*Trial begins (Day 1) (@ 1:30pm ET) – FL – Chad Amato (59) father, Margaret Ann (61) mother & Cody Winston (31) bro (Jan. 25, 2019, Choluota) - *Grant Tiernan Amato (29) arrested & charged (1/26/19) & arraigned (3/26/19) with 3 counts of 1st degree premeditated murder. Plead not guilty. Held without bond. $750K bond granted (4/25/19). DA will seek DP.
Trial set for 7/22/19. Jury selection started 7/15/19 & ended 7/22/19. Jury is 2 men & 10 women.

7/15/19 Day 1 of Jury Selection. Judge Recksiedler estimated jury selection could take the rest of this week, with the actual trial taking an additional week. If Amato is convicted, the second phase of the trial — when the jury would determine whether they would recommend the death penalty — would begin Aug. 12. Jury selection continues on 7/16.

7/18/19 Day 4 of Jury Selection: So far, the court is struggling to find jurors willing to recommend the death penalty if needed. Only two people qualified since 3:30 yesterday (7/17). Current official number qualified is now at 27. Judge Jessica Recksiedler was hoping to have about 55 jurors qualify for the selection process. No indication as of now that that number will be lowered. We are up to 40 qualified people for jury selection. Judge Recksiedler denied a request by the defense to recess at 5 this evening. Death Penalty questions for jury qualifying continues to 7/19.
7/19 Day 5 of Jury Selection: Jury selection continues. Friday afternoon the court finally reached a pool of 55 potential jurors to choose the final jury from, after questioning people all week. From this pool of 55 the court will now pick 12 jurors & 3 alternates, with an eye toward proceeding with opening arguments next week. That final phase of jury selection will take place Monday, 7/22.
7/22/19 Day 6 of Jury Selection: Lawyers debating motions. Final 55 jurors present. Twelve jurors will be selected, with three additional members serving as alternates. Opening statements could get underway on Monday. Jury breakdown: 2 men, 10 women. Trial continues for opening statements on 7/23.

    All 3 alternates are men.
    Of the 12 jurors, 5 have said they are parents.
    Of the 12 jurors 3 mentioned they are gun owners, and two others said they are looking in to purchasing a gun. @MyNews13

    Prosecutors say #GrantAmato was located at a hotel in Orlando on Jan. 26th & found in that hotel among other items were a pair of leather gloves. Prosecutors say on the outside of those gloves is gunshot residue.

    Moderson said he was worried after he tried knocking on the door and calling each family member. He eventually used a pocketknife to open a deadbolt in the master bedroom. Stone: "Once inside the house, did you discover three dead bodies?" Moderson: "Unfortunately, yes we did."

Grant Amato trial: Prosecutor says Chuluota man tried to frame dead brother after killing family

Margaret Amato was the first to die that afternoon in January, prosecutor Stewart Stone said, shot once in the head while sitting at the desk in her home office.

Next, her husband, Chad Amato, was shot twice in the head, shortly after he got home from work, Stone said. The last person to die was Cody Amato, the middle son, who was shot through the face hours later, as soon as he walked into the family’s house on Sultan Circle.

During his opening statement Tuesday in the trial of the family’s youngest son, Grant Amato, Stone told the jury that Amato stayed in the home for hours after killing his relatives, meticulously planting evidence in an attempt to shift the blame from himself, instead implicating Cody Amato in the killings of his family.

“What the defendant did in this case, is he staged a murder-suicide scene,” Stone told the jury of 12 and three alternates, who were seated Monday evening. “And in order to do that, he planted certain items of evidence at the scene to give the appearance of a murder-suicide.”

But Amato’s defense lawyer, Jared Shapiro, told jurors that no physical evidence ties Amato to the killings — and the lack of an alternate suspect isn’t enough to prove his client’s guilt.

“'If not Grant, then who?' is not a legally sufficient argument to convict Mr. Amato in this case," Shapiro told the jury.

Three witnesses were called to the stand during the first day of testimony: Chris Sisco, Cody Amato’s coworker at Orlando Regional Medical Center who called police after Cody didn’t show up to work Jan. 25; Seminole sheriff’s Deputy Todd Moderson, who went into the home and found the bodies; and Crime Scene Analyst Arthur Rubart, who identified several pictures of Amato’s home and the bodies of his family.
