’t hold true when you destroy evidence by cleaning a car and a house and burning which causes the lack of evidence.

The jury needs to get these details on the easel.

“She didn’t know” refrain on repeat

How was MT to know, without x-ray vision, that black opaque bags, similar to the ones she brought, contained murder trash. First of all, the defense calls out the State for using hindsight about what we now know was in the bags; according to the D, it’s misleading to use hindsight to inform ourselves of what MT knew. So, the defense can use hindsight but the State can’t. I call GARBAGE. This is a defense credibility issue IMO.

Apparently, it is common knowledge, that a builder only gets one dumpster per build; and, the cost of the dumpster comes off your bottom line; so, obviously, builders routinely need to find other trash receptacles and gutters once they close the books on a house. In light of the fact that we have evidence of murder trash being generated on the day of a murder, and no evidence of construction trash, this ridiculous supposition IMO is a red herring.

It’s a whodunit

This is a continuation of the D’s theme that the State didn’t prove a key element of the conspiracy, who killed Jennifer? There is reasonable doubt as to who actually killed her as between FD and his “compatriots” or other suspects including PG and KM, but not MT who was at 4JC. Defense does not mention the phone.

The guy on the bike is an identifiable. PG was in NC that day and unaccounted for, for a period of time. PG purchased gas consistent with driving between 4JC and NC. KM could be involved but the State didn’t give you that evidence. And finally Jennifer’s friends pointed to FD and not MT.

Credibility bait and switch

This one really burns me up.

Regarding the judge’s instruction about credibility, in the judge’s opinion, the crux of the case, is defendant’s credibility. The D says the credibility instruction was included for the purpose of helping the jury decide whether PG’s testimony was credible because he took the immunity deal. Yikes ! What a gross misrepresentation.

Defense says that the seat switching story came out after he got immunity; and that FD probably made the “bury her with the dog” comment to PG but either misremembered who said it and accidentally on purpose said it was MT to make his immunity deal more valuable. Whaaaaaaaaaat????

Knowledge and planning

PG and FD took the Tacoma to 80 MS before the dinner party and unbeknownst to MT. FD set up the Greek alibi call when he went to get steak, by himself, for the dinner party.

This is a decent point but isn’t it equally inferable that FDA and MT talked in secret about the phone alibi but we just don’t have video evidence of it.

All I can say is HORN IS BAD LUCK.

My iPad has frozen and I'm trying to reset it but it won't recover and the battery is fine. On phone now but that is too painful to finish the longer post.

Re: Petu's testimony about being unable to speak to MT for awhile because she was going through Customs...I don't believe US Citizens or Non US Citizens need to go through Customs when leaving the US. This occurred to me live when she said it, but only got around confirming today. Probably nothing, but odd. JMO

The entire Petu travel story between the driver having to add oil to his car to showing up for intl flight at Logan with 1.5 hrs to spare simply to me made zero sense.

I agree with you about no customs in US as it would happen at other end even with Argentinan passport. Perhaps she meant security? But it should have been clear if they were speaking in spanish as they always claimed which is another haha!

Others here said Logan makes sense for intl flights but I checked Hartford and they had options priced competitively with logan and its only 14 miles away vs over 100.

What I did find interesting is that Petu fills in with useless info in her narrative the same way MT does. Very odd.

I also wonder on what basis Petu is in US or does she have to leave periodically?

What is curious also is that citizens of Argentina need to have a Visa to be in the US and ditto for US citizens going to Argentina it appears.

No relation between any of the closing stmt segments that I could see. He just bounces from topic to topic. Overall claim is MT knows nothing. Had no reason to help FD as in her view 'all was well' and she was 'happy' and amicable divorce and custody was being resolved and due to the discredited report she would soon be mother of 6 children as JF was missing. This is supported by the testimony of the 'two professionals' GAL Meehan and Atty Rose. Atty Rose, said he saw the light at the end of the tunnel for MT. I can understand why Atty McGinnis was so angry about PG as was a target in the Closing Stmt from the Defence. But, what I found particularly distasteful were the references to iirc non citizen which was misleading at PG had his Green Card/Permanent Resident Card. Its not like the border jumper from Venezuela who just murdered the college female in GA!

Reality:

All these red flags - FD was worried about possible DNA of JF in PG truck - PG did all this even with full immunity
Still insisted that he didn't believe FD would harm JF - he knew more than MT and PG still did what FD wanted

How much blood would there be iif FD hadn't taken out the car mat that had never been found
Why was nothing found in the Cherokee that maybe MT was driving and not PG
Nothing in the Cherokee - there was nothing to find in the Cherokee because there was nothing to find in the Cherokee
What might have been discovered at 80MS if FD and MT hadn't done a little bit of clean up and where we have proven that the showing happened the next day

Lets speculate about a smoke coming out fireplace and chimney
You were shown videos - 2 are within minutes of each other - motion activated camera - to suggest only 2 times is misleading in many ways - unreasonable

LE continued to investigate and went to Albany Ave and got the C4 footage which showed him and not MT putting garbage in black bags in 3 receptacle (not 6 and not 30) - showed FD putting black bags in receptacles
Now, State asking you to evaluate in hindsight she must have known what was in the bags and FD told her they were going to Starbucks but FD went beyond this 1.5 miles - I have to get rid of a few bags - MT told LE that FD had done this before

Spec houses - rent another dumpster come right off the bottom line - how many builders dump that way to save money
Friday am is garbage day in Farmington

What do we know now that we didn't know then
We know that JF missed her appt with Dr Roy Geronomous in NYC in am
We know that she was supposed to go to NY and children and babysitter had already gone to NY

The call came into NCPD at 7pm that JF was missing
went to house
noticed something that looked like blood and that was when investigation started - multiple agencies participate
They went through every point and garage at 69 welles
Found signs of violence
At 8pm found suburban in Waveny
Had not been seen since 1030 am
Not seen Suburban on the school cams - where was it
Police learned about FD from JF friends - he was manipulative
Volatile years long custody battle

MT was in Raptor on Albany and Police knew what was inside them - Michelle didn't know
They found nothing at 80MS - there was a coffee cup
that was in recycling bin in garage - nothing of evidentiary value but they didn't take the cup - couldn't this coffee cup explain what FD was telling MT that he was cleaning up spilled coffee in the Tacoma
That doesn't fit prosecutions narrative so they didn't even collect that as evidence
So MT handcuffed taken to NC 80 miles away and she was kicked out of her house

Police accused FD of something that MT found impossible to believe and they accused her of helping him without proof. She was tired middle of night and cold and had blanket to keep her warm
MT was told she didn't know real FD and he used her and she needed to tell them where JF was - they lied to her, scared her and told her they would lose her daughter and family - told her about murder charges
Kept saying she didn't know
They didn't let up
No evidence who had travelled the world and who wanted to be a mother to 5 additional children that had just lost their mother
She had her own family - large
Good relationship with her daughter - on phone with mother, sisters all while helping dispose of evidence from murder
MT was not trying to replace JF - she liked these children - that is a far cry from wanting to replace JF
Toxic custody - she thought things were working out in her favor

I've been saying from the beginning that Troconis camp has taken advantage of the United States being the only country that still applies the felony murder rule and instead of learning the true charges against MT (i.e., MT conspired with FD to kill Jennifer, and then helped him dispose of evidence and hinder investigators), they have garnered support for MT by spreading false claim MT is being charged with murder. IMO, the defense witness Petu fell victim to this claim, and the idea she could prove MT's innocence is based on her belief that MT was not present at the murder scene. Except this has never been alleged! In other words, who cares if MT was at Petu's store while FD was murdering Jennifer. MT's part in the conspiracy was already done! JMO

It was mentioned if found guilty, MT still might not be immediately remanded to jail. How would this be the case? If guilty, wouldn’t a person sit in jail and wait for appeal? For example in Iskander case, defendant was found guilty on all charges, cuffed and brought right to prison to await sentencing. I guess I don’t understand why anyone found guilty would not be remanded to prison immediately especially due ti the charges relating to a murder.

Upon conviction, in CT it seems the defendant goes into the 'mini jail'/holding pen in the basement of the Courthouse and awaits information on status of their bond/bail. I think she has a $1.5 million bond now supposedly secured by family real estate. Depending on which charges she is convicted of, the bond might go up or down. Supposedly once the bond is resolved she is released and the sentencing questionnaire is completed and once this is done there is a sentencing hearing based on the convicted charges. I have no idea of the timing of any of this as it seems the Courts are quite backed up.

IDK if Judge can revoke bond entirely and send her to jail pending completion of the sentencing questionnaire? I also don't know if Judge can require bracelet be returned either? I hope Atty Hussey readdresses these comments this week as honestly his commentary last week explaining all this left me a confused.

Jury Selection began on 10/4/23 & ended 10/26/23. Another jury selection after dismissed jurors on 1/10/24. Now 6 jurors & 2 alternates. (3 men & 3 women on jury/total: 4 women & 4 men). Jury started deliberations on 2/28/24. Day1-Time: ~5 hours. Total deliberations: ~5 hours.
Trial began on 1/11/24. State rested their case on 2/21/24. Defense started their case on 2/21/24 & ended on 2/23/24. Closing arguments set for 2/27/24.

2/28/24 Wednesday Trial Day 30/Verdict Watch Day 1: Judge says the jury will check in every morning with the court prior to deliberating. They will also check in after lunch every afternoon but not again at end of day. Jury started deliberations at 10am. They asked to hear playback of testimony from Troconis’s friend, Clara Duperron around 12:15pm. Deliberations on Tuesday lasted about 5 hours & 40 minutes before the jury wrapped up for the day, with 40 minutes deducted for read back of witness.
Trial continues on Thursday, 2/29/24 as jury continues deliberates.
