A 94-year-old woman living at the Florida nursing home where eight residents died after an air conditioning system failed in the wake of Hurricane Irma is now suing the rehabilitation center, claiming it showed "negligence and reckless indifference" toward its elderly residents.

Rosa Cabrera's legal guardian filed the lawsuit in a Broward County state court on Friday on her behalf against the Rehabilitation Center at Hollywood Hills in Hollywood, Florida.
 
I think a big part of the problem also was the apparent lack of awareness of the nursing home staff of how absolutely lethal the heat in the building would be to the elderly patients.

In all of the information that was on the news for days about the dangers of the hurricane, I do not recall hearing any warnings about the dangers of excessive heat when the a/c is not working after power outages.

The very young and the very old are highly susceptible to excessive heat.

Heat cramps are the least severe of the heat-related illnesses. This heat disorder is often the first signal that the body is having difficulty with increased temperature. Individuals exposed to excessive heat should think of heat cramps as a warning sign to a potential heat-related emergency.

Heat exhaustion
Heat exhaustion is a more serious and complex condition than heat cramps. Heat exhaustion can result from prolonged exposure to hot temperatures, restricted fluid intake, or failure of temperature regulation mechanisms of the body. It often affects athletes, firefighters, construction workers, factory workers, and anyone who wears heavy clothing in hot humid weather.

Heat stroke
Heat exhaustion can develop rapidly into heat stroke. Heat stroke can be life threatening and because the percentage of victims dying from heat stroke is very high, immediate medical attention is critical when problems first begin. Heat stroke, like heat exhaustion, is also a result of prolonged exposure to hot temperatures, restricted fluid intake, or failure of temperature regulation mechanisms of the body. However, the severity of impact on the body is much greater with heat stroke."

That nursing home - ALL nursing homes, assisted living facilities, and related, should have mandated generators when power fails.
That sounds like a good, but expensive idea. The type of generator or generators needed to power a nursing home are very expensive. I wonder who this cost will be passed on to?

My guess is that this tragedy was the result of a "perfect storm" of events:
- People are advised to evacuate in advance. This leaves the nursing home understaffed, perhaps way understaffed.

- Power goes out and things start to heat up. Things deteriorate very quickly. The few staff on duty make calls for help and wait for orders. But a lot of people need help and orders don't come in time.

Nursing homes can be very dependent on the services of a few capable employees. These employees may well be the ones who had families of their own, and thus were not present. Even the abence of say, three leadership personalities with independent initiative can have a big impact on less capable staff.

Then factor in that a certain number of the staff may not be fluent in English and may of had trouble conveying how bad things were deteriorating.

Murray died more than a week after Irma roared through the Sunshine State. Nobody apparently called 911 until three days after Irma hit — and after the elderly residents had already spent three days sweltering in stiflingly hot rooms despite the fact that a fully functioning and air-conditioned hospital is right across the street.
 
Was hoping to see an update on this with the nursing home shut down due to the violations issued after the storm. Many suits will eventually shut it

I feeel for all these families who lost loved ones due to negligence.
 
Arrest warrants have been issued against four employees of the Hollywood Hills nursing home in Florida. The workers have been accused of playing a role in the deaths of a dozen residents after Hurricane Irma knocked out the air conditioning for the facility.

The employees, including the nursing home's administrator, Jorge Carballo, and the head nurse on duty during the storm, Sergo Colin, are expected to surrender Monday morning. Carballo and Colin could face twelve counts of manslaughter..

Two other employees, both nurses, are expected to face less serious charges.
