10/13/23 Update: Powell & Chesebro: Notice of hearing. The parties having submitted their proposed questions for the juror questionnaire pursuant to the Court's Order entered on 9/15/23 this matter is scheduled for argument on Monday, 10/16/23 @ 10am.
10/16/23 Update: All the attorneys got together Monday to craft the questions to ask the potential jurors for the case. The defense wanted to ask potential jurors true or false questions like: “I think that Trump & his associates tried to steal the election & throw out my vote.” And: “I think every single person who is accused of helping Trump try to overturn the election should be punished.” Prosecutors objected & accused the defense of trying to bend the law. “He stated he said he wanted you to disregard the law & the case law on what’s going on because it’s a high-profile case,” prosecutor Alex Bernick said. Fulton County Superior Court Judge Scott McAfee indicated a reluctance to ask those kinds of questions & also told attorneys he expects a long trial. “Giving everyone an expectation of when we’d be off & we’d be on, and then I’d tighten it instead of a range to just say five months. Maybe we’ll do better,” McAfee said. That’s five or six months for just the first two defendants in this case. (see post #586 page 30, thread #3).
10/16/23 Update: Chesebro: Defendant's 4th Compliance with Discovery obligations. Chesebro & Powell: State's first consolidated Motions in Limine. Next jury selection to begin on 10/23/23 @ 9am with 450 potential jurors.
10/17/23 Update: Powell: State post hearing brief regarding defendant's RICO arguments. Powell & Chesebro: Order on General Demurrers-Denied. Order of Motions to Dismiss on Supremacy Clause & first amendment-Denied.
10/17/23 Update: Chesebro: Entry of appearance of Robert C. Wilson & Serreen F. Meki. 10/18/23 Update: Certificate re petition for testimony of Mike Murphy (out of state witness). Order on motion to exclude communications-Denied.
10/19/23 Update: Attorney Kenneth Chesebro rejected an offer from prosecutors that would have allowed him to avoid prison time by pleading guilty to one count of racketeering. The deal would have forced him to testify against his co-defendants, including Trump, in exchange for three years probation and a $10,000 fine. The terms of the deal also included a written letter of apology. Under Georgia’s first-offender act, the conviction would have been wiped from his record after completing probation. Chesebro rejected the deal in late September.
10/19/23 Update: Former Trump attorney Sidney Powell has pleaded guilty in the Georgia election subversion case, one day before her trial was set to start, to six counts of conspiracy to commit intentional interference with performance of election duties & has agreed to testify truthfully at future trials for her other co-defendants, potentially even Trump. Also to pay a $6,000 fine & $2,700 in restitution to the state of Georgia & write an apology letter to the citizens of Georgia. As part of her guilty plea, Powell is admitting her role in the January 2021 breach of election systems in rural Coffee County, GA. With the help of local GOP officials, a group of Trump supporters accessed & copied information from the county’s election systems in hopes of somehow proving that the election was rigged against Trump.
10/18/23 Update: Chesebro: Order on Motion to Exclude Communications-Denied.
*Sidney Katherine Powell (68) indicted & charged (8/14/23) with 1 count of violation of the Georgia RICO Act (1), 2 counts of conspiracy to commit election fraud (32 & 33), 1 count of conspiracy to commit computer theft (34), 1 count conspiracy to commit computer trespass (35), 1 count conspiracy to commit computer invasion of privacy (36) & 1 count conspiracy to defraud the State. (total 7 counts). Bond $100K. Surrendered 8/23/23. Plead not guilty (8/29/23) & waived arraignment. Represented by Brian T. Rafferty.
10/19/23: took a plea deal & plead guilty to 6 counts of conspiracy to commit intentional interference with performance of election duties & recommended to 6 years probation, required to testify at future trials, pay at $6K fine & #2,700 in restitution to the State & write an apology letter to the citizens of Georgia & admit her role in the January 2021 breach of election systems in Coffee County.
