Judge Robert Wheeler... will allow the jury to hear audio of three phone calls captured on wiretap between Donna Adelson and Charlie Adelson immediately after the bump.

Wheeler explained that the State is not trying to prove what was said between the mother and son, but rather what was not said — which was the name of the defendant. Wheeler clarified that the purpose of allowing the jury to hear these recordings is to establish “the fact that Katherine Magbanua was not mentioned in the calls.”

These recordings prove a major aspect of the State’s case — that when confronted by a stranger about Dan Markel’s murder, Donna and Charlie knew exactly who to call — their middleman, Magbanua.

More likely it is to avoid paying income tax on the earnings. They probably don’t declare the cash income to the government.

We learned that Erica Johnson earns a meager $11.50 per hour. That is likely minimum wage and they top her up with cash to avoid tax. Or, they are the cheapest employers on the planet.
 
So, we now know that tax fraud and welfare fraud was committed by Magbanua for not declaring income she earned as a Bottle Girl and bartender, etc. Also, that she had CA put her on the Adelson Institute payroll so she had proof she had income so she could get her children on Medicaid.
There is no way they can't do something about this. JMO of course.
 
I'm following this trial closely & also watched the first one, also read this entire thread.

I'm really struck by how everyone found Jeffrey Lacasse to be a good witness. I thought he was melodramatic and being a star witness at the center of now two trials and surely upcoming Charlie's has gone to his head. The difference between his demeanor and testimony at Magbanua's first trial and this one is amazing. Two years ago he was calm, restrained and believable. Now he's hyperbolic, self-pitying, going on and on about how Wendi is manipulative. deceptive, pathological, using the kids to jerk him around etc etc.

I do not believe he was set up to be a suspect by Wendi. I think, in many police interviews where he was getting attention & being pumped for more details, they co-created that narrative. Like the "owl necklace" and Bulleit bourbon (it sounds like bullet!!!) details, it smacks of overreach and conspiracy theory.

I watched Wendi's entire 5-hour police interview this weekend. She did not put Jeff forward as a suspect; her friend did. She had a friend come in for support & that friend, while they were brainstorming who would do this, mentioned Jeff. This friend knew him and also had been the one to suggest the week of no-contact after Wendi confided in her about their fight. The friend had been concerned about his jealousy and thought he was controlling in that he had gone through Wendi's datebook and phone. Wendi's response to her friend's suggestion is tepid, but then she castigates herself for not even thinking of it. The friend then leaves, but outside the room, puts Jeff forward as a suspect to the detective, who is in the hallway. We know this because the detective later references "what your friend said." When the detective comes back in he questions Wendi about Jeff & their relationship. At no time does she mention what car he drives or what time he was leaving on his trip. It's all about relationship dynamics and whether he might own a gun. I write this in such detail because if you only listened to Jeff's testimony it sounds like Wendi enthusiastically put him forward as a suspect and emphasized the time he was meant to be leaving town.

One more thing: Wendi wearing the exact same outfit. It was very smart. First, it makes her testimony visually indistinguishable on youtube, so fewer novelty views. It also psychologically designates almost a uniform, something separte from her life or real clothes, kind of like a dress you'd worn to a funeral and could never wear again. It also creates a continuity of circumstances. The subtext about her family is they are rich, they are materialistic. Some questions are about whether she benefited financially. A new outfit might play into that, and also in and of itself, given the interest in this case, might even fuel blogposts or youtube "reactions." She gave them nothing to talk about. Finally, subconsciously, she needs to be completely consistent with her previous testimony. The dress reinforces this sense that things are the same.
Wendi absolutely framed Lacasse. Yes, Wendi’s friend Lynne suggested Jeff as a suspect, but only after Wendi prompted her to do so by asking, “Who would do this?” Wendi had gone for a walk with Lynne five days before Danny was murdered and they spoke about Wendi’s relationship with Jeff. No doubt Wendi planted the seed during that conversation so that he would be top of Lynne’s mind as a suspect. The assassination was thoroughly thought through. Just not very well executed.

Somehow I don’t think this was the only instance of tax fraud involving ye olde Adelson Institute

Oscar Jimenez is a retired FBI Special Agent. Back in 2016, his job was to pretend to be a Latin King and initiate a "bump". A bump is when an undercover approaches someone to either get information or set up a follow up meeting. In this case, get some chatter on the wire taps.

Jimenez gave Donna Adelson- Wendi and Charlie's mom- a print out of a news article about Dan Markel with a number and a dollar amount ($5,000) written on it. The number was his undercover cell number.

This retrial has shown significantly less discovery. But we are seeing the body camera footage of an undercover FBI agent approaching Donna Adelson.

Cross-examination happening now: the defense hinted that because the undercover mentioned Katherine, Tuto, and others, they "gave a roadmap of what they thought the communication should be."


Now Special Agent Bronstein is testifying. He recorded the Dolce Vita tape. That's the secret recording of #KatherineMagbanua and #CharlieAdelson after the Donna Adelson bump.

He sees the two were seated towards the back of the restaurant. The camera was instead a messenger bag. He says he was in the restaurant for roughly an hour.


The state now calls Keith McElveen. He's the person who was finally able to fix the audio on the Dolce Vita tape enough to hear some of the words.

McElveen said the device picked up a lot of noise: music, the kitchen, movement of the bag, the swinging door beside the camera.

"Initially we used the standard techniques practiced in forensic audio for 30 years. Some improvement but not significant. Then we used our tool that works in a substantially different way. It tries to learn the person talking."


Next witness is Agent Patrick Sanford. He was involved in investigating the murder.

Wednesday, May 25th:
*Trial continues (Day 6) (@ 8:30am ET) - FL – Daniel Eric Markel (41) (shot to death July 18, 2014, Tallahassee) - *Katherine Magbanua (32/now 37) (Garcia's wife) arrested (Oct. 2016) & charged with 1st degree murder & 1 count conspiracy & 1 count solicitation of murder were brought together into one case on Tuesday (3/20/18). Plead not guilty. Held without bond.
Murder for Hire hit man. They split a $100K payoff for murder. KM has rejected several offers of immunity for her testimony.
First trial started on 9/23/19 & the jury started deliberations on 10/10-10/11/19 with a total of 11 hours of deliberations. They found Garcia guilty. A mistrial declared for Magbanua. (10-2 for guilty). Will remain in jail as a charged co-conspirator & the State will try her case again.
Re-Trial began on 5/16/22 with jury selection. 12 jurors & 2 alternates (7 women & 7 men). Trial began on 5/18/22. (should last 2-3 weeks).

5/24/22 Tuesday, Trial Day 5: The judge ruled that some of the calls would be too prejudicial & that translation will take too long so only the English calls without Kawass on them will be allowed in. The court ruled that the court will not use any resources to translate non-translated calls so that unless one of the parties transcribes them, he won't consider them. He was clearly not wanting to get bogged down or spend taxpayers money on translating calls that likely won't be used anyway.
State witnesses: Elizabeth Richey, a crime lab analyst with FDLE. Jessica Rodriguez, dated Rivera (not being shown on camera for security reasons).

*Charles Jay Adelson (45) – First appearance & bond hearing on 4/26/22. 4/26/22: Bond denied. Defense attorney asks for an Arthur hearing. No further info or dates yet as 5/15/22.
*Sigfredo Garcia (34) – 10/10/19: found guilty of 1st degree murder. Guilty of conspiracy. Not guilty of solicitation. Sentenced to LWOP for murder plus 30 years for conspiracy charge. 11/4/19: Motion to Withdraw as Counsel: Mauricio Padilla; Motion to Withdraw as Counsel: Saam Zangeneh.
*Luis Rivera (33) charged with 1st degree murder. Took a plea deal (Oct. 2016) & plead guilty to 2nd degree murder. Will testify against Garcia & Magbanua. Will receive 19-year sentence to run concurrently with his 12 year Federal time, which he is already serving.

POIs: Wendi Adelson (ex-wife of Markel), her mom Donna Sue Adelson (68) & father Harvey Adelson. Investigators have not charged any of these people in the Adelson family in connection with Markel’s death, except Charlie; but say Adelson’s mother & brother – Donna & Charlie Adelson – paid $100K to have Markel killed following the couple’s contentious divorce so their two young sons could move to South Florida.
 
Charlie made $3M/Year? Wow! I wonder how much of that was from dental work and how much, if any, was from rental income or other business activities. Implants aren't cheap - they go for about $4K each not including the Crown. He was running all over Florida doing them from referrals from other offices. $3M/$4K = 750 Implants. 750 Implants/250 Working Days in a Year = 3 Implants/Working Day.

I think it was three million dollars for those years, (2014, 15 and 16), rather than per year, but I don't believe that could be right. I've been a dentist,and a practice owner for a long time, and I've never heard of any dentist, even really successful specialists, making close to a million dollars a year.
I think that a visiting specialist, (as he would have been at most practices), would get paid a percentage of the fees, minus any lab type costs. (Such as the actual hardware for the implant, which are quite expensive) In the US, general dentists get paid 30-40% of fees, minus lab fees. CA might have been on a higher percentage, but it wouldn't be much higher. There are always some failures- which would either be redone at no charge, or refunded. And I think his professional indemnity insurance would be pretty high. I'd be interested how many referrals he would have been getting, because there is a lot of competition for implants, (general dentists, oral surgeons and periodontists), and I don't think his overly confident/boasting manner would have won him much love from referring practitioners.
The Institute was meant to have an income of around 2 million dollars/year. HA had been a specialist for a long time, and was probably quite busy. I think CA worked there sometimes, and there were probably hygienists working there too. The profit margin was most practices ranges from 25-40%.
Surely there is no way that they were really paying a long term employee $11.50/hour? (Someone should face criminal charges for that!)

I thought Harvey was just a General Practice Dentist? How can a little one man shop practicing general dentistry working 4 days a week in a suburban town generate $2M/Year?
 
For what it is worth, I'm going to express my predictions:

1) I believe the defense will NOT call Katie or Sigfredo to testify. I hope I am wrong, but that is how I read the predicament the defense is in. The prosecution's intent to use jailhouse recordings for impeachment surely must loom ominously and I believe Jessica's testimony presents a huge problem for Katie getting back up on the stand. Her testimony was very believable, and Katie would also have to answer for this little gem from the new enhanced recording:

CHARLES ADELSON: Let me ask you a question. When everybody was there the next day, did any of you take any money? It's not like you're driving around in a Bentley, cruising around in a mega-yacht, ya know?

Moreover, Katie gave a number of responses in her prior testimony that will be problematic after the prosecution has had more than two years to prepare and follow up.

Sigfredo is a wild card and I surely hope he testifies simply so we can see the drama, but I personally believe the risk of putting him on the stand outweighs the long shot chance he may provide a lifeboat for Katie.

2) I believe Katie's goose is cooked. I'm pretty confident the state is riding towards a conviction.
 
SG testifying seems like a Hail Mary pass situation and could be really bad if he’s just going to go up there and lie (IMO) and weave this secret agreement with CA scenario that was previewed in the opening statements. Clearly he personally has nothing left to lose he is in prison for life and he has every motivation to lie for KM.

Given how JR’s testimony yesterday, particularly her recollection of the day after package drop, was bad for KM does anyone know why they didn’t have her testify in the 2019 trial?

THE STATE COULD REST TODAY. We're back in court. Agent Sanford will continue his testimony. That includes the Dolce Vita tapes. The state says it's a crucial piece of evidence.

The jury is in. Agent Patrick Sanford is testifying again. Headphones are going on because we're about to hear the Dolce Vita tape. It starts in the middle, which is the first part where they can make out words. About a minute in, one juror mouths "Wow"

There's video and audio but no transcription. So it's up to the jurors to determine what they hear. The enhancement is mostly Charlie Adelson. Magbanua is soft spoken and further away from the camera so she's harder to hear. Plus as I described yesterday, background noise

Charlie is a talker. He's controlled most of the conversation in the Dolce Vita tape. But the jurors are interested in this tape. Some are even taking notes.

"If you get someone to confess on a wire, then you can charge them. Outside of that, there's no evidence." Charlie can be heard saying in the restaurant. He's throwing a lot of hypotheticals and what-ifs out in the conversation.

Adelson tells Magbanua about how this story is not just national, but also international. "You think I did something? Arrest me, charge me. That's it." This video is definitely still hard to hear in some parts. I see why the state fought to have the transcript available.

(1/3) "I want you to call this persona nd you say I got a call from some friends of mine saying you reached out and you mentioned my name. These people want to go to the police. They had nothing to do with what you're talking about and frankly I don't know what you're talking..."

(2/3) about but the name sounds familiar. He's incarcerated. Here's something charitable to help the less fortunate but do no contact these people again. They don't know anything. I don't know anything. Don't ever contact me, my family, or my friends again." " Don't use anything

(3/3)other than the word help and charity. If it's the police, they can't take the money." Adelson coaches Magbanua on how to respond to the person who gave Donna Adelson a supposed ransom. Adelson's says he wants to figure out if it was a cop or gang member looking for $

After A LOT of talking, Adelson takes a long sigh and says "So what do you think?" We haven't heard much from Magbanua other than a yeah here and there. He's a talker plus her audio was harder to enhance.

The tapes wraps up. Agent Sanford says no mention of Dan Markel's name or the word murder. He says #CharlieAdelson never speaks on the background of the murder and his families potential involvement. He acknowledges there is a car ride and 30 minutes of meeting not enhanced.

Last trial, Magbanua testified that she didn't know Dan Markel was murdered until May 25, 2016 when Sigfredo Garcia was arrested (this video was recorded about a month prior) Enhancements didn't happen until this year.

Cappleman asks about what other international stories Adelson could have been referencing. Agent Sanford says he doesn't know.

Now we're listening to a call between #DonnaAdelson and #CharlieAdelson. The call happens about 10 or 15 minutes after the Dolce Vita meeting.

(1/2) Charlies calls his mom to say he just had dinner with a friend to give her relationship advice.
CA: "She had to go back to work. I think she's going to come to my office. I gave her some good advice and she's just sleeping on it. Relationships are not easy."

(2/2) DA: "No, they're not."
CA: "Everything's fine. Without a doubt. No question in the world. I would not stress it."
The conversation then turns to June (probably Umchinda, his ex) and a dance competition.

Side note: Donna has the kids with her in this call.

For reference: this all happens one day after the undercover bump. Donna calls Charlie back about 5 minutes later. CA: "I hung up on my friend and she's going to sleep on stuff and come to my office and tell me how... I'll talk to her tomorrow. I wish her the best of luck."

"Like I explained to you, relationships even go one of two ways." "I truly would not worry about anything." The first call ends talking about dinner plans. The second call picks right back up talking about his friends relationship advice.

(1/2) D: "If your theory is correct."
C: "It does them no good. They're not going to gain anything. It's not like we ever threatened anybody. They're not hiding who they are."
D: "Not at all. That's why my thoughts were different."
C: "It's the kind of thing that could easily be

(2/2) traced, they could easily be caught, and charges. Extorting people is like 10 years in prison."
D: "I think it's something that could be dealt with. It's not that bad."

The first wire tap between Katherine Magbanua and Sigfredo Garcia happens the day after the Dolce Vita tapes and the calls we just heard between Charlie and his mom.

Their call starts with an argument.
KM: "I have more pressing matter that I have to attend to."
SG: "I don't feel secure. You take care of everyone else except for me. Everyone else gets special attention and then I have to figure it out."

SG: "I'm not making that *advertiser censored**ing phone call."
KM: "I'm on edge."
SG: "I'mma take care of this problem."
KM: "You never talk to me about anything."
SG: "The less you know the better. Stop talking on the phone, man. BYE"

Another call about 10 or 15 minutes later. #KatherineMagbanua is asking #SigfredoGarcia about a fee that she has to pay. She can't remember if its one number or another. She repeats it multiple times. Then ends the call with "Got it?" 65.70 or 60.57

Agent Sanford says it stuck out because the last 4 digits on the flier is 6570. They believe the number was code.

Later that day, a call between #KatherineMagbanua and #CharlieAdelson. "I don't think it's the best idea regardless." Charlie asks Magbanua about visiting his office.

Now they're talking buying property.
"You don't want to buy the wrong property. It becomes a headache for life."
"You don't want to get stuck in a situation where its false advertisement."
"It's one of two things."
They're discussing if someone keeps increasing the amount.

Adelson talks about his property in Miramar. Agent Sanford says the South Florida FBI office is based in Miramar.

Another call between CA and KM. He's practically begging her to meet him at The Icon Condo in Miami. His parents live there. Says he'll come to her after he finishes talking to his parents.

Magbanua asks about calling Charlie Adelson through WhatsApp. Agent Sanford says the meeting happens at a nearby restaurant. They weren't able to surveil the building because they just didn't have the time to get there, especially with Miami traffic. Plus the building is secure.

The FBI has no records of the WhatsApp call because they can't get those calls.

Another call between Magbanua and Charlie. She asks for a phone number. "Hopefully they haven't listed other properties yet."

Now a call between Charlie and his mom. "Do you remember the number that was written on that paper the other day?"

Magbanua gives the undercover number to Garcia in a call. No one has called it at this point. We're on call T.

On another call, Charlie tells his mom not to worry. "You've done nothing wrong and because of that, you have nothing to worry about. Some's trying to make some money and that will never amount to anything."

"The truth is, the number was called and they didn't pick up." Charlie on the phone with his mom.

The FBI "tickles the wire" a second time. The UC calls the Adelson Institute asking to speak to Donna Adelson. He asks to speak to hear and says he met her last week and gave her "important paperwork".

"Tell her it's very important. I need to find out immediately what she thinks about the paperwork." the undercover says in the call. this is april 28 about a quarter to 10.

Donna relays the message the front desk worker tells her about the "important paperwork" in a call to Charlie. "What's your suggestion?" Charlie: "The odd thing is, that's the number you gave me."

"I'm looking into it right now. The odd this is no one picked up. Let me call somebody. I wouldn't worry at all. Especially because you know who it is."

After that call, leaves a voicemail for Magbanua. "Hey, it's me. It's important. Call me. Bye." Agent Sanford says he believes there's about 4 attempts to call Magbanua after that.

Magbanua finally answers with Magbanua. Charlie explains the call to her. Magbanua says call the number. She's clearly agitated. Charlie: "Nobody's pulling a leg. I just asked you to find out who it is." She tells him to get the number off of the caller ID in the office.

"Let's call that number again and find out what's going on?"
"I'm trying to help with whoever's threatening your family. I'm trying to help you guys out but if they don't pick up, then wtf?"

"Somebody's just harassing you or somebody's trying to get something out of you."
Charlie drops the word FBI. "It's not a joke, Katie."

"If someone's messing with you, they're messing with me. If someone's messing with me, they're messing with you." Charlies tells Magbanua.

Magbanua says whether it's a gang member or a Fbi agent, she wants Adelson to report them. "Listen to me for once."

Agent Sanford said at this point, Magbanua was lying. She said she had not called the number. No one had gone to the cops at this point either. Within an hour, there's another call.

Charlie Adelson finally calls the undercover's number. "Someone's been calling my family. I'm trying to figure out who it is." "In reference to what?" the undercover answers. "My brother Tato has not been taken care of. His family has not been taken care of."

"You don't know Tato? You know Katie and Tuto. They've been taken care of since they handled the family problem. The lady was handed the paperwork. She's knows what I'm talking about.

"You got to the do the right thing for Tato, man. He needs to be taken care of the way Katie and Tuto have. I don't know your relationship with the lady, but we know what's going on."
Charlie responds with "Let me call you back."
His first call after is to Magbanua.

After a couple unanswered calls, he gets Magbanua. He recounts the conversation with him. "As he's talking, I'm hearing a little bit of a New York accent. He didn't sound tough when he picked up the phone, but it started to come out."

Magbanua notes that the person on the call uses a "bad word". Charlie: "He referenced Broward, he referenced Katie and Tuto. Someone other guy I don't even *advertiser censored**ing know. That's two guys I don't know."

Magbanua asks if he said he was a friend of brother of Tato. Remember, that's Rivera's nickname. "He didn't sound Latin and there was a little bit of New York accent to his toughness. He didn't threaten me at all. He just let me know that this is not going away."

"It sounded like a cop or an investigator playing games. He's coming up with a lot of names and I don't know two of the three people he's talking about and you might be the wrong Katie." They harp on the fact that the undercover says "what is this in reference to?"

State focuses on why Magbanua didn't say she knows Tuto and Tato when Adelson says he doesn't know them. Magbanua says she's going to call the number but she doesn't.

A little later, Magbanua texts Garcia "Baby, call me when you can."

She calls him about 20 minutes after the text. "I have more information for you." She tells Garcia about the undercover who calls the Adelson Institute. "I'm getting pissed because my name's involved."

"They said my name and your name." She says the undercover is "a brother of someone incarcerated" but never says who. "It's getting too detailed. It's somebody. For sure."

SG: "What person and his family?"
KM: "Tato and their family. Because they need it."
SG: "Did he tell them if they keep harassing, you're going to call the cops?"

Magbanua never names Charlie. Only says "that person." She also says "I worked for you before." Sanford says she was still on the payroll at this point.

I think tragic June thinks she and Charlie might reunite one day. Even Charlie, rejected by society and accused of murder, would never stoop to marry someone like June. She was a dim witted play toy to him, she’d be an embarrassment to an educated upper class family like the Adelsons who holds themselves in high regard. Tacky June would never make the cut.
 
It’s tragic anyone falls for CA’s “charms”. The fact WA thinks he’s such an awesome guy — she glows and gets all giggly about him — creeps me out. Remember when JL testifid the other day about inappropriate things CA was saying in the hot tub, and how WA had sort of bragged to JL about CA being with young females in other countries and JL made a good dig about how WA is a supposed human trafficking advocate.
