Josh Stambaugh, one of eight Broward Sheriff’s Office deputies who heard gunshots but did not immediately try to confront the gunman during the Parkland school shooting, was put on restricted duty Thursday.

Stambaugh is the third deputy the agency has placed under investigation for inaction during the massacre of 17 people at Marjory Stoneman Douglas High School on Feb. 14.

Each of those investigations began more than nine months after the shooting, despite repeated criticism of the agency’s slow response at the scene.

The 24-year agency veteran, who made $151,954 in 2017, was working an off-duty shift at a nearby school when he responded to reports of shots fired at Stoneman Douglas.

Stambaugh got out of his truck, went to the back of it to put on his bulletproof vest and then took cover for about five minutes after hearing the shots, according to body camera footage.

His next move was not into the school, but instead to get back into his truck and drive to a nearby highway. That trip took over five minutes and thirty seconds, a state commission investigating the law enforcement response found.

A day after a statewide commission released a scathing report on the handling of the Parkland shooting that left 17 students and high school faculty members dead, a Broward Sheriff’s deputy who did not confront the gunman was placed on restricted duty.

Deputy Joshua Stambaugh was informed of the decision by BSO at 9 a.m. Thursday, Jeff Bell, the union president confirmed.

The discipline, first reported Thursday by the Sun Sentinel, marks the third time a BSO deputy has been placed under investigation for not confronting Nikolas Cruz, who walked into Marjory Stoneman Douglas High on Feb. 14 and opened fire, killing 17 and wounding 17 others. The two other deputies placed on restricted duty — which means they have to turn in their badge and gun — are deputy Edward Eason and BSO Sgt. Brian Miller.

Two additional deputies — including the widely criticized school resource officer Scot Peterson — have since retired from BSO.

Prosecutors want trial date in Florida school shooting

"FORT LAUDERDALE, Fla. (AP) — Prosecutors pushed a judge Tuesday to set a trial date this fall for Nikolas Cruz in the 2018 Valentine's Day Florida school massacre that killed 17 people.

At a hearing, Assistant State Attorney Jeff Marcus said the case is fairly uncomplicated despite its notoriety and magnitude. He asked Circuit Judge Elizabeth Scherer to schedule the death penalty trial for Cruz in September.

"We are coming up on the anniversary of this incident. Justice requires that this case be resolved as quickly as it can," Marcus said. "It's a pretty straightforward case that does not require years and years to prepare for."

Judge Scherer, however, said she is reluctant to move that quickly, with Cruz's lawyers contending they still have large amounts of evidence to review and dozens of witnesses to interview. Assistant Public Defender Melisa McNeill said there are more than 300 frontline witnesses on the prosecution's list and added that capital cases in Broward County typically take two years or more to get to trial....

Scherer instead set another status hearing for Feb. 21 and urged both sides to work as quickly as possible....

"FT LAUDERDALE (CBSMiami) – A federal judge has ruled that a lawsuit by Zachary Cruz, the younger brother of self-confessed Parkland school shooter Nikolas Cruz, against the Broward Sheriff’s Office can go forward.

In the lawsuit, Cruz claims that he was targeted, harassed, and tortured by Broward authorities.

In March 2018, Cruz was arrested for trespassing for skateboarding on the campus of Marjorie Stoneman Douglas High and was placed on six months’ probation after pleading no contest....

“If people only knew the half of it,” said Zachary. “I’m nothing like [Nikolas]. But people have their opinions. I’m not my brother.”

Prosecutors said at the time that Zachary Cruz had “red flags” similar to his brother’s in terms of behavioral problems that might lead him down a criminal path or worse....

In the filing, lawyers for Cruz said he was illegally held after posting his $25 bond without just cause. The claim Broward County officials then engaged in a campaign of intimidation and torture once he was in the Broward main jail facility, including the use of a restraint vest 24-hours per day and sleep deprivation tactics such as guards repeatedly waking him at all hours and the use of 24-hour intense lighting...."

Broward Sheriff Scott Israel tells staff he's being suspended over massacre response

"MIAMI —It appears that Broward County Sheriff Scott Israel is preparing to pack up his office.

The two-term sheriff, the object of fierce criticism over BSO's handling of the Parkland massacre, told his top commanders that he will be removed from office by Gov. Ron DeSantis, sources have told The Miami Herald.

DeSantis, who was sworn in Tuesday morning, had not made a formal announcement of a possible suspension.

Stuart N. Kaplan, one of Israel's lawyers, said Israel was in his office at the public safety building in Fort Lauderdale working on Tuesday.

"The governor has not said anything to us, directly or indirectly, as to whether or not the sheriff is going to be suspended," Kaplan said. "He is working and continues to serve the citizens of Broward County."

But Jeff Bell, BSO's union chief, said Israel told his staff on Monday that his ouster was inevitable.

"We know that he is telling everyone at the public safety building that he is going to be gone," said Bell, who was at DeSantis' swearing-in ceremony in Tallahassee on Tuesday.

Several candidates have been mentioned as possible replacements, including former Broward Sheriff Al Lamberti, a Republican like DeSantis. But Bell would not indicate whether the union was backing anyone...."

Since Parkland, scores of American school districts across the country — including many in poor and rural areas — have quietly adopted new policies to arm teachers or school staff.

At least 215 school districts across the U.S. have adopted such policies since last February, a VICE News review of state and local policies has found. Nationwide, at least 466 districts now allow school staff to be armed, encompassing hundreds of thousands of students of all ages.

DeSantis Suspends Broward Sheriff, Names Successor

FORT LAUDERDALE, Fla. — Gov. Ron DeSantis on Friday suspended Broward County Sheriff Scott Israel over his department's response to the Parkland massacre and named a veteran police sergeant as his successor.


The suspension was made with an executive order filed Friday afternoon by the governor.

"The (Parkland) massacre might never have happened had Broward had better leadership in the sheriff's department," DeSantis said at a news conference in Fort Lauderdale.

Brevard isn’t the only school system to have trouble complying with a new state law that allows certain employees to be armed, according to an examination of how the program is being implemented across the state by the Tampa Bay Times and University of Florida student journalists.

Some small districts struggled to recruit enough so-called school guardians to keep their schools safe. Levy County launched a program, only to have nobody apply for weeks.

Others had trouble with the guardians they hired. In Duval County, a school safety assistant was arrested for pawning a service weapon issued to him by the school district. In Hillsborough, a school security deputy resigned after exposing students to pepper spray.

Duval County faced a different kind of challenge: Several parents sued the school district on November, claiming that it is illegal for school safety assistants to carry weapons on school grounds.

A prosecutor said his office would turn over about 180 witness statements to Cruz's lawyers by Jan. 29.

Jason Jones, who represents the chairman of the 15-member Marjory Stoneman Douglas High School Public Safety Commission, said most of the key witness statements and transcripts had already been turned over to Broward County prosecutors. Jones said he'd have a list of other evidence to Cruz's defense by Friday.

"We have turned over all recorded and or transcribed statements," Jones said. "All those have been turned over to the state as we promised."

Assistant State Attorney Steven Klinger said prosecutors were still going through about 180 witness statements collected by the commission but would soon turn them over to Cruz's lawyers. Judge Scherer set a Jan. 29 deadline for that to happen.

"We would at least like to have the time to review them and read them," Klinger said. "We haven't even seen most of them."...

"A ccused mass murderer Nikolas Cruz not only got counseling from Henderson Behavioral Health, but staff there were deeply involved in major aspects of his life: providing input about his mother’s parenting skills, his medical care and his education, a lawyer claims.

From the time Cruz was in middle school through late 2016, Broward County’s largest mental health services organization dealt consistently with the disturbed student, attorney David Brill told the South Florida Sun Sentinel on Wednesday.

Brill represents Andrew Pollack, father of one of the 17 people Cruz is charged with killing on Feb. 14 at Marjory Stoneman Douglas High School. Pollack has filed a wrongful death suit against Henderson and others for failing to act to prevent Cruz from carrying out the deadly attack.

All sides were in Broward Circuit Court on Wednesday to deal with scheduling matters for depositions and evidence gathering. The judge also refused to let school security guard Andrew Medina escape the suit, saying claims that he acted with reckless indifference could go forward....

The suit also contends that:

-- At meetings where school officials were deciding on moving Cruz from Cross Creek to Stoneman Douglas, Henderson employees “never advocated for him” and “failed to request” that he not be mainstreamed to a school “he couldn’t handle.”

-- Cruz scored a 43, “which was very low,” on a “Global Assessment of Functioning” scale, which ranges from 0 to 100. Higher numbers represent greater levels of functioning.

-- Cruz was heavily medicated when he transferred into Stoneman Douglas. Doctors had prescribed him Focalin, Clonidine and Risperidone for attention deficit-hyperactivity disorder and irritability associated with autism. The medications can increase aggression.

-- When Stoneman Douglas officials let Cruz, at age 18, withdraw from special education services, Henderson had a duty to advocate for him to remain in the program but “they did not and were nowhere to be found.”

-- After Cruz was forced out of Stoneman Douglas in February 2017, Henderson did not advocate for Cruz when he asked to return to Cross Creek so he could graduate...."

"FORT LAUDERDALE (CBSMiami) — A wrongful death lawsuit will go forward against Marjory Stoneman Douglas High School security monitor Andrew Medina.

The family of slain student Meadow Pollack filed suit against Medina in August 2018 for failing to stop self-confessed shooter Nikolas Cruz after he saw the mass shooting suspect arrive on campus minutes before the massacre that left 17 people dead and 17 injured.

Attorneys for the Pollack family say Medina should have called a code red to lock down the school.

Medina’s attorney argued he did everything he could....

n an interview with investigators, Medina is also heard telling them he knew who Cruz was and what he was capable of doing.

"FORT LAUDERDALE, Fla. (AP) — Florida school shooting suspect Nikolas Cruz appeared in court Friday for hearings on two important issues.

First, the defense withdrew its motion to prevent Cruz from being supervised by a corrections officer he's accused of assaulting.

Cruz's lawyers wanted him to be under the supervision of an officer other than Sgt. Raymond Beltran....

But on Friday, the defense withdrew its motion, meaning Cruz can remain under Beltran's supervision.

Also on Friday, Circuit Judge Elizabeth Scherer heard motions related to the deadly school shooting at Marjory Stoneman Douglas High School in Parkland last February.

Cruz's lawyers say his confidential medical records should not have been shared with a state investigative panel.

They asked Judge Scherer to hold the Broward Sheriff's Office in contempt of court for improperly providing the records to the state commission investigating the shooting. They say access should have been limited to certain authorized investigators and prosecutors in the criminal case.

Scherer did not immediately rule on that motion...."

Gualtieri to lawmakers: schools need more armed staff, punish districts that move too slow

When Pinellas County Sheriff Bob Gualtieri stood up to give his presentation to the House Education committee on Tuesday, he had harsh words for school districts whom he said are “not moving fast enough” and are “playing games” with SB 7026, the law passed last year in response to the Parkland shooting that mandated sweeping school safety requirements, including requiring an armed guard on every campus.

Gualtieri chairs the Marjory Stoneman Douglas High School Public Safety Commission, which was created by the new law to study the Parkland shooting and issue recommendations to the Legislature aimed and preventing future school shootings, after 17 students and staff were killed in Parkland last February.[...]

He raked school districts over the coals, enumerating what he said was: “no sense of urgency” by districts to train teachers on how to respond to active shooter situations, that staff is not taking advantage of behavioral threat assessments to identify troubled students, schools are slow to submit reports on their emergency readiness and that districts are dragging their feet to train and arm school staff to increase the presence of armed guards on campus.

As part of the commissions' recommendations, Gualtieri said districts need to further implement the Coach Aaron Feis Guardian program, which trains school employees who aren’t primarily classroom teachers to undergo training and carry guns. Gualtieri said only two districts so far have armed existing school staff such as coaches and administrators, while 23 others, including Pinellas, have hired new school employees whose sole responsibility is to be on-campus security.
