Josh Stambaugh, one of eight Broward Sheriff’s Office deputies who heard gunshots but did not immediately try to confront the gunman during the Parkland school shooting, was put on restricted duty Thursday.
Stambaugh is the third deputy the agency has placed under investigation for inaction during the massacre of 17 people at Marjory Stoneman Douglas High School on Feb. 14.
Each of those investigations began more than nine months after the shooting, despite repeated criticism of the agency’s slow response at the scene.
The 24-year agency veteran, who made $151,954 in 2017, was working an off-duty shift at a nearby school when he responded to reports of shots fired at Stoneman Douglas.
Stambaugh got out of his truck, went to the back of it to put on his bulletproof vest and then took cover for about five minutes after hearing the shots, according to body camera footage.
His next move was not into the school, but instead to get back into his truck and drive to a nearby highway. That trip took over five minutes and thirty seconds, a state commission investigating the law enforcement response found.

The discipline, first reported Thursday by the Sun Sentinel, marks the third time a BSO deputy has been placed under investigation for not confronting Nikolas Cruz, who walked into Marjory Stoneman Douglas High on Feb. 14 and opened fire, killing 17 and wounding 17 others. Judge Scherer, however, said she is reluctant to move that quickly, with Cruz's lawyers contending they still have large amounts of evidence to review and dozens of witnesses to interview. Assistant Public Defender Melisa McNeill said there are more than 300 frontline witnesses on the prosecution's list and added that capital cases in Broward County typically take two years or more to get to trial....

The two-term sheriff, the object of fierce criticism over BSO's handling of the Parkland massacre, told his top commanders that he will be removed from office by Gov. Ron DeSantis, sources have told The Miami Herald.
DeSantis, who was sworn in Tuesday morning, had not made a formal announcement of a possible suspension.
Stuart N. Kaplan, one of Israel's lawyers, said Israel was in his office at the public safety building in Fort Lauderdale working on Tuesday.
"The governor has not said anything to us, directly or indirectly, as to whether or not the sheriff is going to be suspended," Kaplan said. "He is working and continues to serve the citizens of Broward County."
But Jeff Bell, BSO's union chief, said Israel told his staff on Monday that his ouster was inevitable.
"We know that he is telling everyone at the public safety building that he is going to be gone," said Bell, who was at DeSantis' swearing-in ceremony in Tallahassee on Tuesday.
Several candidates have been mentioned as possible replacements, including former Broward Sheriff Al Lamberti, a Republican like DeSantis. But Bell would not indicate whether the union was backing anyone...."

The suspension was made with an executive order filed Friday afternoon by the governor.

Jones said he'd have a list of other evidence to Cruz's defense by Friday.
"We have turned over all recorded and or transcribed statements," Jones said. "All those have been turned over to the state as we promised."
Assistant State Attorney Steven Klinger said prosecutors were still going through about 180 witness statements collected by the commission but would soon turn them over to Cruz's lawyers. Judge Scherer set a Jan. 29 deadline for that to happen.

"A ccused mass murderer Nikolas Cruz not only got counseling from Henderson Behavioral Health, but staff there were deeply involved in major aspects of his life: providing input about his mother’s parenting skills, his medical care and his education, a lawyer claims.
From the time Cruz was in middle school through late 2016, Broward County’s largest mental health services organization dealt consistently with the disturbed student, attorney David Brill told the South Florida Sun Sentinel on Wednesday.
Brill represents Andrew Pollack, father of one of the 17 people Cruz is charged with killing on Feb. 14 at Marjory Stoneman Douglas High School. Pollack has filed a wrongful death suit against Henderson and others for failing to act to prevent Cruz from carrying out the deadly attack.
All sides were in Broward Circuit Court on Wednesday to deal with scheduling matters for depositions and evidence gathering. The judge also refused to let school security guard Andrew Medina escape the suit, saying claims that he acted with reckless indifference could go forward....
The suit also contends that:
-- At meetings where school officials were deciding on moving Cruz from Cross Creek to Stoneman Douglas, Henderson employees “never advocated for him” and “failed to request” that he not be mainstreamed to a school “he couldn’t handle.”
-- Cruz scored a 43, “which was very low,” on a “Global Assessment of Functioning” scale, which ranges from 0 to 100. Higher numbers represent greater levels of functioning.
-- Cruz was heavily medicated when he transferred into Stoneman Douglas. Doctors had prescribed him Focalin, Clonidine and Risperidone for attention deficit-hyperactivity disorder and irritability associated with autism. The medications can increase aggression.
-- When Stoneman Douglas officials let Cruz, at age 18, withdraw from special education services, Henderson had a duty to advocate for him to remain in the program but “they did not and were nowhere to be found.”
-- After Cruz was forced out of Stoneman Douglas in February 2017, Henderson did not advocate for Cruz when he asked to return to Cross Creek so he could graduate...."

When Pinellas County Sheriff Bob Gualtieri stood up to give his presentation to the House Education committee on Tuesday, he had harsh words for school districts whom he said are “not moving fast enough” and are “playing games” with SB 7026, the law passed last year in response to the Parkland shooting that mandated sweeping school safety requirements, including requiring an armed guard on every campus.

Gualtieri chairs the Marjory Stoneman Douglas High School Public Safety Commission, which was created by the new law to study the Parkland shooting and issue recommendations to the Legislature aimed and preventing future school shootings, after 17 students and staff were killed in Parkland last February.[...]
He raked school districts over the coals, enumerating what he said was: “no sense of urgency” by districts to train teachers on how to respond to active shooter situations, that staff is not taking advantage of behavioral threat assessments to identify troubled students, schools are slow to submit reports on their emergency readiness and that districts are dragging their feet to train and arm school staff to increase the presence of armed guards on campus.
As part of the commissions' recommendations, Gualtieri said districts need to further implement the Coach Aaron Feis Guardian program, which trains school employees who aren’t primarily classroom teachers to undergo training and carry guns.
