Did MS hold shares of ownership, or lease the office space from the ownership? I wonder if he defaulted on association dues. A monthly fee due to the office property management, similar to a condo? 'Signing over of shares' language is confusing.:confused:

I repaired the link in my post to the NBC-2 article that Naples News referenced and it has this in it:

According to the staff at Wilson's Wellness Center, which is located right across the hall from Sievers' office, a meeting was held Tuesday night for all owners and partners in the building.

We're told the building's manager informed partners that he met with Mark Sievers and his attorney on Monday. Mark Sievers signed papers transferring his membership interest back to the medical center.

We're told Mark Sievers was given until this Saturday to vacate the building.

I'm confused on that too. So possibly a co-op ownership with shared costs of bldg and expenses? Except they did say rent, so color me confused.
 
What are the odds that MS is making the mortage payment on the house? It is probably pretty high. I would have thought he would have gotten a job by now. If there is a big insurance policy it may be quite awhile before they pay out. jmo

Thank you, KateB! Interesting, I wonder what cost, if any, was paid for a membership 'buy in'? If they invested a lot of money, sounds to me like MS is taking a financial loss by transferring the interest back. I highly doubt the medical center is forgiving the outstanding debt owed by the practice, wonder how that will play out. Also, really interested in knowing exactly when MS first got behind in payments.

It may be a co-op. It was noted that he owned shares in the building as do the others in the building, yet Mark was to pay rent. It sounds like it was a co-op. In a co-op, the people own shares in the entire building, and for that they are granted a lease to a particular part f that building. They pay common charges which is sometimes referred to as rent. They each also pay their own separate mortgages for the actual shares they bought. People don't own shares in a condo; each person owns their own unit, and each person pays their own mortgage. They do not own shares, and although they do pay common charges it is not referred to as paying rent.
 
Well that plan didnt work so well. Thinking they could bring a doctor in and it would be business as usual was unrealistic. Dr Seivers was the practice. jmo.
 
The building is owned by ESTERO MEDICAL CENTER LLC. TS signed individually, as guarantor (along with 20 or so other doctors in the building plus the LLC) on a hazardous waste indemnity agreement with the LLC's mortgage lender.
Maybe TS was leasing from the LLC and the mortgage company wanted the tenants to agree...but one of the tenants is also the registered agent for the LLC. This leads me to believe shares of interest in the LLC are majority owned by the doctors-tenants.

If this is the case, maybe that explains why MS wanted to find another doctor - to fill the space. On the other hand, he could have filled the space, sublet the office by now.

BBM: What would he do? His previous employment history seems a bit lackluster. He, IMO, was a Practice Manager because of his wife. I think most employers would not consider him a viable candidate due to current circumstances (possibly a very, very long LOA in the future), lack of educational degree and lack of experience. I cannot picture him on a landscaping crew or in an Arby's uniform...I am just pointing out that he likely has very little options right now.

BBM: Perhaps by signing over interest in the bldg, he was extended a "credit" on monies owed in lieu of...JMO
