It’s hard for me to tell what JS’ agenda is here.JS turns over a sweatshirt with a hair on it with PG’s dna on it, thru another lawyer, to the investigators. Then he refuses to say where it came from. Claims he may use the sweatshirt/hair at trial If prosecution brings up Fotis’ bike ride to JF‘s house in New Canaan on the day of the murder
How do u introduce something as evidence if you will not say where it came from?
And if u do know where it came from - how about the chain of custody of the items?
Who doesn’t own a sweatshirt/hoody- so not unusual for PG to have one. Nor imo would it be unusual for their be be a PG hair on someone else’s sweatshirt. Like on one owned by FD or one owned by PG that FD used that day he murdered his wife and later put the sweatshirt in PG’s truck. Or any number of scenarios
Imo JS is a film flam man - cut out of the same cloth as NP.
So what is his end game?
If they remove him it’s more delay delay for his client which has been JS’ specialty since day one. If they don’t remove him and he introduces his bs - might be grounds for mistrial later. So kind of a win win for a desperate client with either of those outcomes.
Imo he needs to be removed.

This new bit is intriguing to me--from JS's attempts to get full transcript of the sealed divorce hearing re the psychologist's testimony, I thought JS was going with a defense where Fotis was the bad guy and Michi was only an innocent bystander, and even his victim, too. Now I don't know--he's trying to say Pawel was the guy on the bike in the hoody? Does anyone know when the Supreme Court is going to hear JS's appeal against the court reporter?
 

TROCONIS CASE UPDATE: Here’s Jon Schoenhorn’s objection to the state’s motion to remove him as Michelle Troconis’ attorney. Of note in the filing, a still of the video we’ve heard about (but never seen) showing a bicyclist who the prosecution says is Fotis Dulos in New Canaan the morning Jennifer Dulos disappeared.

The box containing a screwdriver, a wrench and a large black and blue hooded sweatshirt is the latest point of contention in the long running investigation of the disappearance and presumed murder of Farber Dulos at the hands of her estranged husband, Fotis Dulos.


According to the motion to disqualify Schoenhorn by the State’s Attorney’s office in Stamford, state police investigators first learned of the box and sweatshirt after being called two years after the slaying to the law offices of attorney — and now Superior Court Judge Tara Knight — in New Haven.

Knight handed the detectives a white banker’s box and said she had received it a day earlier.

“Knight, citing attorney client privilege, refused to reveal who gave her the box or how it came into her possession,” the prosecution motion said. “Knight did, however, state the following in sum and substance: She had not looked inside the box; however, she had been assured by her ‘client’ that the contents of the box had a direct connection to the investigation.”

Inside the box, the detectives found, in addition to the sweatshirt and tools, a letter from Schoenhorn to Knight. The letter referred to the criminal charges against Troconis and said only, “I am enclosing a blue sweatshirt that I received from another attorney.”

According to the prosecution memo, Schoenhorn “intimated” that he came into possession of the box a year earlier and disclosed it to police after realizing it could be significant in view of other evidence. He “suggested” the sweatshirt had been in in various places and handled by “several” persons before it arrived in his office.

Detectives also interviewed attorney Andrew Bowman, who represented Troconis before Schoenhorn. Bowman said the box was among the materials he gave Schoenhorn. Bowman said Troconis did not give him the box, but he could not remember who did, according to the prosecution motion.

@PrairieWind , another attorney IIRC.

Granted plenty of what I know about forensics was explained by Abby on NCIS -- but if "several people" have handled that sweatshirt with zero chain of custody, there is zero forensic value.

Except to muddy the water, perhaps.

The state’s brief notes that the case will likely not be ready for trial at any point “in the immediate future.” That’s because Schoenhorn is separately suing for access to a transcript in the divorce proceedings between Jennifer and Fotis Dulos; that case is currently being briefed before the Connecticut Supreme Court.

To any lawyers/legal types out there @gitana1 @Seattle1 how could whatever is in that box even actually be considered evidence? Isn't that the real issue?
So "somebody" (AB cannot remember who) gave Andrew Bowman the box of items when he was representing MT and then Bowman passed them to Shoenhorn who held on to the box for a year - then passed to Tara Knight another lawyer to hand off to detectives.
Why all the subterfuge - if the items had merit regarding the case, why were they not given to detectives right away?

Hmmm...let's see that box. And let's also see that suitcase on wheels that crossed the street and entered the hospital before FD was removed from life support. Any correspondence, size-wise?

I can finally post this - she has had so many court hearings cancelled - now I can finally shorten this up a bit.

Tuesday, October 18th:
*Pretrial Hearing-(Off the Record) (all cases) (@ 9am ET) – CT – Jennifer Rebecca Farber Dulos (50) (May 24, 2019, New Canaan; still missing) – *Michelle C. Tronconis (44/now 47) (Dulos’ GF) arrested & charged (6/1/19) & arraigned (6/3/19) with tampering with or fabricating physical evidence & hindering prosecution. Plead not guilty. $500K bond. Posted bond (on 6/3/19). These charges were dismissed (8/28/20) & recharged below.
*Charged (9/5/19) & arraigned (10/4/19) with tampering with evidence involving the borrowed car from work colleague. Plead not guilty. $100K bond. Posted bond (on 9/5/19).
*Charged (1/7/20) with conspiracy to commit murder. Plead not guilty. $2M bond. Bond reduced (1/8/20) to $1.5M & bonded out (on 1/9/20).
*Charged (8/28/20) with 2nd degree hindering prosecution, tampering with physical evidence & conspiracy to commit tampering with physical evidence. No plea entered yet. $500K bond. Posted bond.

7/8/22 Update: Pretrial hearing on 7/14/22 has been rescheduled on 7/28/22. 7/27/22: Attorney Jon Schoenhorn is seeking any information from the State that would indicate other suspects may have been investigated regarding the disappearance of Jennifer, a motion filed Wednesday (7/27/22) indicates. Schoenhorn contends in a motion State prosecutors didn’t reveal to his client that federal authorities were conducting their own investigation until this year. Schoenhorn is asking a judge to reconsider a motion that was denied in 2021 seeking “particulars” about other potential suspects including their names, phone numbers & what “overt acts” the state alleges are material to the charge of conspiracy to commit murder. A judge had denied Schoenhorn’s request for “particulars” about other potential suspects based on the extensive arrest warrants issued in the case that detailed nearly every move made by Fotis Dulos & Troconis in the hours before & after Jennifer Dulos disappeared. But Schoenhorn now says the representations that he didn’t need any other information on potential suspects “were materially false.” “Therefore, the defendant has not been afforded adequate notice as to the names of all alleged conspirators, whether charged with a crime or not; nor has she been given adequate notice as to what overt acts are alleged to be part of a ‘conspiracy,’ ” Schoenhorn said.
7/28/22 Update: Schoenhorn is AGAIN arguing for GPS ankle monitor to be removed as part of her conditions of release. The State says their position is to keep the GPS on, she’s charged with very serious crimes & we want to know where she is while trial is pending. Judge Blawie: the charges haven’t changed but you’re right, she has been in compliance. Denies GPS ankle monitor but agrees to second request that Troconis no longer needs judicial approval to travel within the continental United States. Schoenhorn also wants anything sent to him after 7/1/22 to not be allowed to be used in the case. Says he’s still getting stuff he’s never known about from three years ago. Suggests that perhaps previous prosecutors on the case withheld information or were not forthcoming with the court. He implies information has been withheld from him by previous prosecutors. Blawie denies request for a cutoff on evidence/discovery. Next hearing will be an off-the-record pretrial on 9/6/22 to discuss scheduling moving forward & which motions will be argued. Supervisory State's Attorney Michelle Manning put it on the record that Blawie would continue as judge through the pretrials but there'd be a different judge at trial.
8/10/22 Update: Schoenhorn filed a new motion on Wednesday, seeking information on a possible "co-conspirator" in the case, a Greek national, who New Canaan police, State police & the Dept. of Homeland Security investigated. Law enforcement probed whether the man & Fotis Dulos had been involved in criminal activity before Jennifer disappeared, but Schoenhorn & the court did not become aware of that investigation until this year. Blawie gave DA Manning a few weeks to respond to the latest motion. The next hearing in the case, which will be scheduled for the Judge's chambers between Blawie, Schoenhorn, Manning & another attorney from the State's Attorney's office, is set for 9/6/22. At that meeting, the principals will discuss what motions & evidence still remains unresolved.
9/1/22 Update: Hearing on 9/6/22 has been rescheduled to 10/18/22.
9/12/22 Update: CSP released about their response to the Farmington River. Divers & paranormal investigator who has been trying to help find Dulos, pulled a stained carpet from the river. They say it was held down by cinder blocks. Do not know if this is connected to the Dulos case. This body of water is not far from the former Dulos properties in Farmington. State Police say rug pulled from Farmington River is not connected to the Jennifer Dulos case or any other criminal investigation.
10/12/22 Update: The State has filed a motion to remove Jon Schoenhorn as Troconis' attorney, saying he's likely to be a witness in her impending trial & is working under a potential conflict of interest. Schoenhorn filed a lengthy objection to this motion. And in an email: “The state apparently is willing to go to outrageous length to go after my client & to deny her a fair trial & that includes getting rid of me. To be clear: I am not going anywhere voluntarily. PERIOD. This pathetic move just demonstrates the weakness of the case against Michelle. It also suggests that police investigators were incompetent by failing to look at other suspects who may or may not have had something to with the unexplained 2019 disappearance of Jennifer Dulos."
*Kent D. Mawhinney (54/now 57) – Murder: Judge John F. Blawie put the case on the trial docket. Disposition hearing on 10/3/22. Trial set to begin January, 2023. 2/23/22: Plead guilty to a charge of violating a protective order that stemmed from an incident involving his ex-wife. Sentenced for violation & assault on 6/17/22 was given a 5 year suspended prison sentence & 3 years of probation on a domestic violence charge.
*Fotis Dulos (52) – Committed suicide on 1/28/20 & declared dead at 5:32pm on 1/30/20. 3/3/20: Charges dismissed. The case against Dulos will be officially dismissed in about a year, unless the state decides to reopen it. 1/17/22: After debt, no money left in Dulos estate for children. While Fotis Dulos’ estate has $395,687 in assets, it owes $548,280.75 in expenses, according to Farmington Probate Court records. Attorney Christopher Hug will be paid $189,525 for settling the estate & attorney Paul Knierim, who represented Hug, will receive $98,326, court documents show."
