Ivan Lara, 43, a painter, said he saw Mr. Hill outside sometime after noon Monday, wearing a pair of shorts and lying face down. He assumed that he was exercising. But when Mr. Hill lifted his head, his speech was indecipherable, Mr. Lara said.

Workers at the rental office eventually called 911. Mr. Lara said one of the workers at the complex tried to calm Mr. Hill.

When Mr. Hill saw the officer, Mr. Castillo said, he stood up and moved toward him with his hands raised, and the officer, who Mr. Castillo said looked frightened, yelled for him to stop.

Mr. Castillo said that he had not seen a scuffle, but that he did see the officer pull out a handgun and shoot Mr. Hill.

Anthony was bipolar and having some kind of an episode. I have yet to see any report that he was threatening to anyone before police arrived. He was knocking on doors and laughing at one point. The NY Times interviewed two people who said he was walking. A third person thought he was running. The cop had a taser and pepper spray that he didn't bother to use. Apparently shooting someone is a great way to de-escalate a situation.

Lesson here. if you or a loved one are having a mental health crisis and need assistance. DON"T call 911. Yes, Anthony was black and the cop was white. It matters.

Prosecutors in DeKalb County, Ga., will seek a criminal indictment of the police officer who in March 2015 fatally shot Anthony Hill, an Afghanistan war veteran who was naked and unarmed when he was killed

Hill’s family, which has filed a wrongful-death lawsuit, says he was suffering from post-traumatic stress disorder and was bipolar. They say Hill he was having an emotional breakdown when he was killed and that they do not believe Hill charged at Olsen, instead that he may have been approaching the officer for help.

If Olsen is charged in Hill’s death, his would be the ninth on-duty fatal police shooting in 2015 that resulted in criminal charges for the officer involved.

Georgia Police Officer Indicted for Murder of Unarmed Black Man


A white police officer was indicted here Thursday on six counts, including felony murder, in the fatal shooting last year of an unarmed black man who was naked and described as acting in an erratic manner.

The indictment of Officer Robert Olsen of the DeKalb County Police Department came about two weeks after the district attorney said he would ask a grand jury to pursue criminal charges in the death of Anthony Hill, a 27-year-old Air Force veteran.

“This is a day in history,” said a lawyer for Mr. Hill’s family, Christopher M. Chestnut, who also said, “Hopefully, this will set a precedent for discouraging paramilitary policing.”


[Officer Olsen's attorney Mr. Samuel] added, “When this case is presented in a fair manner to a jury in an open courtroom, Officer Olsen will be fully exonerated.”

Grand juries in Georgia have rarely returned indictments against police officers who were involved in shootings. In October, The Atlanta Journal-Constitution reported that the state had logged more than 170 fatal police shootings since 2010, and that just one police officer had been charged in connection with the killing of a civilian. (The case against that officer, in a city south of Atlanta, was ultimately dismissed.)

Dekalb Officer Who Shot Naked, Unarmed Man Has Resigned

A white Atlanta-area police officer who shot a naked, mentally ill black veteran who was unarmed has resigned.

Maj. Stephen Fore with the DeKalb County Police Department says Officer Robert Olsen resigned from the department Monday

Naked, unarmed, mentally ill, veteran, black. I just... don't know what to say.

Charges should be dismissed against a white former Atlanta-area police officer who shot an unarmed, naked, mentally ill black veteran because grand jury secrecy was violated in the case, the ex-officer's lawyer argued Friday in court.

During a hearing on Olsen's motion to dismiss the indictment, defense attorney Don Samuel argued that extra, unnecessary people were in the room during the grand jury proceeding, including multiple people from the district attorney's office, an expert witness and a court reporter who didn't transcribe anything but a statement by the officer.

"It was like a circus at times," Samuel said.

Prosecutor Chris Timmons countered that prosecuting a police officer is more complicated than other cases, essentially requiring a mini trial, and therefore extra prosecutors and investigators were necessary to present the evidence quickly and efficiently.

11th Circuit Revives Suit on Police Shooting of Anthony Hill

The U.S. Court of Appeals for the Eleventh Circuit has revived a suit filed by the parents of Anthony Hill, a 27-year-old Afghanistan veteran who was naked, unarmed and suffering a mental episode in March 2015 when a responding officer shot and killed him as he approached the patrol car.

Hill's parents, Carolyn Giummo and Anthony Hill Sr., sued DeKalb County police officer Robert Olson, the police department, the then-county CEO and the Board of Commissioners in Georgia's Northern District Court asserting federal claims for violations of Hill's constitutional rights, as well as state wrongful death claims.

As many as five white police officers in Georgia face murder trials next year in the deaths of unarmed black men.

The first case is expected to be that of DeKalb County Police Officer Robert Olsen, in late February. Olsen claimed self-defense after shooting Afghanistan war veteran Anthony Hill, who was naked and unarmed outside a housing complex.

A judge just appointed last week after three judges recused themselves, consulted Friday with the defense and prosecutors to compare their future availability to her calendar. She said she would set a date within the next week.

Based on those conversations, the trial appears likely to begin this summer, in either June or July. There’s a slim chance it could start as early as March 11, but the Judge admitted in court Friday she knew little about the case other than the defendant was a former cop facing murder charges.

March 9 marks the fourth anniversary of the death of Afghanistan War veteran Anthony Hill, shot twice by Olsen after the officer said Hill ran toward him and ignored commands to stop.

I guess this jury room doesn't have a light? Court was supposed to end for the day 5 minutes after the knock but the judge was in drug court. So still waiting.

Jurors on Friday began deliberating the case against former DeKalb County, Georgia, police officer Robert "Chip" Olsen.

Olsen is accused of killing Anthony Hill, a 26-year-old US Air Force veteran of the Afghanistan war. Hill was naked and unarmed at the time when Olsen shot him in the chest and neck in March 2015.

Olsen, who is white, faces several charges, including two counts of felony murder and one count of aggravated assault.

On the day he was shot, someone in Hill's neighborhood called police to report a man "acting deranged, knocking on doors, and crawling around on the ground naked," then-DeKalb County Police Chief Cedric Alexander said after the shooting.

"When the male saw the officer, he charged, running at the officer. The officer called him to stop while stepping backwards, drew his weapon, and fired two shots," Alexander said.

Hill's girlfriend, Bridget Anderson, said he had a history of mental illness and struggled to get the support he needed from the Department of Veterans Affairs.

Olsen did not take the stand during the trial.

During closing arguments on Thursday, the prosecution called for checks and balances within police departments and claimed that Olsen did not follow protocol when using force.

Lance Cross, an assistant district attorney, grabbed a baton and extended it in front of the jury.

"This is a weapon. He could've used this. We wouldn't be here," he said.

Defense attorney Amanda Clark Palmer put her hands-on Olsen's shoulder and said he was "a good cop who had to make a tough decision".

"Chip Olsen is not a murderer and is not guilty of any count in this indictment," she said.

Witnesses testified Olsen asked Hill several times to stop as he ran or charged towards the former officer, slowing down right before the young veteran was shot twice.

The prosecution argued witnesses said Hill had his arms up while naked with nowhere to hide a weapon.

In opening statements last week, prosecutors said Olsen was uncomfortable when he saw Hill running naked outside the apartment complex, but it didn't give him a reason to shoot.

"How does a human being react when you have 6 or 7 seconds, and someone is running at you?" Samuel said.
Since 2005, there have been 106 law enforcement officers who have been arrested for murder or manslaughter resulting from an on-duty shooting, according to research by Philip Stinson, a professor of criminal justice at Bowling Green State University in Ohio.

Stinson's figures show that 35 officers have been convicted of a crime that resulted from the on-duty shooting. The criminal cases for 45 officers didn't result in a conviction, and another 26 cases are still pending, including Olsen's case, according to Stinson.
